Drake Trying To Set Aside Deposition Request Files Motion to Get Out of It

Drake is trying to put the kibosh on getting deposed in the XXXTENTACION murder trial — and he's making some legal moves to try to get out of it.
The rapper filed a motion, through his attorney Bradford Cohen, asking the judge to set aside the subpoena requiring him to sit for a private deposition in late February.
As we reported, the judge was persuaded by arguments made by defense attorney Mauricio Padilla to call Drake as a witness in the case. Padilla represents Dedrick Williams, one of three defendants charged with killing XXX. The murder trial for the 3 men began last week.
According to the docs, obtained by TMZ, Padilla sent Drake a ZOOM link for the deposition without putting it under seal, which could have compromised Drake's security given that he’s an international star.
Several days later, the docs say Padilla filed a notice with the court but failed to include details on how the ZOOM interview with Drake would be conducted. As a result, Drake says the subpoena was procedurally defective.
Per the motion, Drake also claims his name never appeared in the investigative files and there's nothing to suggest he has any relevant knowledge about the case ... he believes it's unreasonable to ask him to sit for a deposition and says doing so is just an attempt to "add more layers of celebrity and notoriety to a tragic and unfortunate event."
The judge has yet to make a final ruling on Drake's motion.

2:15 PM PT -- Miami PD tells TMZ ... units responded to the address in reference to a possible burglary in progress. Upon arrival, we're told they were notified the suspect could be armed and still in the building -- which spurred a perimeter being set outside.
Cops in Miami have descended upon an area near Bad Bunny's downtown restaurant -- leaving many wondering if he's okay ... but we've learned this has nothing to do with him.
The reggaeton artist's Japanese steakhouse, Gekko, is surrounded by dozens of police vehicles right now -- with SWAT units on the scene as well. The streets are getting blocked off ... and bystanders are filming the dramatic scene.
There are multiple units parked right in front of BB's establishment, with officers seen going in and out the front entrance -- so, naturally, there was panic that something may have happened to the beloved rapper ... that's not the case, though.
Sources directly familiar with the situation tell TMZ ... the owners of Gekko have been notified about a possible fugitive situation that's playing out at the SLS LUX Brickell Hotel -- which is adjacent to Gekko and shares the block. This explains this type of police response.
Our sources tell us Gekko is not directly involved in this matter. We're also told Bad Bunny isn't in FL at the moment, so he's no even in the vicinity of what's happening.
Gekko has become a huge hot spot in the city ... when Bad Bunny and Grutman opened this place back in August, it drew a big crowd and a lot of celebs. So, it's quite well-known.
It sounds like whatever the police are dealing with is fluid. We've reached out to the department for clarification on what exactly is going on, and if there's an active threat.
So far, no word back.

BTK Serial Killer Oklahoma Cops Eyeing Him In '76 Missing Persons Case

The BTK serial killer is back on police radar ...but this time we're told it's to see if he has any connection to the disappearance of an Oklahoma teenager back in 1976.
BTK (real name: Dennis Rader) tells TMZ…he was interviewed January 20 by Osage County Sheriff, Eddie Virden and three other investigators at El Dorado Correctional Facility in Kansas. That's where BTK is serving 10 life terms for killing 10 people from 1974 to 1991. He was captured in 2005 after sending police taunting letters using the moniker, "Bind, Torture, Kill."
Rader said the Osage County cops wanted to know if he was involved in the disappearance of 16-year-old Cynthia Dawn Kinney in Pawhuska, Oklahoma, on June 23, 1976. Kinney was reportedly last seen leaving Osage Laundromat and getting into a beige 1965 Plymouth Belvedere with two people under suspicious circumstances. No one has been arrested.
BTK said police thought he might have a connection to the Kinney case because he was actively committing murders in Wichita, Kansas, during that time frame. Wichita is only about a 2-hour drive to Pawhuska.
The killer also said cops asked him about his connection to Oklahoma and the Boy Scouts. BTK admitted he was in Oklahoma as a Boy Scout, but several years before and after 1976.
BTK categorically denied any involvement in the Kinney case.
Sheriff Virden confirmed to TMZ…he and the other investigators visited BTK in prison to interview the serial killer in a roundabout way regarding the Kinney case.
Virden said investigators were pursuing leads and doing their due diligence to see if BTK fits into the Kinney case considering his criminal activities around that time.
Virden said, “There’s similarities between the time frames. She disappeared in daytime – most of [BTK's] stuff occurred in daytime hours. Some of the stuff that motivated [BTK] -- there are similarities,” but Virden declined to further elaborate.
During the interview, Virden said he also gathered personal information from BTK about his early life, military service and his murders.
Virden ended with this..."There’s additional research going to be done to either rule [BTK] in or out."

