Kim Kardashian Sued Over 'SKKN' Trademark ... She Calls it a Shakedown

Kim Kardashian is using her celebrity to bully a small business for the rights to a skincare line, according to a new lawsuit ... but Kim's legal team says it's nothing more than a "shakedown effort."

Kim is being sued for trademark infringement over her new brands, SKKN and SKKN BY Kim, by a company out of Brooklyn called Beauty Concepts, which claims it owns the rights to "SKKN+" and says Kim's use of the moniker on her beauty products is confusing customers.

According to the lawsuit, obtained by TMZ, Beauty Concepts says it's a Black and woman-owned business that survived the pandemic, and moved up to a brick-and-mortar store only to learn Kim K was launching her new brand with a strikingly similar name.

In the docs, Beauty Concepts says it reached out to Kim's team after she filed papers trying to lock up rights to "SKKN" ... informing her it already held the trademark for "SKKN+" and asking Kim not to use similar branding. The company claims Kim's team ignored the request and pushed forward, releasing her line anyway.

Kim's attorney, Michael Rhodes, is pushing back, telling TMZ ... "This lawsuit is not what it seems. SKKN BY KIM is a new brand that follows in the footsteps of Ms. Kardashian's successful KKW line of products. Building on independent research and development, her company filed a trademark application for SKKN BY KIM to protect the new branded products. This prompted the current shakedown effort."

Rhodes says, "We applaud Ms. Lunsford for being a small business owner and following her dreams. But that doesn’t give her the right to wrongfully claim that we’ve done something wrong. In its letter, Beauty Concepts claimed to own rights to a logo made up of SKKN+, and had just filed for trademark protection for that logo. The business was a one-person shop offering facials from a single Brooklyn location. The salon had no signage and was by appointment only. To our knowledge, Beauty Concepts sold no products under the SKKN+ name.

He continues, "Beauty Concepts asked that we drop the SKKN name. Of course, we said no. Beauty Concepts then challenged Ms. Kardashian’s trademark applications at the USPTO. Unsurprisingly, the USPTO rejected Beauty Concepts’ own SKKN+ mark saying that “skkn” just means “skin.” Undaunted, Beauty Concepts then tried to make its business seem more than it was – it leased a new storefront, changed its website, etc."

Rhodes says Kim's team tried to work with Beauty Concepts to figure something out, and says he "pointed out running a small esthetician business in Brooklyn does not give it the right to shut down a global skincare line."

Kim and Beauty Concepts are still battling over who has the trademark rights ... and Kim's attorney says BC filed this suit to try to leverage a settlement and score a big payday.

DEPP ATTORNEY CAMILLE VASQUEZ Hollywood, Law Firms All Want a Piece

Johnny Depp's attorney Camille Vasquez is plotting her next move after winning his case against Amber Heard ... and she's in high demand in both the legal world and Hollywood.

Sources with direct knowledge tell TMZ … Camille's considering a wide range of career options in the wake of the Depp-Heard trial, and her rise to fame, including media, law and even authoring a book.

Camille's a "big get" for lots of Hollywood bigwigs ... we're told she's speaking with agents and network execs about a bunch of projects ... like broadcasting roles, speaking engagements, branding opportunities and even starting her own production company.

We're told Camille's taking it slow, and is trying to decide if Hollywood, law or both are the right fit.

As for law ... we're told she's being courted by some major law firms. It makes sense ... law firms are all about snagging clients, and Camille is now in high demand by litigants around the country. We're told at least 4 big law firms are making a full-court press, and last Wednesday in NYC she met with a managing partner at one of them.

She's getting hit up by scores of folks who need a lawyer, and we're told there's one high-profile potential client who's close to going to trial, and she's interested in the case.

As we reported, Camille was hailed as "Wonder Woman" on her way to NYC ... jumping to aid a passenger who was suffering a medical emergency on her flight.

She's also pondering the idea of writing a book ... in her spare time, right?

12:58 PM PT -- Daily Harvest tells TMZ ... "While we do not comment on pending or potential litigation, as soon as we received reports suggesting a possible link between the French Lentil + Leek Crumbles and an adverse reaction, we immediately took action and launched a voluntary recall. We have reached out multiple times directly to consumers who received the product, instructing them to dispose of it and not eat it."

"In parallel, we launched an investigation to identify the root cause, working closely with the FDA, multiple independent labs, and a group of experts that includes microbiologists, toxin and pathogen experts as well as allergists. All pathogen and toxicology results have come back negative so far, but we’re continuing to do extensive testing so we can get to the bottom of this. Everyone who has been affected deserves an answer, and we are committed to making this right."

A woman is suing Daily Harvest, the organic food-subscription company, claiming its French Lentil + Leek Crumbles have upended her life, causing her gallbladder to be removed, liver damage and all sorts of other problems.

