Morgan Wallen Fan Sues Over Canceled Concert ... Then Takes It Back!!!
12:26 PM PT -- The would-be-concertgoer has filed to dismiss her lawsuit against Morgan Wallen. However, she's dismissing it without prejudice ... which means, it can be refiled. No word yet on why she's had a change of heart.
Morgan Wallen is having some legal headaches after canceling his concert in Mississippi ... 'cause he just got sued by an angry fan!!
According to court docs, obtained by TMZ, Brandi Burcham filed the federal lawsuit Monday against the country music star, accusing Wallen of breach of contract and negligence.
In the suit, Burcham says Wallen skipped out on his Sunday performance at Vaught-Hemingway Stadium in Oxford, Mississippi, after he claimed he lost his voice minutes before he was to take the stage.
Burcham says that after Wallen made the announcement on Instagram, the large screens around the stadium displayed messages, promising the audience would receive full ticket refunds.

But, Burcham pointed out that the University of Mississippi -- which hosted the sold-out event -- has yet to reimburse ticketholders.
She also says the guaranteed refunds do not take into account concertgoers' "out of pocket expenses," such as food, lodging, transportation and other fees.
Not only that ... Burcham wants to make the suit a class action so she can incorporate other fans impacted by Wallen canceling his show as part of his "One Night at a Time Global Tour."
If the judge certifies the class action, Burcham will likely get others to join the suit. Right after the concert was nixed, video showed many adults upset as they left the venue with their children crying.
We reached out to Wallen's reps for comment about the lawsuit...so far no word back.

Pete Davidson's late-night car crash didn't result in serious injury, but that doesn't mean the comedian is gonna get off scot-free ... because we've learned he's now facing possible criminal charges as a result of the incident.
Law enforcement sources tell TMZ ... the Beverly Hills Police Department recently wrapped its investigation, and sent the case over to the L.A. County District Attorney's Office to determine whether Pete will be charged for the crash.
As we first reported, drugs and alcohol were ruled out as factors in the mishap, but we know Pete was traveling at a high rate of speed when he crashed ... so you gotta imagine at the very least, a reckless driving charge is on the table.
TMZ broke the story ... Pete was driving with his girlfriend, Chase Sui Wonders, through Bev Hills last month when he lost control of his Mercedes, drove through someone's yard and crashed into the side of their house. No one was injured.
Pete was not cited at the time for the crash, but that didn't mean he was in the clear.
We should note, the case is headed to the District Attorney, which usually handles felony cases ... but in Beverly Hills, the D.A. also can handle misdemeanor charges.

We know Jonathan Majors' alleged DV victim was out partying after the incident in question -- but now -- there's video that appears to support Majors' team's claim she was just fine.
TMZ has obtained security footage that was referenced in a filing last week by his legal team -- where they submitted still images that they argued prove their case ... namely, that his woman was not assaulted by Majors at all, and that this whole thing is a false witch hunt.
That's been their argument from the beginning ... and the new video does seem to firm up their POV -- at least on its face, anyway.
Check out the clips for yourself ... we're told this was recorded at Loosie's Nightclub near Little Italy in Lower Manhattan after the taxi altercation with Majors -- which this woman claims turned violent and left her with injuries. However, here, she doesn't look too hurt.
You can view everything that Majors' attorney, Priya Chaudhry, noted in her previous filing -- including where the alleged victim is seen walking in normally, ordering drinks, dancing and pushing her hair back with her hand ... which she claimed was injured by Majors.
There's an interesting moment where this woman is dancing by a DJ booth. She puts her drink down on the ledge, chats with the DJ and then launches forward abruptly ... possibly hitting her head. Later, you see her leaving while holding hands with another woman.
Remember, Majors' attorney claimed last week that her client was not with the alleged victim after the taxi cab moment ... and that he didn't come into contact with her again until the following morning -- when he allegedly found her unconscious in his bathroom.