'STREET OUTLAWS' RYAN FELLOWS FAMILY SUES DISCOVERY OVER FATAL CRASH

The family of the late "Street Outlaws: Fastest in America" star Ryan Fellows claims both TV networks and studios put his life at risk for financial gain by having him race on an unsafe stretch of road ... and now they're suing over his fatal crash.
According to new legal docs, obtained by TMZ, the Fellows family is going after Warner Bros. Discovery and Lions Gate Entertainment ... accusing the media corporations of negligence they insist led to Ryan's death.
In the docs, the family says the area where 'Street Outlaws' filmed drag racing scenes was a dusty, weather-beaten, rough asphalt 55-mile per hour roadway in the Las Vegas desert, which didn't meet any of the industry safety standards for drag racing.
TMZ broke the story ... Ryan died back in August in a fiery crash during filming for his popular Discovery show. We were told Ryan was racing another driver when he lost control of his car near the finish line, with the vehicle rolling before catching fire.

In the docs, Ryan's family says the roadway where he crashed was only 12 feet wide instead of the industry standard of 30 feet. They also say the sides of the road featured broken asphalt and gravel shoulders with sheer drop-offs, instead of the industry standard concrete barriers.
Ryan's family claims there were numerous crashes during filming, including cars flipping, rolling and catching fire ... and they rip the media giants for filming life-threatening collisions and airing them on TV for profit.
The family claims the rough asphalt caused racecars to lose traction, the narrow lanes left drivers no room for corrections and the gravel shoulders and drop-offs sent racecars into out-of-control slides that only ended when the vehicles dug into the sand, flipped and rolled.
The Fellows say Warner Bros. Discovery knew it was extremely dangerous to hold races on the roadway ... and they claim it was an "extreme departure from what a reasonable careful person would do in the same situation to prevent harm to others."
It gets worse ... Ryan's family says Warner Bros. Discovery had multiple opportunities to move filming to a safer location after "numerous horrific crashes," but they say the network instead "sat back, flipped on the lights and cameras, and waited for the next inevitable crash."

That crash happened August 7, when Ryan's family claims his racecar lost traction on the roadway, slid off the road and flipped into a roll. The Fellows say Ryan's car rolled multiple times before coming to a rest upside down and catching fire, and they claim he hung upside down in the driver's seat on fire for more than 30 minutes before fire crews removed him from the car. By that time, the family says Ryan was horribly burned and dead.
The Fellows say after Ryan's death Warner Bros. Discovery moved the show to a dedicated 75-foot-wide drag strip at a professional California raceway ... and the family says the change "proves the availability and feasibility of a safer alternative to the unsafe desert roadway."
Ryan's family is now suing the media companies and they want punitive and compensatory damages because they say his death is causing suffering and loss of love and companionship.
We reached out to Warner Bros. Discovery ... so far no word back.

Remember ... Kilcher was hit with two counts of workers' comp insurance fraud back in July, following an investigation by the California Dept. of Insurance. Officials said they found evidence the actress improperly collected over $90,000 in disability benefits.

CDOI claimed Kilcher collected the money over the course of 2 years, as a result of a neck injury she said she suffered back in 2018 during filming for "Dora and the Lost City of Gold." Officials claim she continued raking in disability benefits while filming "Yellowstone" episodes in 2019 and charged her with felonies.
Kilcher maintained her innocence, saying she suffered a serious and life-altering traumatic injury on the 'Dora' set, and Camille and Steve set out to clear her name.
The L.A. County District Attorney's Office tells TMZ ... "After the charges were filed, the Workers Compensation Insurance claims adjuster retroactively changed his conclusion regarding her ability to work. We therefore determined that Ms. Kilcher did not commit insurance fraud and advised the court that we were unable to proceed."
In a statement, Kilcher says she's "beyond grateful" her case was dismissed ... and she's thanking Camille and Steve "for their steadfast belief in my innocence." She adds, "without their advocacy, we would not be here today."
Camille and Steve say Kilcher never should have been charged in the first place, and they're gratified she's been vindicated.