Carol Ann Ready claims back in May, she bought the product through her online subscription. The same day she ate the Crumbles, she began experiencing abdominal pain and gastrointestinal distress.

It got so bad she couldn't handle it ... she said on a pain scale she was either 9 out of 10 or possibly 10 out of 10. So, 2 days later she went to the ER and got pain meds and was told to go home and eat a bland diet.

Now here's the crazy part ... she went home and several weeks later ate more Crumbles and it made a bad situation desperate. Her abdominal pain intensified so she went back to the hospital.

Doctors found she had elevated liver enzymes, and she stayed in the hospital for 4 days. Doctors concluded she had both liver and gallbladder dysfunction. She was told she may have to endure the pain indefinitely. They told her the best course would be to remove her gallbladder, which they did.

It's unclear if she continues to have liver problems, but she says she continues to suffer significant pain and she'll need time to see doctors and that could mess up her career.

She's suing for more than $75,000 -- btw, that's just a placeholder. She'll probably ask for a lot more.

As we previously reported, the company has told its customers not to eat the Crumbles and they are investigating. Scores of customers have complained of severe pain and various medical problems connected to the product.

Bam Margera Missing Again ... Two Weeks Later

Bam Margera has vanished from a Florida rehab facility -- and police are on the lookout for him … this coming just 2 weeks after he bolted from a court-mandated rehab center, TMZ has learned.

Law enforcement sources tell TMZ ... Bam was last spotted around 5:30 PM Saturday in Deerfield Beach, FL, after he left LifeSkills residential facility without permission. He was sporting a black shirt, black sweatpants and black sneakers.

Broward County detectives are now searching for Bam, asking anyone with information as to his whereabouts to call them.

Earlier this month, Delray Beach cops went looking for Bam after he disappeared from a rehab facility.

According to a police report, the 'Jackass' star went missing on June 13 after Bam told the facility's manager that he was unhappy with their services. Bam allegedly told the manager he was going to check himself into a different rehab center nearby ... and then left the premises in a black sedan without authorization from the staff or the court.

Days later ... cops found Bam at a Delray Beach hotel in the area and escorted him back to the treatment center. TMZ obtained photos of Bam out the day before he was found, at a few bars close to his hotel. We're told he'd been off his medication for several days, and his team was worried he'd relapsed.

Sources close to Bam tell us the reason he left the rehab was partly due to his split from his wife.

Misrepresenting a two-year-old car purchase to make an unprovoked and unjustified attack on Travis Scott is nothing more than another desperate publicity stunt to try to falsely blame Travis and intentionally manipulate public opinion, which won’t work."

Travis Scott is getting dragged for his latest purchase, a $5.5 million luxury car ... the family of a 9-year-old who died at Astroworld says it's just not a good look.

Bob Hillard, the attorney for the family of Ezra Blount, tells TMZ ... Ezra would still be alive today, enjoying his summer, if Travis would've spent half of what he paid for the Bugatti on simple safety measures at the deadly music festival.

As we reported ... Ezra, who was trampled at Astroworld, sued Travis before he died from his injuries ... and Travis recently splurged on a new Bugatti Veyron Chiron Super Sport despite the mountain of lawsuits he's facing.

While Ezra's attorney says Travis has every right to live life as he sees fit, including buying what he wants, Hillard rips Travis' choices as "excessive" ... and says everything Travis does should be questioned because of what happened at Astroworld.

Ezra's lawyer also has some choice words for Travis' camp ... ripping them for trying to make Travis look good with a $5.5 million car in his driveway as the Astroworld litigation heats up.

Brian Laundrie's notebook confession to murdering Gabby Petito is now public for the first time ... revealing his handwritten excuse for why he took her life.

In the 8-page confession, first obtained by Fox News, Laundrie admits killing her, but claims he only did it after Gabby sustained an injury while they were hiking in Wyoming.

He thought what he was doing was "merciful, that it is what she wanted, but I see now all the mistakes I made. I panicked. I was in shock."

Laundrie also seemed to be ready to take his own life at the point of writing his confession ... saying "From the moment I decided, took away her pain, I knew I couldn't go on without her."

Johnny Depp v. Amber Heard Judge Says Sure Amber, You Can Appeal ... But It's Gonna Cost You!!!

Amber Heard is now officially on the hook for $8.35 million, and she could be on the hook for even more if she appeals the defamation verdict.

As you know, a jury awarded Johnny Depp the $8.35M after an explosive trial. The judge Friday officially entered the judgment into the court record, and there's a string attached if Amber decides to go forward with an appeal.

The judge said if Amber appeals she must post a bond in the full amount of Johnny's judgment PLUS 6% -- that's an additional $621k. Presumably, the 6% is an interest penalty for a delay in collection.