At that point, he called 911 on her behalf ... and that's when cops showed up and arrested him.
His team all along has also insisted purported text messages sent from the alleged victim to Jonathan in the aftermath of all this -- where she appears to recant her allegations and apologize to him -- do not make any reference to injuries supposedly inflicted by him.
All this evidence -- including the full surveillance footage videos -- has been submitted to the D.A. there in Manhattan. His lawyers have also said they have witnesses (including the cab driver) who'll testify to what they apparently saw ... notably, that JM didn't put his hands on her.

Casey Anthony hanging out in the kids' toy section at Disney World sure is a strange sight to see -- but that's exactly what you got here as she continues her trip at the house of mouse.
The formerly acquitted defendant -- who was on trial in Florida over a decade ago for the murder of her daughter -- was spotted again Friday at the Happiest Place on Earth ... only this time, she seemed interested in the plush doll options that the Mouse House had to offer.
We're told these photos were taken inside one of the general merchandise stores within Downtown Disney Springs ... and, as you can see, she's perusing and browsing the toys.
Granted, just about everything inside this store is child-friendly -- but still ... it's a little jarring considering her history with her own late daughter, Caylee -- who was found dead in 2008 not far from here, which became the center of a massively publicized trial against her mom.
Like we said ... Casey was found not guilty of any of the serious charges pertaining to Caylee's death. She was only found guilty of lying to the police at the time -- and got off on everything else. And yet, she still has that stench hovering around here ... just like O.J.
Anyhoo ... Casey ventured elsewhere at Disney World this weekend, including to the Epcot Center where eyewitnesses saw her in the Japan area. Epcot breaks up its sections into worldly corners, and this photo of Casey suggests she knew people recognized her.
As we reported ... Casey appears to be there with at least two other women who are tagging along, and there's been no indication she's trying to maintain a low profile whatsoever.
Of course, that's her prerogative ... but she's also gotta realize people are probably going to do double takes if they notice her, and Disney-goers undoubtedly have. Nevertheless, CA seems to be relatively unbothered and is carrying on with her business like nothing happened.
Of course, something horrible did happen ... and many haven't forgotten.

Celebrity Cruises Sued for Storing Man Who Died in Drinks Cooler
The family of a Florida man who died on a Celebrity Cruises ship and was allegedly put in a drinks cooler is suing the company for a million bucks.
78-year-old Robert Lewis Jones died on the Celebrity Equinox back in August in the middle of the high seas. When the ship docked in Ft. Lauderdale 6 days later, his wife says she learned the body of her husband of 55 years was placed in a walk-in cooler, which is used to stock beverages and keep them cold.
The lawsuit claims the body should have been placed in the cruise ship's morgue for proper care. They say as a result Jones' body was badly decomposed.
The lawsuit seems to allege the corpse was at first placed in the morgue but then moved to the cooler.
The ship docked in Puerto Rico after Jones died, and the suit claims his widow was given 2 options ... take the body off in Puerto Rico or keep it in the morgue until it returned to Ft. Lauderdale. The suit claims the crew urged his widow to keep the body on board, which she did.
When the ship docked in Ft. Lauderdale, a Sheriff's deputy came on board and the body was nowhere to be seen in the morgue. The suit claims funeral service workers found it inside a blood-splattered bag, laying on the floor of the cooler.
The body was badly decomposed because the temperature was not suitable for preserving it. The family wanted an open casket, but Jones' body was green and bloated, so they couldn't follow their long-standing family tradition.

Shannen Doherty Files for Divorce ... And It Ain't Pretty

Shannen Doherty is pulling the plug on her 11-year marriage, filing for divorce from Kurt Iswarienko ... and we're told things are nasty behind the scenes.
Shannen filed docs, obtained by TMZ, Friday in L.A. stating the two have been split up since back in January ... they were married in October 2011 and did not have any kids together.
Shannen's rep, Leslie Sloane, tells TMZ ... "Divorce is the last thing Shannen wanted. Unfortunately, she felt she was left with no other option. You can contact Kurt's agent, Collier Grimm at PICTUREKID as she is intimately involved." Not hard to read between the lines.
Sources close to the estranged couple tell us Shannen's living with stage 4 cancer and the divorce is very acrimonious ... which makes things all the more difficult.
According to the docs, filed by Disso Queen Laura Wasser, Shannen is asking for spousal support, but for it not to be awarded to Kurt. We're told there was no prenup.
Kurt was Shannen's third husband ... she was previously married to Ashley Hamilton from 1993 to 1994 and to Rick Salomon from 2002 to 2003.

