Travis Scott Wants Astroworld Lawsuit Dismissed Files First Response of Many

Travis Scott doesn't believe he should be tied to litigation when it comes to the tragedy that happened at Astroworld ... which is why he's asking a judge to nix one of the lawsuits against him.

The rapper just filed legal docs, obtained by TMZ, denying the claims against him by a guy named Jessie Garcia, who's alleging he was in the crowd at the festival. Trav's asking that his suit be dismissed with prejudice ... specifically, as it pertains to TS himself, his company (Jack Enterprises) and his foundation/label (Cactus Jack).

Travis is issuing a "general denial," which is a legal term in civil suits that allows one to submit one blanket response to all the allegations against them.

In other words, Travis is making clear that the deaths and injuries are not his responsibility, and he's asking the judge to toss the suit against him and his entities.

BTW, sources with direct knowledge tell TMZ ... Travis is planning to issue a similar response for every civil suit against him -- and trust us, there are many. He might be able to do it in one fell swoop though -- last week, there was a motion filed to combine all 275 cases that have been filed thus far into one "multi-district litigation," which would consolidate many of the suits.

The reason for the ask is because a lot of the claims are eerily similar ... so just for efficiency, they're asking one judge be assigned to the case. The court has yet to rule.

Anyway, now it's clear where Travis stands ... up until now, he's only denied liability through public statements -- saying he was unaware of what was going on that night -- but now, he's making it official for the courts.

DaBaby LAS VEGAS BATTERY CASE DISMISSED

DaBaby is putting his Sin City battery case behind him -- we've learned the charges against him have been dismissed.

According to online court records, the misdemeanor battery charge was dismissed with prejudice ... meaning the case is over and done, and can't be refiled.

The Clark County District Attorney's Office tells TMZ ... the charges were dismissed because DaBaby satisfied everything prosecutors asked him to do in order to resolve the case, including paying the alleged victim $7,500 and staying out of trouble.

TMZ broke the story ... a driver in Las Vegas came forward with allegations against DaBaby back in February, claiming the rapper attacked him during a ride in November 2020. DaBaby's camp described the allegations at the time as a "money grab."

DaBaby's attorneys, David Chesnoff and Richard Schonfeld, tell TMZ ... the rapper denied the allegations and was prepared to fight the case in court.

The case never made it that far, and now it's in DaBaby's rearview.

Chris Cuomo Accused of Sexual Misconduct ... Amid CNN Exit

3:50 PM PT -- A rep for Cuomo tells TMZ ... "To the extent that they were sent to CNN to negate what Chris Cuomo told his audience, he fully stands by his on-air statements about his connection to these issues, both professionally and in a profoundly personal way. If the goal in making these false and unvetted accusations was to see Mr. Cuomo punished by CNN, that may explain his unwarranted termination."

It is now clear what forced CNN's hand in firing Chris Cuomo -- the guy was accused of sexual misconduct this week ... this is as he was already on thin ice.

Attorney Debra S. Katz came forward Sunday to reveal she'd been retained by a woman who wanted to go public with an allegation against the ex-anchor ... something she was apparently inspired to do after hearing about his involvement in his brother's own scandal.

She says while Gov. Cuomo's mess played out in public, Chris came on the air for his own show and said, "I have always cared very deeply about these issues and profoundly so. I just wanted to tell you that." Katz adds, "Hearing the hypocrisy of Chris Cuomo’s on-air words and disgusted by his efforts to try to discredit these women, my client retained counsel to report his serious sexual misconduct against her to CNN."

According to NYT, the woman -- who is remaining anonymous for now -- is a former junior colleague of Chris' from another network, and her claims are unrelated to Gov. Cuomo.

Katz goes on to describe how she contacted CNN on Wednesday -- a day after he'd been suspended -- to report her client's allegations against Chris ... and by Friday, she says she was already in discussions with the network to provide evidence and making the woman available for an interview with CNN's outside counsel.

She finishes by saying, "My client came forward at this time because she felt in sharing her story and related documentation, she could help protect other women. She will continue to cooperate with CNN’s investigation into her allegations. Given the nature of her allegations, she wishes to remain anonymous, and we ask that you respect this decision."

