Jussie Smollett Team Demands Immediate Release Cite Threats, Health, COVID
Jussie Smollett's lawyers have wasted no time demanding his release from jail -- at least while his appeal plays out --- claiming he risks being harmed (physically and microbially) every second he stays behind bars.
The 'Empire' actor's legal team filed an emergency motion Monday asking a judge to spring Jussie from behind bars while his appeal is pending -- arguing that the potential cons of him staying locked up in Cook County far outweigh any benefits.
The crux of their case here is that Jussie's family has been on the receiving end of what they say is a barrage of harassing messages and phone calls aimed at Jussie ... which they say is emblematic of the harm that might actually befall him if he remains locked up.
To hammer this home ... Jussie's team offers up a video taken by the Smollett family which they say shows a stranger calling them with disgusting sentiments about what should happen to their brother as he serves his 5-month sentence.
They claim the clip -- which is laced with racist and homophobic slurs -- is just one example of what they say has been a deluge of hate sent their way -- and they fear that'll translate into real-world violence against their brother on the inside.
There are other reasons they say he should be out ... for one, they attach a sworn affidavit from a doctor who states Jussie is at a higher risk of catching COVID due to a compromised immune system ... while citing positive case rates in jails and prisons across the country.
On top of this ... Jussie's lawyers argue that because he's being held in protective custody -- which they say is akin to solitary confinement -- his mental health will deteriorate.
Big picture, they continue to reiterate all the points they made in court in trying to get the case tossed in the first place -- including the argument that he's already been punished for all this ... so the whole thing amounts to unconstitutional double jeopardy.
But, while they sort out all that in his official appeal, they argue he shouldn't have to be in jail ... because his sentence may, in fact, be deemed invalid at the end of the day.

Kanye West has been going after Kim Kardashian, claiming she's denying him access to their children, but it's pretty clear what Kim plans on doing about it legally -- nothing.
Fact is, Kanye's rants aren't accurate ... he's routinely seen his kids when he wants. What's more, there's no point in asking the family law judge for a protective order. First off, it's unclear if the judge would grant it, but even if they do, that assumes Kanye would obey it, and that's pretty clearly a pipe dream.
As we reported, Kim and Kanye do not have a structured child custody agreement. He has never asked for one and the way it works ... whenever he wants to see the kids, within reason, she accommodates him. From everything we've seen, Kim does not want to limit Kanye's time with the kids in any way.
Now, the judge has not issued a child custody order yet, and if Kanye decides to fight Kim in court, the numerous texts attacking Kim, Pete, etc., will almost certainly become evidence and could affect the outcome, and not in a good way for Kanye.
We're told the reality is this ... Kim is the primary caregiver of their 4 kids, and they are all young enough that she can shield them from all the drama.
As we reported, Kanye fired off a flurry of tweets over the weekend, and Pete finally responded with some biting comments.
For Kim's part, she's only said publicly she is not withholding the kids from her ex.

Finally, she finishes her sentiment with this ... "My prayer is that he is freed and put on house arrest and probation because in this case that would seem fair. Please #freejussie."
As we told you, Jussie's brother told his followers that his sibling had been placed in the psych ward wing of Cook County Jail -- which we've learned is, in fact, true ... but it's not for the reasons that Jocqui suggested ... namely, that he was there against his will.
Our law enforcement sources tell us it's simply where they house high-profile inmates ... and not just that, but he'll also be in protective custody while there, under a watchful eye.
Now, as for TPH's Emmett Till juxtaposition with Jussie ... she's entitled to her opinion, but it's almost certain not everyone's gonna agree with what she's selling here. Fact is ... they're completely different cases, circumstances and time periods -- and that context matters.

Jussie Smollett has been placed in the psych ward at the Cook County Jail, and his brother says it's because the official paperwork says Jussie is at risk of self-harm.
Jocqui Smollett hopped on Instagram Saturday, saying, "So Jussie is currently in a psych ward at the Cook County Jail. What's very concerning is that there was a note attached to his paperwork today saying that he's at risk of self-harm."