Colorado Bus Driver Facing 30 Charges Of Child Abuse ... After Intentionally Slamming On Brakes
A school bus driver in Colorado reportedly got stripped from his job after getting caught using his brakes as a cruel way to teach students to stay seated -- and he's apparently now facing a slew of charges as a result.
Douglas County School District bus driver Brian Fitzgerald tried to turn a recent ride home from Castle Rock Elementary into a messed up & teachable moment for the kiddos in his vehicle last month, as the security footage shows.
You can see him ask them to sit down, but it seems to fall on deaf ears ... he then offers a word of warning if they don't behave, then suddenly slams on his brakes -- throwing the kids forward with a loud thud, and resulting in a few kids shouting as it happens.
Fitzgerald makes sure they got the message, before demanding again that they all sit down ... it sounds like one kid asks "Why did he do that?" One child was reportedly bleeding on their cheek after getting brake-checked.
He's reportedly been fired from the district, but now is looking at 30 misdemeanor counts of child abuse, as well as a count of child abuse with bodily injuries. Fitzgerald's scheduled to appear in court next month.
Lesson learned -- on Fitzgerald's part, at least.

Alec Baldwin's 'Rust' Gun that Killed Cinematographer Had Modified Trigger More Embarrassment for Prosecutors
Alec Baldwin continues to embarrass Santa Fe New Mexico authorities who charged him with involuntary manslaughter ... because he may have been right all along when he insisted he never pulled the trigger on the gun that killed cinematographer Halyna Hutchins.
The prop gun Baldwin used back in 2021 had been modified, this according to the L.A. Times ... the trigger mechanism had been changed which increased the probability it could have misfired without Baldwin pulling the trigger.
Baldwin insisted he never pulled the trigger, something prosecutors and even the FBI disputed. The D.A. made a big deal of its theory that pulling the trigger was a major component of its case ... a case that has now gone up in flames.
What's unclear ... when did authorities learn of the modification on the gun? And how could it be ... Baldwin was charged before the authorities properly examined the weapon to understand exactly what happened.
The involuntary manslaughter case against Baldwin is being dropped ... less than 2 weeks before the trial is set to begin. The case was widely criticized, in no small part because the D.A. somehow felt an actor was responsible for checking the work of an expert armorer.
Hannah Gutierrez-Reed, the armorer on the set, remains the only person charged with involuntary manslaughter.

Ralph Yarl is alive today thanks, in part, to the actions of 2 neighbors who came to his assistance minutes after Andrew Lester shot the 16-year-old boy twice -- and one of those neighbors is tearfully sharing the traumatic experience.
Jodi Rae joined us Thursday on "TMZ Live," and was almost immediately choked up remembering when Ralph banged on her front door, desperately seeking help. She says she couldn't see out her front door, and was uncertain about what was going on outside.
She had not heard the gunshots, but says it was clear Ralph was in dire need of assistance ... so, she decided to call 911. The operator told her there was an active shooter in the area, and advised Jodi not to open her door.
This definitely created a massive dilemma for Jodi ... one that brought her to tears as she told us about it -- she wanted to make sure her own son remained safe in their home, but also wanted to help Ralph, who she could see through her window falling to his knees.
Jodi says once she saw another neighbor walking outside, she figured the danger must have passed ... and immediately ran to Ralph's side. When she saw pools of blood outside her door, she realized the teen had been shot.
The story gets even more gripping and emotional at this point ... Jodi says she and a male neighbor used a towel to apply pressure to Ralph's head wound, held his hand and talked to him about school ... anything to keep his mind off the pain he was clearly suffering.
She fought through tears to tell us what Ralph told them about getting shot. She says she's had very limited contact with the shooter, Lester, since moving to the Kansas City neighborhood last year.
Jodi says she just kept thinking, "That's somebody's son," and knew she had to do something to help him. Sadly, she says there's been some backlash against her and other neighbors ... people who are, incorrectly, assuming the community did nothing to help Ralph.
While that's clearly not what happened, Jodi says she's mostly concerned with Ralph's recovery. She says, "Nothing compares to what that young man is living through every day."
As we reported, Ralph is out of the hospital and recovering at home. Lester, meanwhile, has been arrested and charged with first-degree assault and armed criminal action.