It's not yet clear what exactly the woman is alleging against Chris, but his rep says the "apparently anonymous allegations are not true." CNN says they already had cause to terminate Chris, but when they were made aware of this woman's claims, they saw no reason to delay any further.

Master P Judge, Declare Me Single!!!

Master P says he’s been separated from his estranged wife for over a decade and he's ready to start a new chapter ... so he wants the judge to step in and declare him single.

In new legal docs, obtained by TMZ, Master P says there's no reason he and his ex, Sonya Miller, should remain married any longer ... so he's asking the court to restore their single status ASAP.

Master P points out Sonya filed for divorce way back in 2013 after they separated in 2010, and he says they settled all their issues in 2016 and reached an agreement, but claims the paperwork was never submitted to the court.

So, to move things along, P has now filed legal docs requesting a bifurcation of his divorce ... legal speak for both parties getting single status now, and handling the rest of the divorce issues later.

It looks like Master P thinks the divorce has dragged on long enough and wants to move towards wrapping it all up at this point.

Meagan Good wants to become a gun owner ... and while she says she didn't always feel that way, the recent rise of home invasions in Los Angeles changed her mind.

Meagan explained her change of heart in tonight's interview with Charlamagne Tha God on his Comedy Central show "Tha God's Honest Truth" ... saying she would feel more comfortable with a gun after seeing home invasions on the rise in Hollywood.

The actress says she used to think she didn't need a gun at home because there wouldn't be time to grab the weapon if a situation arose ... but now she says she wants to be able to at least have the option.

While Meagan says she doesn't want to shoot or kill any potential home invaders ... she says she is willing to defend herself with a gun.

Meagan's fears are real.

TMZ broke the story ... Clarence Avant's wife, Jackie, was shot and killed inside the couple's Beverly Hills home Wednesday morning after at least one suspect made it inside during a home invasion robbery.

Alec Baldwin Not in Clear Yet on 'Rust' Probe ... D.A. Reacts to ABC Interview

Alec Baldwin's claim he's not responsible for Halyna Hutchins' death is not echoed by the woman leading the "Rust" shooting investigation -- instead, she says Baldwin, and several others, could still be charged for their roles in the tragedy.

During his sit-down with George Stephanopoulos, Baldwin said he didn't feel guilt over what went down. As he put it, "Someone is responsible for what happened and I can't say who that is, but I know it's not me."

Well, Santa Fe County District Attorney Mary Carmack-Altwies isn't ready to clear his name, criminally, just yet. She tells TMZ ... "Everyone involved in the handling and use of firearms on the set had a duty to behave in a manner such that the safety of others was protected, and it appears that certain actions and inactions contributed to this outcome."

Her Office, along with the Sheriff's Dept., hasn't completed their probe yet ... and she's making it clear no decisions have been made about exactly who could be charged. She says, "Once I have had the opportunity to review the complete investigation, certain individuals may be criminally culpable for his/her actions and/or inactions on the set of Rust."

And, there's this ... Baldwin's explanation for how he fired the fatal shot isn't holding water with weapons expert Steve Wolf, who says the "no trigger" theory IS possible -- but there were several other mistakes made on the set.

Steve's been working with munitions and props for TV and film for decades, so he was particularly interested in Baldwin's claim that the replica antique revolver he was holding fired without him pulling the trigger.

Steve was on Friday's "TMZ Live" when he held up a similar handgun and demonstrated exactly what Baldwin described. He pulled back the hammer on the weapon, but unlike Alec claimed ... Steve says it's just not possible for the hammer to strike and fire a bullet without the trigger getting engaged. Not normally, anyway.

He admitted there are 2 possible exceptions -- first, there could have been a mechanical flaw ... and the other possibility has to do with how the weapon was manufactured.

The Colt .45 Baldwin was using is a replica of an 1873 revolver, and it could have been made without a safety feature that is standard on such weapons now, but wasn't back in the 19th century.

Steve says investigators will be able to determine what really happened by inspecting the gun.

Jussie Smollett Trial Osundairo Bros in Trojan Gear Working Gay Pride Parade

Ola Osundairo says he's not the homophobe Jussie Smollett claims he is, and we've got the photo he showed the court to prove it.

Both Ola and Abel Osundairo testified in the Smollett case Thursday, among questions directly related to the case, Ola also worked to fight Jussie's previous claims he was homophobic.