Jocqui then called B.S. ... "I want to make it clear that he is in no way, shape, or form at risk of self-harm. He wants to let folks know that he is very stable, he is very strong, he is very healthy and ready to take on the challenge that... has been put up against him."
A law enforcement source tells TMZ, the reason Jussie is in the psych ward is because it's also the area where they house high-profile inmates.
The former "Empire" actor is now serving his 5-month sentence for faking a racial and homophobic attack on the streets of Chicago. When he was sentenced he told the judge repeatedly that he was not suicidal, so if anything happened to him behind bars it was not self-harm.
Jussie's brother said, "This is not right. This is complete lack of justice. So please, make sure you all spreading facts. We really need our people to support us."

Jussie Smollett will almost certainly escape federal charges for allegedly faking another part of the elaborate hoax that just got him sentenced to 5 months behind bars ... the infamous hate letter.
Federal law enforcement sources tell TMZ ... barring any major future development in the fake hate mail case, the feds will NOT charge Jussie.
As we reported ... the studio received a threatening letter directed at the "Empire" star 8 days before the "attack," with scrapbook-style letters with the warning ... "You will die black f**," along with an image of a noose.
Some authorities believe Jussie sent the racist and homophobic letter to himself, hoping it would put him smack in the middle of the social justice movement.
The feds seem content with the sentence Jussie received after a jury convicted him on 5 felony counts for lying to cops about the incident. He was just sentenced to 150 days in jail with 30 months of felony probation.
Our sources say the feds feel it would be "piling on" to hit Jussie with more charges.
The U.S. Attorney for the Northern District of Illinois, the office in charge of filing federal charges, declined to comment.

Jussie Smollett believes there's one overarching reason he was sent to jail, and it's not because of the hoax ... he says it's because he's Black.

He told his defense team before sentencing he felt he would be treated more harshly than other defendants convicted of a non-violent crime ... all because of the color of his skin. Jussie told his team after sentencing he was dead-on when he predicted the outcome ... based on the animosity the judge showed toward him. He called it "unfortunate" and "sad."
As you know, the judge read Jussie the riot act, saying the hoax was rooted in a desire for more fame and more attention.
We reached out to the court for comment, and a rep for the Cook County Chief Judge's Office tells TMZ ... "Judges can't comment on pending cases, and it's still pending."
As we reported ... Jussie will be held in protective custody -- as requested -- while serving his time behind bars, with security cameras and an officer with a body-worn camera monitoring his cell.
Our sources say Jussie spoke out in court about not being suicidal because he wanted to make it clear to the public that if something were to happen to him in jail, it was foul play ... and our sources referenced the Jeffrey Epstein outcome, and that was what was on Jussie's mind when he made the comment.
Jussie was taken into custody following Thursday's sentencing, and we're told he spoke with his defense team Friday ... telling them he's OK and filled with hope.

'Rust' Fatal Shooting Alec Baldwin is Shameful Says Family Lawyer He Wanted to Complete the Movie, Seriously?
Alec Baldwin knows no shame in the death of "Rust" cinematographer Halyna Hutchins ... this according to the lawyer for her widower and son.
Attorney Brian Panish is reacting to Baldwin's new legal docs which say the actor wanted to complete the film after Hutchins' death. Panish told Deadline, "It is shameful that Baldwin claims Hutchins' actions in filing a wrongful death lawsuit derailed the completion of Rust. The only action that ended the film's production was Baldwin's killing of Halyna Hutchins."
There's a great divide between Baldwin's take on the fatal shooting and that of Halyna's husband, Matthew Hutchins. Baldwin has said he bears no responsibility for her death, which Panish says, "Alec Baldwin once again is trying to avoid liability and accountability for his reckless actions before and on October 21st that resulted in the death of Halyna Hutchins."
As we reported, Baldwin claimed in his new legal docs his contract with the "Rust" production company immunizes him from financial responsibility for any mishap. That contract, however, in no way prevents the Hutchins family from going after Baldwin. If they win a wrongful death judgment against Baldwin, they could force him to pay the judgment. It would then be Baldwin's responsibility to go after the "Rust" production company to recoup what he paid, provided the production company is still solvent.
Baldwin's legal docs claim Hutchins set the wheels in motion for her own death, saying she's the one who told him to point the gun and her and pull back the hammer. This statement is sure to enrage Matthew, who was livid after Baldwin's ABC interview in which he said he's blameless. Matthew groused that Baldwin is trying to make himself the victim.