Alec Baldwin has been vindicated in the "Rust" shooting case ... at least criminally, because the New Mexico prosecutors will drop the involuntary manslaughter case against him ... sources with direct knowledge tell TMZ.
We're told Baldwin has been informed the case against him is over. Attorneys Alex Spiro and Luke Nikas were expected to wage legal war in less than 2 weeks ... but the D.A. blinked in a big way.
Frankly, it makes a lot of sense. The D.A. has charged armorer Hannah Gutierrez-Reed with involuntary manslaughter, presumably because she's the expert, so it doesn't make a whole lot of sense why an actor would double-check her work.
Beyond that, although Baldwin is an executive producer on the movie, he's not the one making day-to-day decisions.
As you know, the accidental shooting took the life of cinematographer Halyna Hutchins.
The case against Baldwin will be dismissed without prejudice, meaning it could be filed in the future, but that seems to be little more than a face-saving move by the D.A.
Spiro and attorney Luke Nikas tell TMZ ... "We are pleased with the decision to dismiss the case against Alec Baldwin and encourage a proper investigation into the facts and circumstances of this tragic accident."

Jonathan Majors Video, Witness Prove I Didn't Strike Ex-GF ... She Went Clubbing After Incident

Jonathan Majors says the man who was driving him and his now ex-girlfriend the night of their alleged domestic incident will testify the actor did not strike her -- and he claims there's video proof she was not injured when she went out to a club after their altercation.
Jonathan's attorney Priya Chaudhry filed docs Wednesday in Manhattan, informing the court the driver witnessed what went down between Jonathan and the woman back in March. According to the docs, obtained by TMZ, the driver saw the woman assault Majors -- around 1 AM on March 25 -- "while she was attempting to steal his phone."
Further, the "Creed III" star says the driver will testify he never struck the alleged victim "in any way at any time, or even raised his voice." Majors and his attorney also say the driver saw her "hitting, scratching, and attacking" Jonathan ... and that Jonathan asked the driver to stop the car, so he could escape her attack ... which he did.
The woman allegedly told police she suffered a broken finger and a laceration behind her ear during the altercation -- however, in the document, Chaudhry says they have proof that's a "complete lie."
She says they have hours of security videos showing the woman went clubbing and got drunk after Majors left her in the car -- and she also texted him, accusing him of infidelity and threatening suicide.
As for what happened while she was out at a nightclub ... Majors' court filing includes screen shots of security video showing the woman freely using her right hand, which she claimed Majors injured.
In the videos, they say she casually pushes her hair behind her right ear, reaches into her bag several times, sorts through credit cards, handles phones, holds a menu and easily holds a glass of champagne.
They say she was seen partying pretty hard, throwing back shots and champagne with friends without any visible sign of injury.
When her night out at the club was over, they claim she showed up at Majors home at 3:23 AM ... entered his apartment, and called him 32 times and sent several angry, jealous text messages. Majors was not home when she got there.
Chaudhry says none of the text messages accuse Jonathan of injuring her, nor does she mention any discomfort from alleged injuries.
They say Majors got home at 11:13 AM, and found her unconscious and half naked on the floor of his walk-in closet. He also discovered she allegedly threw up in his bed, and told him she'd taken "a few sleeping tablets."
Majors then called 911, and claim when paramedics arrived, the woman repeatedly told them "I don't know" when asked what happened to her.
In the document, Chaudhry claims body cam footage shows police interviewing the woman, and "clearly coaching her to say that Mr. Majors grabbed her by the throat." Chaudhry claims the alleged victim never made that claim to anyone prior to the officer's direction.