Ola told the court Jussie was full of it, and he has plenty of respect and experience with the gay community ... working as a bouncer at a gay club and even marching in a Chicago pride parade years ago "handing out condoms and flexing" as a Trojan warrior to promote Trojan condoms.

We've obtained the photo Ola shared with the court, and you can not only see him, but his brother Abel shirtless and decked out in Trojan gear.

Obviously, it's unclear as of now if the photo left an impression on the jury ... but it's certainly a unique piece of evidence.

Phil Collins' Ex-Wife You Can't Hurry Love, But Divorce ... Ditching New Hubby After 16-Months

Phil Collins could probably feel this coming in the air too ... his ex-wife, Orianne Cevey, is heading back to divorce court, already splitting from the guy she married just last year.

Orianne says it's over with her new husband, Tom Bates, with whom she eloped in August 2020. They'd tied the knot at the Graceland Wedding Chapel in Las Vegas ... even as the dust was still settling from her ultra bitter divorce from Phil.

As for why she's filing for divorce this time? Orianne's blaming the worldwide pandemic. Sure. Why not?

She says, "I believe the emotional stress of the COVID quarantine caused me to act in ways and do things that were out of character."

She also not-so-subtly references her Phil drama by saying, "Fortunately, I have faced challenging situations before and like I always have, I will muster all the strength I can, the best team I can find and the courage to do the right thing."

When Orianne, a jewelry designer, says "best team" she's shouting out her attorneys ... the ones who helped her secure a $43 million divorce settlement from the Genesis drummer in 2008.

She and Phil tried to make things work a second time when they got back together from 2016 to 2019, but their second breakup got downright vicious.

You'll recall, she accused Phil of drinking too much and showering too little. She claimed his "stench became so pervasive that he became a hermit." Collins denied the dirty allegations.

Adding injury to those insults ... Orianne auctioned off several of Phil's prized possessions, scoring as much as $22k for one of his gold records. For his part, Phil booted her from their waterfront Miami mansion.

Sooo, good luck, Mr. Bates ... is what Phil's probably saying right now.

Jussie Smollett Trial Osundairo Bro Says He's No Homophobe ... I Worked it at Pride Events, Gay Bars!!!

Jussie Smollett's claim one of the Osundairo bros is homophobic -- and that motivated him to pull off the alleged attack -- is getting shot down in court by the brother himself, who brought Pride pics as evidence.

Ola Osundairo -- one of the prosecution's star witnesses, along with his brother Abel -- testified Thursday in Chicago, saying he respects the gay community and had worked as a bouncer in a gay club called Boystown.

He stopped short of dropping the old "I have gay friends" trope but did say he'd been knee-deep in Pride celebrations. The jury was shown a 2015 photo of one such time -- Ola said he was "handing out condoms and flexing" while dressed as a Trojan warrior.

Get it? Condoms? Trojan? Anyway, there are no cameras in court, so we haven't actually seen the pic in question.

As for Abel Osundairo ... he took the stand and got grilled by Smollett's attorney about his alleged sexual relationship with the "Empire" star. Shay Allen asked when they started dating, and Abel replied they never did. He also denied there being any sexual tension between them, and he only thought of Jussie as a friend.

Jussie Smollett Trial Actor May Have Scored with Jury ... Over Osundairo Drug Testimony

The prosecution's star witnesses in the Jussie Smollett trial may have a credibility problem with one of the Osundairo brothers ... over supplying Jussie with drugs.

Abimbola 'Bola' Osundairo testified he obtained drugs for Smollett, but didn't sell them to him.

The reason this came up during the trial ... back in 2019, texts surfaced between Jussie and one of the brothers about scoring marijuana, cocaine and ecstasy. Documents in the case refer to the transaction this way ... "Smollett would request ... weed, molly, or Whitney [slang for cannabis and controlled substances]." The document goes on to say Jussie used PayPal and Venmo to pay for the drug transactions. And, the document suggests Jussie tried to cover the drug deal by saying payment was for personal training.

Well, Bola testified that yes, he did supply Jussie with drugs, but added, "I'm not a drug dealer. I don't sell."