1:24 PM PT -- Laundrie family attorney, Steven Bertolino, tells TMZ, "As I have maintained over the last several months, the Laundrie‘s have not publicly commented at my direction which is their right under the law. Assuming everything the Petitos allege in their lawsuit is true, which we deny, this lawsuit does not change the fact that the Laundries had no obligation to speak to Law Enforcement or any third-party including the Petito family. This fundamental legal principle renders the Petito’s claims to be baseless under the law."
The parents of Gabby Petito want justice for their daughter -- suing the parents of her killer, Brian Laundrie -- for allegedly knowing more about Gabby's death than they let on.
According to the lawsuit, obtained by TMZ, Gabby's parents say Chris and Roberta Laundrie knew their son had murdered Gabby and believed they were in the process of helping him leave the country.
The docs also mention Gabby's autopsy revealed she'd suffered blunt force injuries to both her head and neck ... additional details from the fact she had been strangled to death.
The lawsuit, filed by Gabby's dad, Joseph Petito, and mom, Nichole Schmidt claim after her death, Brian used Gabby's phone to send text messages ... making it seem like she was still alive.
Gabby's parents say in one of the texts allegedly sent to Schmidt by Laundrie from Gabby's phone, he referred to Gabby's grandfather by his real name, Stan, something she would never have done.
The lawsuit claims Brian was using Gabby's phone up until at least August 30 -- 3 days after she was murdered -- to communicate with Schmidt, saying there was poor cell service in Yosemite.
What's more ... Gabby's parents say they believe it was on August 28, a day after her murder, when Brian told his parents what had happened. The lawsuit alleges it was that same day when the Laundries contacted an attorney ... and hired him a few days later.
Gabby's parents say prior to her disappearance, they had a pleasant relationship with the Laundries, but as the situation got worse, Brian's mom allegedly blocked Gabby's mom's cellphone as well as her account on Facebook.
While the docs don't get into detail on exactly how ... they read, " ... Christopher Laundrie and Roberta Laundrie were keeping the whereabouts of Brian Laundrie secret, and it is believed were making arrangements for him to leave the country."
Gabby's parents say they suffered emotional distress, and are asking for an unspecified amount in damages.

11:49 AM PT -- A rep for the Cook Co. Sheriff's Office tells us Smollett's cell will be monitored by security cameras as well as an officer with a body-worn camera. They tell us Jussie will be able to have time outside of his cell in common areas, where he can watch tv and use the phone -- but other inmates will not be in the common area at that time.
They tell us, "The safety and security of all detained individuals, including Mr. Smollett, is the Sheriff’s Office’s highest priority."
Jussie Smollett will be held in protective custody -- as requested -- while serving his time behind bars.
Judge James Linn ordered the actor's 150-day jail sentence, and specified he'll serve it under protective custody. According to legal docs, obtained by TMZ, Judge Linn says Smollett and his team requested the protection.
The goal of protective custody is to protect an inmate from any form of harm while they serve their time.
Smollett was immediately taken into custody following Thursday's sentencing. A rep for Cook County Sheriff’s office told us Smollett was given a medical and mental health assessment by Health services, as well as a security assessment upon getting locked up.
As we reported, Smollett erupted after his sentence -- which also included 30 months of felony probation, $120K in restitution and $25K in fines -- was handed down ... reiterating he isn't a suicidal person, and if something happens to him while he's in custody, he wants the world to know he didn't do it to himself.
Jussie's maintained his innocence the entire time -- even after being found guilty -- and still insisted he did not hire the Osundairo brothers, Abel and Ola, to stage the "attack" on a chilly Chicago night.
The City of Chicago has also sued Jussie in a separate civil action over the resources spent investigating his claims, which is being pegged at $130,000.