TMZ broke the story ... Majors was arrested March 25th, and charged with misdemeanor assault, aggravated harassment, attempted assault and harassment.
Chaudhry and Majors want the D.A. to review their evidence swiftly and "dismiss these false charges against him."
As we've reported, the case has already cost him a lot, professionally -- his management team and PR firm reportedly dropped him, and the U.S. Army yanked a popular recruiting commercial starring Majors.
Ralph Yarl Shooting Grandson of Shooter Says His Grandpa's a Racist
The white geriatric gunman who shot and nearly killed a 16-year-old Black youth in Missouri is a Trump supporter who has been radicalized by racist conservative views in recent years ... at least according to his grandson.
Klint Ludwig was on CNN Thursday, railing on his 84-year-old grandfather, Andrew Lester, who stands accused of shooting Ralph Yarl outside Lester's Kansas City home last week.
Ludwig said he was "disgusted" by Lester's alleged attack on Yarl, calling it a "horrible tragedy." Ludwig also said he was 100 percent in Yarl's corner.
Don Lemon asked Ludwig why he was speaking out against his own grandfather. Ludwig responded, "It was right thing to do," adding, "This country it happens over and over again where people get away with killing unarmed innocent Black people."
He continued, "People need to speak out and not make any excuses for this kind of behavior and violence."
Ludwig went even deeper, accusing his grandfather of being a "stock American Christian male" with "racist tendencies."
Ludwig also stated as Lester got older, he became conspiratorial and would say "weird racist things," which seemed to be the result of watching conservative media outlets, such as FOX News, all day long. Ludwig went on to say Lester is a Trump supporter and, within the last five years or so, he became radicalized with these toxic views.
As we reported, Yarl mistakenly arrived at Lester's home in Kansas City last week while trying to pick up his younger siblings, who were staying at a different address.
After Yarl rang the bell, Lester answered the door while armed with a loaded revolver. Lester then opened fire through a glass door, hitting Yarl in the head and then firing a second time, hitting him in the right arm. At no point did Yarl step foot inside Lester's house.
Yarl was rushed to a hospital with potentially life-threatening injuries, but, miraculously, he survived. In fact, his attorney, Lee Merritt, posted a photo of the two back at Ralph's home Wednesday.
According to court documents, Lester told police he spotted Yarl yanking on an outer door handle and thought the teen was trying to break into his home. That's why, Lester says, he shot Yarl.
But Yarl allegedly gave a different story to investigators, telling them that he never pulled on the door handle and that he was standing patiently waiting for someone to answer the bell he rang.
Lester surrendered to police Tuesday and appeared in a Clay County court to face charges of first-degree assault and armed criminal action. He later posted $200,000 bail and was released from jail. He has pleaded not guilty.

We're told Boskovich claimed at one point in the argument, David said that this won't end well for her -- which apparently made her fearful. She filed a police report and now the LAPD is investigating the incident.
We're told this will probably land in the prosecutor's office once the investigation wraps and they'll make a decision on whether to file a case or not.
TMZ broke the story, David and his ex-wife Brooke Burke finalized their divorce in 2020, agreeing to a 50/50 split of physical and legal custody of their kids. We also saw David packing on some PDA with another woman in St. Barts about a year before getting divorced.
We spoke with David who tells us he not only hasn't been contacted by the LAPD on the investigation, but he's also unaware of the allegations being made against him.

Jonathan Majors Report: More Alleged Victims Coming Forward ... Attorney Says He's Innocent
There appears to be a reason why Jonathan Majors is being cut from projects as his team jumps ship ... he reportedly has more alleged abuse victims waiting in the wings.
The alleged victims are coming forward and cooperating with the Manhattan District Attorney's Office, according to Variety.