It's too early to know how this develops ... but jurors may find it hard to swallow Bola's testimony ... that a couple of trainers who have bit parts in a TV show would dig deep into their pockets to pay for the drugs of a wealthy actor. If the jury has issues with this, it could impact the brothers' credibility, which could create the reasonable doubt necessary to acquit Jussie.

The brothers were in court Thursday ... before entering the building they were seen praying together.

Diddy I Wanna Buy Back Sean John ... Out of Bankruptcy

Diddy is swooping in to try to save his namesake brand ... and he's got grand plans to breathe life back into Sean John.

According to new legal docs obtained by TMZ ... the music and fashion mogul's company recently bid $3.3 million to buy the clothing line's assets out of bankruptcy.

Diddy founded the fashion and lifestyle brand way back in 1998, but as it stands now, the brand management firm, GBG USA Inc., which owns 90% of Sean John, is currently in bankruptcy.

The company has reportedly been looking for someone to come in and buy the brand since May ... and now Diddy is stepping up and looking to be the winning bidder.

Sources close to Diddy tell TMZ ... he is very excited about the prospect of reacquiring Sean John and if successful, he plans to reinvigorate the brand.

It's not a done deal yet ... other potential buyers have until December 15 to submit bids.

'RHOSLC' STAR JEN SHAH MY FRAUD CASE SHOULD BE THROWN OUT ... Feds Too Chatty on Hulu!!!

Jen Shah wants the judge in her upcoming fraud trial to dismiss the criminal case against her, saying it's all because of what federal agents chatted about to Hulu cameras.

According to new legal docs, obtained by TMZ ... "The Real Housewives of Salt Lake City" star says the streaming service interviewed two specials agents from Homeland Security for a new documentary, where they gave out details about the investigation that weren't publicly available and opined on Shah, offering lots of commentary on the "lavish lifestyle" of "fraudsters."

Jen claims Agent Rick Patel specifically commented on the circumstances surrounding her arrest ... and says Agent Agnieszka Norman made "highly prejudicial" statements about her allegedly hiding money in offshore accounts, even going so far as to suggest the origin of the case against Shah came from an investigation into a narcotics smuggling ring.

As we reported ... Jen was arrested back in March for allegedly targeting and scamming folks out of their money, with the feds recently accusing her of "greater culpability" in the scheme. The trial is scheduled to get underway in March, and she's claimed total innocence and pled not guilty.

In the docs, Jen says the agents' statements on the ABC News doc "The Housewife and the Shah Shocker" destroyed any chance of her getting a fair trial by tainting the jury pool because the program is full of opinions that will lead people to presume she's guilty.

Shah not only wants permission to file a motion to dismiss the indictment against her, but she also wants to hit the feds with sanctions and wants the judge to order them to hand over any other info about any other collabs prosecutors' and the feds' might have with the media regarding her case.

Cop Kicking Dog Assault Captured on Ring Cam ... PD Explains Encounter

An Indiana cop captured on video kicking a dog on someone's front porch will not be prosecuted ... and his bosses say that's due to the full picture of what happened.

The disturbing video was posted this week by a woman who wrote, "Yesterday evening while my family and I were at work, someone broke into my home. My dogs ran the intruder off. This was the response shortly after a neighbor called. My home needed help and all it received was hurt."

Of course, outrage ensued ... and many were calling for the officer's badge number, not to mention his job. On its face, it looks like the cop is just going to town on the unleashed dog, which was barking at him.

Well, apparently there's more to the story. Terre Haute PD tells TMZ neighbors had been calling about this dog and another from this home constantly being on the loose and attacking people, including kids.

On this particular night, Nov. 29, they got a call about a white pit bull on the loose in the neighborhood -- just the latest call for this exact thing, they say. Officers came out, and THPD says they actually encountered 2 dogs -- including the one seen in this video -- which were allegedly lunging at the officers.

After talking to neighbors about how the dogs escaped their backyard, THPD says this sergeant walked onto the porch ... and that's where the video picks begins. The owners apparently weren't home, so the officers waited ... and then cited the owners when they eventually arrived, ringing 'em up for 6 separate counts related to the dogs being loose.

As for what happens now ... well, THPD says the Virgo County Prosecutor's Office has already reviewed the case, and found the cop didn't violate any laws. Still, the department says it's conducting its own review, and the cop is on leave for now.