Alec Baldwin says his "Rust" contract makes him judgment proof in the fatal shooting of Halyna Hutchins ... and he goes on to blame her for the fatal incident.
Baldwin's lawyers filed an arbitration claim, alleging his deal shields him from any financial responsibility in connection with Hutchins' death. What's more ... the lawyers say Baldwin's legal fees must be covered by the production as well.
But that's not all. In the docs, Baldwin says Hutchins is the one who told him how to position the gun, saying, "She directed Baldwin to hold the gun higher, to a point where it was directed toward her. She was looking carefully at the monitor and then at Baldwin, and then back again, as she gave these instructions."
The lawyers go on ... "In giving and following these instructions, Hutchins and Baldwin shared a core, vital belief: that the gun was 'cold' and contained no live rounds."
The attorneys also say Baldwin asked Hutchins if she wanted him to pull back the hammer ... the lawyers say Hutchins responded in the affirmative.
And, there's this ... the docs reference Baldwin's interactions with Hutchins' husband, Matthew shortly after the shooting. When Hutchins hugged Baldwin, the actor's lawyers say Hutchins said, "I guess we're going to go through this together."
That relationship blew up after Baldwin sat down with ABC News and not only absolved himself of responsibility, but blamed Halyna.
The docs say it's not the actor's responsibility to check a gun for live ammo ... the lawyers say it's the armorist's job.
As for liability because of Baldwin's Executive Producer title, the lawyers say his contract indemnifies him. Besides, the lawyers say, Baldwin was just a creative E.P.
As we reported, there were numerous safety concerns on the set, to the point some of the crew staged a walk-off.
Matthew Hutchins and his son are suing Baldwin and others for wrongful death.

Cat-Tastrophe Two Death Row Dogs Spared ... After Alleged Cat Killing
Two dogs have been sprung from death row after allegedly killing a neighbor's cat ... this after a legal battle that lasted more than a year.
A 2-year-old pit bull named Odin, and a 6-year-old Akita mix named Lucy were caught back in January 2021 next to a dead cat named Big Boy. Animal control officers came and took the dogs to a shelter, and began legal proceedings to euthanize the pooches.
The dogs owners, Nola Lowman and her son, William Dillon Jr., hired lawyers ... who argued Odin and Lucy just came upon the cat and the probability was that a coyote killed the feline.
They pointed to not just one but 4 cat attacks in the area ... which suggested a serial animal killer was on the loose.
Authorities didn't see it their way, and ruled the 2 dogs were considered "vicious." That's a critical word, because under Maryland law animals that are labeled "vicious" must be euthanized.
According to The Washington Post, the dogs were impounded for more than a year, as lawyers racked up a $25,000 bill trying to appeal the decision.
A few weeks ago, a judge reversed the death sentence, saying the dogs had no history of aggressiveness. The judge didn't find the dogs innocent ... rather, the label "vicious" was replaced with the label "dangerous."
So, the 2 danger dogs have been spared and are back at home.

Travis Scott's announcement about his new charitable project is a blatant attempt to clean up his image after the Astroworld tragedy ... at least according to some of the plaintiffs, who want the judge to stop him from tooting his own horn.
Family member of Ezra Blount, the 9-year-old killed in the Astroworld crush, are pissed about Travis launching his Project HEAL initiative ... or at least they don't think he should be allowed to publicize it through the media. As we reported, Travis announced this week he'd be pouring $5 million into several charitable efforts.
Ezra's father and mother have filed docs asking the judge to amend the gag order put in place last month ... to specifically block Travis from making such announcements, which they feel will taint the potential jury pool in their lawsuits against Travis.
The dad, Treston Blount, calls Project HEAL nothing more than a "highly sophisticated marketing campaign." He points out Travis and his team issued a "look at me" press release to all TV and print media in Harris County, Texas ... the exact place from which the jury will be selected.
Here's the twist, though ... Travis' legal team feels it's Blount's attorney who violated the gag order by publicly disparaging Travis for Project HEAL. In their response, they say Travis was merely continuing his "long history of giving back to his hometown" -- however, Blount's attorney characterized it as Travis trying to say, "Look at me, I'm a good guy."
Ezra's family and other plaintiffs want the gag order to block all parties in the case -- not just the lawyers -- from making public comments that could sway the jury pool. Alternatively, they want the judge to lift the gag order altogether ... so everyone's on a level playing field.