As for Amber, her rep released a statement invoking, of all things, the January 6th House hearings, stating ... she will indeed appeal, saying, "As stated in yesterday's congressional hearings, you don't ask for a pardon if you are innocent.  And, you don't decline to appeal if you know you are right."

The reality is ... appealing a jury verdict is a big uphill climb, and it could be she's throwing good money after bad.

DEPP ATTORNEY CAMILLE VASQUEZ Jumps to Help Airline Passenger in Medical Distress ... Flight Attendant Calls Her 'Wonder Woman!'

Johnny Depp's attorney Camille Vasquez helped another guy out of a jam ... she's being hailed as "wonder woman" for tending to a man suffering a medical emergency at 40,000 feet.

Folks on an American Airlines flight from Los Angeles to New York this week tell us Camille rushed to assist an elderly passenger who collapsed and hit his head midflight.

We're told the incident went down when the man in his 70s fell to the floor while walking past her and her bodyguard, who were both sitting in first class.

When the flight attendants yelled for help, we're told Camille and her muscle sprang out of their seats and tended to the guy.

Passengers say Camille got in touch with her brother-in-law, a doctor, and he started guiding her through steps to check if the man was having a heart attack or brain bleed from the fall.

Camille's bodyguard took off his Apple watch to monitor the passenger's heart rate.

Incredibly, folks say there was a surgeon on board who came forward to take over for Camille and her guard.

One of the flight attendants told Camille she was "wonder woman" and gifted her 2 bottles ... Merlot and champagne.

The plane turned back to LAX ... when it landed the man was conscious and EMTs came aboard and escorted him off the plane.

A rep for American Airlines confirmed the incident to TMZ.

According to legal docs, obtained by TMZ, Chelsea cut a deal with a company called ThirdLove to promote its clothing. She claims the company loved Handler's unique body-positive image and brand and thought it was a fit for its customers.

Chelsea says she went through a specialized exercise routine to stay in shape and get ready for the photo shoots ... and claims she passed on other potential deals to honor her exclusive commitment to the company.

She claims she had to fly out to Canada from L.A. for a photo shoot as part of the deal -- and did so on her dime. But, Handler claims ThirdLove ended up pulling the plug on the entire thing at the eleventh hour.

Elon Musk Daughter is Musk No More ... Vivian's Legal Changes Approved

Elon Musk's daughter is officially free of her famous last name ... she's been granted the name and gender change she requested.

Court docs, obtained by TMZ, show the L.A. County Superior Court judge signed off on the name change for the 18-year-old ... who is now Vivian Jenna Wilson. Wilson is her mother's maiden name.

She was also granted a gender change ... Vivian identifies as female, and the docs state a new birth certificate reflecting the change in gender will soon be issued by the state registrar.

As we reported, Vivian said her reason for the change is "the fact that I no longer live with or wish to be related to my biological father in any way, shape or form."

Back in December 2020, Elon tweeted his support for the transgender community, but added ... "All these pronouns are an esthetic nightmare."

It's unclear what's at the root of Vivian's desire to part ways with her father -- seems like it must be more than just that tweet.

In any event, Elon's ex-wife Justine Wilson posted about being proud of Vivian as the news broke about her legal request. Neither Mom or daughter has said anything publicly about Elon yet, but Vivian's gotta be over the moon now that it's all official.

Bill Cosby Not Sweating $500K Verdict Against Him 'That's All? Booyah!!!'

Bill Cosby seemingly didn't care he was found liable in a civil suit accusing him of sexually assaulting a 16-year-old girl ... cheering over the phone when he found out the whole thing was only going to cost him $500,000.

Cosby's rep Andrew Wyatt tells TMZ he called the 84-year-old directly after the judgment was read -- informing Cosby the jury didn't award any punitive damages -- which could've cost the disgraced comedian millions.

Wyatt says when he let Cosby know the jury only awarded his accuser, Judy Huth, $500k ... Cosby responded, "What? That's all?" followed up with a "Booyah!"

We're told Bill was also able to get on the phone with the 2 jurors who had sided with him, thanking both women for being on the right side of equal rights and social justice.

We're told Cosby plans on filing an appeal ... so Huth's payday is, at the very least, likely to be delayed.

The actor dug in his heels Wednesday morning on Sway's SiriusXM show, talking about why he feels he got screwed in court. As Jussie sees it, if you buy what the jury said -- that he flat out lied -- that would mean we all found out "someone is exactly the opposite of who they claim to be."

No argument there.

However, he went on to explain that committing such a nefarious lie would mean he'd exploited the pain and fears of both Black people and the LGBTQ community -- and Jussie says, "I'm not that motherf***er."

Of course, his stunning statement flies in the face of all the evidence presented in Cook County court before he was convicted and sentenced, back in March, to 150 days.