They also claim the dog's owners have declined to file any further complaint, or to review any other bodycam footage the officers recorded that night.

What's interesting ... she never said if she believed he was actually attacked on the streets of Chicago back in 2019. A jury has been selected and testimony has begun. It's unclear if Jussie will take the stand in his own defense. Typically, defendants in criminal cases stay mum, but this case almost demands Jussie tell the jury his version of what happened.

It seems the jury's verdict will be irrelevant to Vivica. She not only supports her former "Empire" co-star -- she wants to do a project with him in the future.

'Rust' Movie Shooting Cops Looking Into Ammo Supplier ... Get New Search Warrant

5:11 PM PT -- Hannah's attorney, Jason Bowles, tells TMZ ... sheriffs took a huge step towards finding who put live ammo on the movie set by executing the search warrant, and the expectation is for the FBI to compare and analyze the live rounds from the set with the live rounds seized at PDQ Arm & Prop to determine where they came from.

The big mystery in the fatal shooting on the set of Alec Baldwin's movie "Rust" remains ... how live rounds ended up in the weapon, and now investigators are taking a closer look at the film's ammo supplier.

According to a new search warrant, obtained by TMZ, detectives in New Mexico have interviewed a guy named Seth Kenney, one of the suppliers of the ammunition head armorer Hannah Reed used on set.

Cops also spoke to Hannah's father, Thell Reed, who himself is an experienced armorer who has worked with Seth. In the docs, cops say Thell told them he and Seth crossed paths on a different production ... a month or 2 before the "Rust" tragedy.

What's interesting about that is ... Thell claims Seth brought live ammo -- a can with about 200 to 300 rounds -- to that set for the purpose of weapons training. When the training was completed, Thell says Seth took back the remaining bullets, and claims that included some live Colt .45 ammo.

The gun Baldwin fired was a long barrel Colt .45. You see where Thell is going with this -- he told cops the leftover ammo from his production might match that which killed cinematographer Halyna Hutchins.

That's his theory, anyway, and cops are willing to check it out -- the Santa Fe County Sheriff's Dept. got the warrant to search Seth's company, PDQ Arm & Prop.

Presumably, they want to see if the fatal round matches those in the can of live ammo from a couple months ago. The judge signed off, giving detectives the greenlight to scoop up the potential evidence.

And, there's this ... according to the docs, cops also spoke to "Rust" prop master, Sarah Zachry, who said she checked the ammo box -- after Halyna was shot -- and found some bullets that rattled, indicating they're dummy rounds, and others that didn't. That led her to believe there were even more live rounds in the ammo box.

Remember, Hannah's attorneys floated a theory that someone, perhaps a disgruntled crew member, intentionally brought live bullets on set to sabotage the production -- but D.A. Mary Carmack-Altwies has said she isn't buying that.

Aaron Carter My Fam Wants Me In Conservatorship ... Went Behind My Back W/ Ex

Aaron Carter thinks his family is actively working to place him under a conservatorship ... and he claims they've been going behind his back and talking to his now-ex to do so.

Aaron tells TMZ ... he was FaceTiming with his friend Monday and was told his fiancee Melanie Martin regularly communicates with his twin sister, Angel Conrad, a revelation that felt like betrayal.

Remember, Aaron is estranged from his family -- in 2019 Angel got a restraining order against him after claiming he threatened to send hitmen to her door -- and he tells us Melanie knew he did not want her talking to his fam.

Aaron and Melanie have an on-again-off-again relationship, and every time they broke up he claims his family would reach out to her and see if she was OK ... but he thinks they weren't being nice, there were ulterior motives.

The way Aaron sees it ... his family is trying to gain an ally in Melanie as part of a plan to get a conservatorship over him, using her to gather information for the case.

However, Melanie tells TMZ .. she doesn’t believe his family is trying to get a conservatorship and they never grilled her on info.

Aaron says he confronted Melanie after Monday's FaceTime and claims she denied talking to his family initially, but then admitted it was true and copped to communicating with them.

Sources close to Aaron's brother, Nick Carter, tell TMZ … Nick and his wife, Lauren, have no part in wanting to put Aaron under a conservatorship, and they haven't talked to Melanie because they have no relationship with Aaron or Melanie.

We're told people close to Nick see this as another way of Aaron trying to bring Nick and his family down.