Drake Will Be Grilled in XXXTENTACION Murder Case
Drake will have to answer questions about XXXTentacion's murder, and the judge is threatening severe consequences if he misses a deposition.
Mauricio Padilla, the defense attorney for Dedrick Williams -- one of the 3 men accused of killing XXXTentacion -- persuaded the judge it's necessary for Drake to answer questions about his 2017 beef with the late "Look At Me!" rapper.
Drake was originally scheduled to be deposed on January 27, but failed to appear and now must sit for the deposition on February 24, via Zoom. If he misses that date, the judge says he better be in court on Feb. 27 or possibly be charged with contempt.
X and Drake have been intertwined through conspiracy theories for years -- mostly based on claims Drake bit some of his musical style, and one of X's IG stories. Four months before his June 2018 murder, X posted ... "IF ANYONE TRIES TO KILL ME IT WAS @champagnepapi IM snitching RN."
XXXTENTACION deleted the post and said he'd been hacked, but still ... Padilla's doing all he can to create reasonable doubt, and for now, the judge is allowing the far-fetched Drake theory to play out.
The trial began earlier this week as defendants Williams, Michael Boatwright and Trayvon Newsome all face life sentences for their role in killing XXX outside a RIVA Motorsports in June 2018.
Another suspect, Robert Allen, pleaded guilty to second-degree murder and has been testifying throughout the trial.

Billie Eilish and her family are getting court-ordered protection from the man she claims broke into her childhood home.
The "lovely" singer appeared virtually in court Thursday for a hearing, where a judge granted Billie a 5-year restraining order against 39-year-old Christopher Anderson. Billie's parents, Patrick and Maggie, and brother, Finneas, are also getting protection.
TMZ broke the story ... Billie got a temporary restraining order against Anderson last month after her dad claimed Anderson broke into the family home after professing his love for Billie, even though she's never met him.
Billie says she didn't feel safe visiting her family anymore ... especially after they had to call cops to the home 5 times in December as a result of Anderson's unwanted visits.
The permanent restraining order says Anderson must stay 100 yards away from Billie, her family and her parents' house ... and he can't contact her on social media or come near her vehicle or workplace. If he does, police can immediately arrest him.

Ron Jeremy Committed to Mental Hospital ... Rape Trial Derailed
Ron Jeremy isn't going before a jury to face rape charges, because he's being shipped off to a mental hospital ... where he could spend the rest of his days.
The former porn star -- who'd been hit with a 30-count indictment alleging rape, sexual assault and other related crimes -- was committed to a state-run mental hospital in California ... this after being deemed unfit to stand trial.
A judge signed off on Jeremy's fate last month -- ruling that his cognitive ability was in a state of such decline that he couldn't facilitate his own defense.
He can be held for up to two years at the facility ... and there will be periodic checkups to see if his condition improves. The first hearing on his progress is scheduled for early May.
As we reported ... during a hearing last month the judge was informed, after a battery of tests Jeremy was diagnosed with dementia.
They left the door open to continue pursuing charges against him if his condition improves, but for now ... he'll remain at the facility.
Jeremy has been accused by several women of misconduct dating back decades. He pled not guilty in 2020, and his attorney had told the media it's a shame RJ wouldn't get a chance to clear his name in court due to his mental condition.

'Real Housewives' star Teresa Giudice is down a set of wheels ... her Mercedes-Benz was stolen from her New Jersey estate, and now police are working to get the whip back.
Sources with direct knowledge of the investigation tell TMZ ... Teresa's luxury car was stolen overnight Monday, when intruders came onto her $3.35 million property in Montville, NJ and drove off with her Benz.
Our sources say police were called and cops are currently investigating the incident, as well as working to get the car back to the 'RHONJ' star.
As for which Mercedes was stolen, that's unclear ... Teresa has had a G-Wagon for a while, but her hubby, Luis, gifted her a white Benz sedan for Christmas in 2021 when they were still engaged.
The good news ... law enforcement already has some early leads, because we're told there is surveillance video from Teresa's home capturing the crime and the suspects on camera.
We reached out to Teresa's attorney, James Leonard, and he had no comment.