6:49 PM PT -- A rep for Cook County Sheriff’s office tells TMZ — Jussie will be given a comprehensive medical and mental health assessment by Health services, a security assessment and will be placed in appropriate housing. He will also be tested for COVID at intake and will be offered vaccination if he has not been previously vaccinated or gotten the booster.
6:37 PM PT -- We’ve just obtained Jussie’s mugshot, he's stone-faced. As the judge said during the hearing, he will begin his sentence immediately.
Jussie Smollett was just sentenced to 150 days in Jail for his elaborate hoax on the streets of Chicago ... and Jussie went off on the judge, telling him if he dies in prison it's not suicide. It got so intense, Jussie was taken into custody and left with his fist in the air.
Judge Linn just handed down the sentence ... which also includes 30 months felony probation, $120,106 restitution to the city of Chicago and will pay a $25,000 fine.
Judge Linn pointed to Jussie's testimony during trial, when he talked about his life ... and he talked about social justice and how much it meant to him and his family. And, the judge noted the irony and hypocrisy that Jussie engineered a hate crime hoax.
Judge Linn says Jussie wasn't motivated by money ... he did it because he craved the attention and thought he could boost his profile by tapping into the social justice movement in America. He said he just wanted to make himself more famous, throwing himself a "national pity party."
The judge called Jussie arrogant, selfish, narcissistic, and he did damage to real victims of hate crimes. Victims are always reluctant to come forward, and Jussie did them no favors. The judge says Jussie lied ... lied and lied repeatedly about the incident.
The judge made it clear he was not sentencing Jussie to satisfy public opinion ... it was purely a matter of what Jussie did. The judge said there was nothing he could do that would be worse than what he did to himself, saying Jussie destroyed his life by his shenanigans.
Jussie declined to speak in open court before sentencing ... his lawyer advised against it.
Jussie's 92-year-old grandma got on the stand to plead for leniency, and she launched on the media for not reporting the story accurately. She called him a "justice warrior," who has been steeped in social activism for years. She told the judge, if he sends Jussie to prison he should send her along with him.
The lawyer for the City of Chicago made it clear ... this was not a victimless crime, saying more than 30 Chicago cops investigated the case and had to review more than 1500 hours of surveillance video. They went door to door in the freezing cold to get to the bottom of the case. They amassed more than 1,000 in overtime, and it caused fatigue and stress. The lawyer also said Jussie has made real hate crime victims hesitant to come forward.
Jussie's lawyer made a series of arguments during the hearing, imploring the judge to throw out the verdict. Notably, his lawyer argued because of the pretrial publicity by City officials -- including the Police Commissioner -- Jussie did not enjoy the constitutional protection of being presumed innocent. The judge rejected that argument.
The judge also turned thumbs down on the argument Jussie was entitled to a public trial and that, his lawyer argued, was not the case. The special prosecutor fired back, even during a pandemic, the trial was open to reporters and also, the defense didn't want cameras in the courtroom during the trial, so it's rich they're making this argument now.

Kimora Lee Simmons' estranged husband, ex Goldman Sachs banker Tim Leissner, testified he posed as his ex-wife online to spin a web of lies ... including convincing Kimora he wasn't still a married man when they met.
Tim testified under oath Tuesday he pretended for years to be his then-wife, Chinese heiress Judy Chan, and sent fake emails to his future wife Kimora when they began their relationship.
It's pretty wild ... Tim admitted he created a fake email account to pose as Chan in order to woo Kimora, using it to convince her he was already divorced from Chan.
Tim apparently did a great job posing as his then-wife ... because the emails presented in court reportedly show Kimora invited Chan and her kids on multiple family vacations, which Tim, posing as Chan, declined.
Kimora and Tim tied the knot back in 2014 ... and he also admitted in court to faking divorce documents in order to marry Kimora when he was still married to Chan, whose family is said to own the top winery in China and a coal-mining business.
The bombshell testimony is part of an ongoing embezzlement trial of Tim's former Goldman Sachs colleague, Roger Ng ... with Tim also testifying he used the fake email account to pose as his then-wife in conversations with Malaysian financier Jho Low, who has been separately charged with laundering billions of dollars, among other things.
It's unclear if Kimora found out about Tim's fake emails before he took the stand ... but her lawyers reportedly say she and Tim are now estranged.