As we reported, Majors was arrested last month in New York City for misdemeanor assault, aggravated harassment, attempted assault, and harassment after allegedly slapping his girlfriend in the back of a taxi cab.
Variety reports the alleged incident is just the tip of the iceberg ... which explains why honchos in the entertainment industry are distancing themselves from the "Creed III" star.
Remember ... in the wake of his arrest, Majors was dropped by his management team, and a major PR firm pulled the plug on working with him. He's also been uninvited from the upcoming Met Gala.
Majors' attorney claims the alleged victim from the NYC arrest texted the actor after he got busted to say ... "she was the one who used physical force against him."
As you know, Majors has been working nonstop in Hollywood lately ... he's set up to be the next big villain in the MCU after starring in the recent 'Ant-Man' movie.
But, with other alleged victims reportedly waiting in the wings ... it appears the hits could keep coming for Majors.

The Menendez brothers getting a new trial because an ex-member of Menudo is accusing their father of rape is no slam dunk ... it's more of a Hail Mary, according to a criminal defense lawyer.
Attorney Alan Jackson joined us Wednesday on "TMZ Live" and we asked him what Lyle and Erik Menendez should be expecting from Menudo member Roy Rosselló's explosive revelation about their father, Jose Menendez.
Alan believes the chances are remote the Menendez brothers get a new trial based on Roy's accusation.
Still, Alan says Lyle and Erik's defense team will try to get the accusation before a judge and present it as new evidence in hope of overturning their convictions -- because even if it's a long shot, it's something.
The way Alan sees it ... Roy's claim is unlikely to change anything for Lyle and Erik, who were convicted in 1996 of murdering their parents, despite arguing their father sexually molested them for years and they only killed him out of fear.
Alan says Roy's accusation -- that music executive Jose drugged and sexually assaulted him in the Menendez family's New Jersey home -- isn't directly connected to the evidence pointing to the brothers murdering their parents with shotguns.
The Menendez brothers are serving life sentences ... and Alan cautions against them getting their hopes up now that Roy's come forward to back the allegation -- made during their trial -- that their father had molested them.

R. Kelly Appeals Federal Sex Crimes Case in NY ... Claims Gov't Didn't Prove Guilt

R. Kelly has officially filed an appeal in his federal sex crimes case out of New York -- and he's got a laundry list of reasons why he thinks his conviction should be reversed.
According to legal docs, obtained by TMZ, the controversial singer -- who was found guilty in 2021 on 9 federal counts that included RICO charges as well as charges pertaining to sex crimes and human trafficking -- says he got a raw deal throughout the lengthy trial.
For starters, R. Kelly's legal team simply argues the government did not meet its burden of proof in court ... despite a jury convicting him on all counts. His lawyers have specific gripes about the jury and some of the evidence prosecutors were allowed to submit during trial.
For the jury, his attorneys say that at least 4 of the jurors selected have since admitted prejudging his guilt before handing down their official verdict -- and he says at least 2 of them had watched the "Surviving R. Kelly" docuseries, and should never have been seated on the jury.
As for the underage girls he's alleged to have groomed and molested ... Kelly seems to have an explanation for what happened in each case. He says some were, in fact, at least 18 years old when he met and engaged in sexual relationships with them -- despite prosecutors' insistence the alleged grooming started while they were still minors.
In the cases where Kelly is alleged to have met with actual minors ... his team claims he was misled by those girls at the time about their real age.
Now, on the evidence front -- his team claims there was a lot of stuff that was allowed in during the trial that shouldn't have been seen or heard by the jury ... and hurt his ability to get a fair trial.
For instance, he says details about his sex life and/or conduct and behavior with former partners or exes of his -- accounts of which dove into STDs, sexual preferences and behavior in the bedroom -- were not relevant to the crimes being alleged against him, and were simply a way for prosecutors to sway the jury.
He also pushes back on former employees/associates of his that were trotted out on the stand ... saying a lot of them falsely testified to things they had no real knowledge of and weren't privy to in their capacity as staffers.
He's asking the appeals court to reverse his convictions or, at a minimum, order a new trial. Of course, there's a second federal case in which he was also convicted out of Chicago. No appeal for that just yet
His attorney, Jennifer Bonjean, filed R. Kelly's appeal Tuesday. He's currently serving a 30-year sentence in this matter ... not to mention another 20 years for the Chicago case.