Gabby Petito Parents Release Selfie ... Bruised Face Pre-Traffic Stop
Gabby Petito's family just released a photo that they say backs their wrongful death suit -- namely, what they claim is an alarming selfie taken minutes before cops stopped her -- and proof officers should've taken action.
Attorneys for Gabby's parents -- who filed suit against the Moab Police Dept. in Utah for not intervening to protect their daughter before she was killed by her boyfriend, Brian Laundrie -- distributed a picture they claim was taken on her phone minutes before she and Brian encountered MPD officers on the road ... following a call from a concerned citizen.
The photo appears to show Gabby with a bruised eye and red marks on her face ... something that didn't look nearly as visible in body cam footage taken during the actual traffic stop.
Interestingly, the cop talking to Gabby did point out something on her face ... asking if she'd been hit. He also pointed out what he seemed to think was an injury on her shoulder.
The Petito family says a timestamp from Gabby's selfie shows it was taken at 4:37 PM on August 12. Moab PD's body cam footage started rolling shortly after at around 4:53 PM.
Gabby's parents feel this shows she was obviously injured at the hands of Brian ... and that law enforcement had a duty to step in and shield her. As we now know, the two officers on the scene made a decision not to arrest anyone at the time ... something the Petitos feel warrants at least $50 million in damages.
Of course, Brian Laundrie later confessed to killing his girlfriend in a notebook found after he took his own life. Their disappearance sparked a nationwide search and subsequent investigation that captured the country's interest for months.

ORLANDO BROWN Getting Mental Evaluation... Could Plead Insanity

"That's So Raven" star, Orlando Brown is going to get his head checked to see if he's fit to stand trial in his Ohio criminal case ... opening the door to a possible plea of not guilty by reason of insanity.
According to legal docs obtained by TMZ, Brown's attorney is asking for a mental evaluation to see if the disgraced actor is mentally fit for trial.
Orlando's charged with aggravated menacing, a first-degree misdemeanor in Ohio, for his December arrest. The former Disney star previously pled not guilty, but the results of the evaluation could lead to Orlando changing that plea.
In the meantime, Orlando's on house arrest ... he was released from custody Friday after posting bond of about $25,000.
Orlando Brown Loses Movie Gig After Arrest, Friend Says He Has Mental Health Issue
TMZ broke the story ... Orlando was busted back in December after cops in Ohio say they responded to a call about a fight in progress between 2 men.
Cops say the alleged victim told officers Orlando came at him in a threatening manner while wielding a knife blade and hammer.
As we first reported, Orlando was living under the same roof as the alleged victim, who got him a movie role ... which Brown's since lost as a result of the alleged incident.

Tyre Nichols White Cop Involved In Arrest Fired
Preston Hemphill, the white Memphis police officer involved in the Tyre Nichols arrest who is heard on body cam footage wishing Tyre harm, has just been fired.
The Memphis Police Department announced Hemphill's firing in a Friday news dump ... and he has not been criminally charged in connection with Tyre's death.
Hemphill was one of the first officers to confront Tyre during the fateful January. 7 traffic stop ... and he's alleged to have used his Taser on Tyre.
Hemphill's body cam footage shows him chasing Nichols on foot ... and he's twice heard saying, "I hope they stomp his a**."
As you know ... Tyre was later confronted by 5 Black cops, who used pepper spray and beat him so badly he complained of shortness of breath and ended up in a hospital, where 3 days later he died.
The 5 Black officers ... Tadarrius Bean, Demetrius Haley, Emmitt Martin III, Desmond Mills Jr. and Justin Smith ... were fired before Hemphill, and they've been charged with second-degree murder.

Civil rights attorney Ben Crump, who is representing Tyre's family, has been questioning why Hemphill is not being prosecuted.

In a statement, Memphis PD says they conducted a thorough review of Tyre's arrest and determined Hemphill violated multiple department policies, including personal conduct, truthfulness and not using his Taser properly.
Meanwhile, a 7th Memphis PD officer who was involved in the arrest is on administrative leave ... but the officer's identity has not been publicly revealed.
As we reported ... earlier this week the Memphis Fire Department fired 3 members who responded to the scene in an ambulance, including a pair of EMTs and a lieutenant.