11:29 AM PT -- 3/10 -- A court clerk tells us Ron's TRO request was granted.
Selma Blair got an order of protection against her boyfriend, claiming he attacked her ... this after he was arrested for felony domestic violence with corporal injury.
According to the docs, obtained by TMZ, Selma and Ron Carlson were in a long-term relationship that recently ended. Ronald went to her home on February 22 to drop off a TV set. Selma told him she had been medicated all day to treat her Multiple Sclerosis and was feeling ill. She says he got frustrated and screamed at her, "You f**ked up, you can't do anything, you can't love anybody, you're f**king useless, you cripple." She says he went on to say, "I don't f**king deserve this, I can do so much better than you."
Selma claims Ronald became enraged and lunged at her, jumped on top of her body while she was lying on the sofa, grabbed her by the neck "and strangled her, throttling her and shaking her head and shoulders aggressively."
According to the docs, Selma says she stuck her fingers into his eyes and mouth and he responded by covering her mouth and face with his hands. She says she was unable to breathe and lost consciousness. Police came to their house and when they interviewed Selma, she says her nose began to bleed heavily and she lost consciousness again.
We're told EMTs on scene made the decision to take Selma to the hospital for a further evaluation.
Ronald was arrested for felony domestic violence with corporal injuries. The police obtained a 5-day restraining order against Ronald, prohibiting him from going near Selma. She then had her lawyer go to court and obtained a temporary restraining order.
Ronald filed a petition for a restraining order today against Selma -- 15 days after the incident -- he says when he was at her home she asked him to sit next to her. He claims they had both been ill so he declined to get next to her, at which point she became "angry and antagonistic." He says she got in his face and said, "Your daughter is a f**king loser."
He claims Selma then swung at his face with her right arm and struck him in the eye. He says she then attacked him with both arms, scratching him in the nose, eyes and cheeks. He says he reached for her defensively, and denies attacking her. He says her bloody nose was a persistent problem that she had complained about 2 days earlier in a text (above). As far as we can see, his restraining order petition has not yet been granted.

Chris Brown is firing back at the woman who accused him of rape and sued him for $20 million -- insisting voicemails and texts she sent after their encounter prove it was consensual, and now the woman's lawyer is dropping her.
The string of texts began very shortly after he and the anonymous accuser hooked up on a yacht in Miami back in December 2020, and continued for several months. In the texts, Chris tells the woman she should take a Plan B pill after their encounter, and she responds that she will, and adds ... "I wanna f**k u tonight at midnight lol."
Months later, after she and Chris apparently talked about meeting up again, but never did, the woman sends a nude selfie and says "U were honestly the best d**k I've had 😠lol i just want it again."
When Chris didn't respond, she seemed to get peeved, texting ... "U knew full well I wasn't pressing u bout no d**k. U told me to stay and then gonna try to play me? Nah that's crazy i didn't deserve that but u def got it."
In a voicemail, which Chris posted on his IG, she says, "I just want to see you again ... just let me know. If you want me to leave you alone, I will. But I really just wanna f**k the s**t again."
Chris clearly feels vindicated, and said on social media ... "No more dragging me through the mud. CLEARLY YOU CAN ALL SEE THE (blue cap emoji)." He says he's planning to sue the accuser because, "You don't play with people's lives like that."
TMZ broke the story ... the woman accused Chris of drugging her during the yacht party, and taking her into a bedroom and raping her.
We spoke with the accuser's lawyer, Ariel Mitchell, and she confirms the woman sent Chris the texts and voicemail. She tells TMZ she's withdrawing from the case because she says the woman had not informed her about the messages.
Meanwhile, Miami Beach PD tells us the case is still under investigation, however they have received the messages between Chris and the accuser.