What's unclear about Jussie's clarity is how long he would have continued fasting if the judge hadn't let him out, and also ... what exactly he gained clarity about during that time.

In any event, he says he won't allow Hollywood studios or casting directors to derail his career going forward -- he's got a plan for that. What he didn't address is what happens if his appeal fails, and he has to go back to jail and finish out his sentence.

David Dobrik Jeff Wittek Sues for Excavator Stunt Gone Wrong ... Claims He Almost Died

David Dobrik should have never been behind the controls of a massive excavator used in a social media stunt gone wrong, so says a YouTuber now suing the influencer, saying he suffered serious injuries as a result of David's actions.

In the lawsuit, obtained by TMZ, former Vlog Squad member Jeff Wittek says he traveled to Utah Lake in Provo, Utah in the summer of 2020 with David and a group of friends to shoot video as part of Dobrik's "social media comeback."

Wittek says the plan for one video was to use an excavator, operated by Dobrik, and plant it in the water, to swing people around with a rope while riding various objects -- including wakeboards.

However, Wittek claims Dobrik then suggested people get swung around by the machine -- that he was operating -- by only holding the rope, and without objects.

Wittek says when it was his turn -- David started to swing him around too quickly -- the docs claim Dobrik noticed he was moving the excavator too fast, and slowed down abruptly, causing Wittek to slam into the side of the excavator ... and causing him serious injury.

While he doesn't list the specifics of his injuries in the lawsuit ... Wittek has previously discussed what happened that day -- saying he almost died -- breaking his foot, hip, tearing a ligament in his leg and shattering his skull in 9 places. He also says he almost lost his eye.

Wittek says as a result of the accident, he's suffered wage loss, loss of earning capacity and racked up hospital bills. He's suing for general negligence and intentional tort. He's suing for more than $10 million in damages.

We reached out to a rep for David ... so far, no word back.

Bill Cosby Found Liable of Sexually Assaulting 16-year-Old Girl

8:06 PM PT -- Huth's attorney, Gloria Allred, tells TMZ, "Today our client, Judy Huth, won real change because she fought Bill Cosby one step at a time over seven and a half years, and she proved with the jury’s verdict that Mr. Cosby did sexually assault her when she was a minor, and that he should be held accountable for what he did to her. We are proud of Ms. Huth and our victory against Bill Cosby."

Bill Cosby was just found liable in a civil suit filed by Judy Huth against the disgraced comedian, who claimed he sexually assaulted her at the Playboy Mansion back in 1975.

The Santa Monica jury awarded Huth $500,000.

Huth was 16 years old when she and a 17-year-old friend met Cosby on a film set in a park. She claimed Cosby invited them to accompany him to the Playboy Mansion a few days later.

Huth testified Cosby was alone with her in a bedroom at the mansion, where he attempted to put his hand down her pants. She says she lied to Cosby about being on her period to get him to stop, but claimed Cosby exposed himself and forced her hand on his erect penis and used it to masturbate until climax.

Cosby did not attend the trial ... the jury was, however, shown Cosby's 2015 video deposition, during which he denied Huth's allegations and said he didn't even remember meeting. Huth's lawyer, however, showed the jury a photo of Cosby and Huth at the Playboy Mansion.

Cosby's defense team insisted the allegations were nothing more than Huth attempting to cash in.

As for why Huth waited until December 2014 to file the lawsuit, she claimed the alleged assault resulted in anxiety attacks and flashbacks, beginning in 2014 ... lasting through 2018 when Cosby was sent to prison after being convicted in a separate criminal sexual assault case involving Andrea Constand.

Hailey Bieber New Skincare Line Sued By Same-Name Company ... You Stole Our Name

11:37 AM PT -- A source connected to Hailey's brand tells us she owns the trademark for skincare, and the other Rhode holds the trademark for clothing. The source also points to the fact Hailey's legal name is Hailey Rhode Bieber.

Hailey Bieber and her new skincare line are being dragged to court already ... they're getting sued for trademark infringement by a fashion line of the same name.

According to legal docs obtained by TMZ, clothing company Rhode NYC claims Hailey and her business, Rhode, taken from her middle name, could easily wash away all the hard work they've put into their brand.

They say Hailey and co. previously tried to acquire the "RHODE" trademark but owners Purna Khatau and Phoebe Vickers refused to give it up. Rhode NYC, founded in 2013, claims the "Rhode" logo looks very similar to the one they have.

They believe Hailey's celebrity status is the reason her company is already taking off ... not to mention her famous husband Justin Bieber has also promoted the company to his 243 million Instagram followers.

The owners say they've already faced issues online ... people have been tagging Hailey's company by mistake instead of theirs, which they think shows there is clearly consumer confusion.

They are asking the judge to force Hailey's company to stop using the Rhode name and come up with something else to avoid further confusion and harm to their brand.