There's been a lot of blame placed on the armorer on the set of "Rust" -- by both the public and law enforcement -- but her attorney says she did everything in her power to ensure everyone working on the project was safe.
We had Jason Bowles, the attorney for Hannah Gutierrez-Reed on "TMZ Live" Friday who talked at length about his client's case ... and shared what he believes were some of the failures that led to the death of Halyna Hutchins.
Bowles says Hannah asked assistant director, Dave Halls, to let her know when Alec Baldwin was going to handle the gun that fired the fatal shot so she could inspect it and give Baldwin proper instruction on how to handle the weapon.
Bowles says Halls never gave Hannah a heads up, simply handing the gun over to Alec without following any sort of safety procedure.
'Rust' Armorer Distraught Directly After Shooting, Says Her Lawyer
What's more -- Bowles claims Hannah was stretched very thin on set -- taking up both the duties as armorer and handling props.
Bowles tells us at one point, Hannah sent an email to production letting them know she needed to focus more of her time on the armorer duties ... a request he says was denied.
As we reported, both Hannah and Baldwin have been charged with involuntary manslaughter. They're both facing up to five years in prison if convicted.

Kelly Clarkson's alleged stalker is now facing a slew of criminal charges after the singer claimed the woman keeps showing up at her home ... even with a restraining order against her.
The L.A. City Attorney's Office tells TMZ ... Huguette Nicole Young was charged last month with one count of stalking, four counts of violating a protective order, and one count of trespassing.
We're told Young pled not guilty and bail was set at $26,000 ... with the court ordering Young to stay the hell away from Kelly, which, frankly, hasn't seemed to work very well in the past.
TMZ broke the story ... Kelly previously got a restraining order against Young, but the woman has since been accused of violating the terms of the restraining order a bunch of times.
As we first told you, Young was busted outside Kelly's San Fernando Valley mansion Jan. 25 after Clarkson's security called 911 after cameras appeared to show the woman meandering around the singer's property. Police raced to the scene and arrested her.
It's super strange ... Clarkson claimed Young was repeatedly showing up to her property at exactly 8:59 PM, and there's still no explanation for the time or significance.
Kelly is concerned, though, because sources connected to her told us she won't allow her kids outside the gate at night.
Young's history with Kelly apparently dates back over a decade. She allegedly first tracked Kelly down at her Nashville estate before the incidents in California. Clarkson says Young sometimes even leaves unwanted gifts outside her home.
The good news for Kelly is ... Young hasn't bailed out yet. If convicted, she's looking at more than a year in jail. Her preliminary hearing is set for February 26.

Chloe Cherry 'Euphoria' Star Charged with Retail Theft ... Allegedly Stole $28 Blouse

"Euphoria" star Chloe Cherry is in some hot water back in her hometown after allegedly stealing a blouse from a local store and getting caught.
Cherry was charged with misdemeanor retail theft in January for an incident that reportedly happened back in December in Lancaster, Pennsylvania.
According to sources with direct knowledge of the case, Chloe entered the Building Character shopping complex on December 27 and took a $28 blouse into a dressing room ... she then held onto the blouse and left without paying.
We're told Chloe paid for other items using a credit card, but is accused of not paying for the blouse. At some point, the police got involved, and cops say Chloe admitted to taking the blouse -- giving it back to an officer.
Chloe's rep, however, has a different take on what happened ... telling us, "In December, there was confusion over a blouse that wasn’t properly charged to my client’s credit card. In no way did she 'admit' to taking the blouse, since that was not the case. This story seems to be more about a local store trading on a celebrity’s name more than anything else.”
Lancaster Online was first to report the story.
Chloe is most famous for her role as Faye on "Euphoria" but has modeled and worked in adult films as well.
Of course, she's not the first celeb to become entangled in alleged shoplifting shenanigans. It was back in 2001 when Winona Ryder was accused of stealing more than $5,000 in designer items from Saks Fifth Avenue in Beverly Hills.
Ryder was charged with four felonies and was sentenced to three years of probation, 480 hours of community service, $3,700 in fines, and $6,355 in restitution ... after completing the community service, her charges were reduced to misdemeanors.
