Judge to Usher Stepson's Death Will NOT Delay Custody Battle
The judge in the Usher/Tameka Raymond child custody case has refused to postpone the trial because Tameka's son died -- ruling the trial will resume as scheduled later this month.
As TMZ first reported, Usher wanted to have a court date moved back because he was worried that with the recent passing of Tameka's son ... the court hearing would cause "unnecessary stress and strain" for himself, Tameka, and their two minor children.
But Tameka argued Usher was just posturing for the press and his concern was "bogus." She claimed in court papers Usher "visited Kile in the hospital only once" during his 15 days on life support.
A judge in Fulton County, GA has now ruled, saying the case will go on as planned and Usher will once again take the stand.
The trial will resume on Aug. 13 and is only expected to last a few more days.

In his request, Usher claims he's worried the hearing would cause "unnecessary stress and strain" for both himself, Tameka and their two minor children "in the immediate wake of this tragedy."
Usher also claims Tameka would get an unfair advantage in the hearing because the court would not want to rule against a woman who is still grieving the death of her son. Usher fears he could lose custody of the children and believes it would be unfair to him.
But in docs of her own ... Tameka's lawyer claims Usher is full of crap ... insisting U's claims of suffering "stress and strain" are "BOGUS."
In fact, she claims Usher didn't care about her son at all in his final days -- even though Usher regarded him as a son back when they were married.
"[Usher] visited Kile in the hospital only once" during his 15 days on life support ... Tameka claims.
She also claims she had begged Usher to tweet a message about her son, "Please pray for Kile" ... but he refused. Instead, Tameka claims, Usher's next tweet was a photo of his own breakfast with the caption, "Breakfast of Champions."
In her docs, Tameka claims Usher's attempt to postpone the hearing is "simply a transparent sham" ... and asks the judge to DENY Usher's request and require him to appear at the next scheduled hearing, set for August 13.
She also claims resolving the custody battle is the only way for her to heal and move forward with her life.

Usher's Stepson Laid to Rest
Usher's 11-year-old stepson -- who tragically died last week after a jet ski accident -- has been laid to rest following his funeral today.
As we reported, Kyle Glover -- the son of Usher's ex-wife Tameka Raymond (pictured in the sunglasses) was declared brain dead following the accident earlier this month, and eventually passed away on Saturday from the injuries he sustained.
According to sources, Glover was riding in an inner tube on Georgia's Lake Lanier July 6th when he was struck in the head by a passing jet ski. He was unresponsive when taken out of the water.
Kyle's funeral was held in Atlanta this morning. He was laid to rest in a nearby cemetery.

Usher's Stepson Investigation Into Accident Continues Following His Death
The investigation into the accident that resulted in the death of Kyle Glover, stepson of R&B star Usher, is going forward ... and TMZ has learned his passing could lead to more serious charges being recommended.
As TMZ first reported, the 11-year-old passed away yesterday from the injuries suffered from a jet ski accident back on July 6.
The Georgia Department of Natural Resources, Wildlife Resources Division tells TMZ they were saddened to hear of Kyle's passing and their investigation into the accident is going forward.
According to our sources, Kyle's death could lead to more serious charges against the driver of the jet ski, Jeffrey Hubbard. We're told the Department will take into account Kyle's death when the make their recommendation to the District Attorney.
We're told the report is still coming together and there is no timetable on when the investigation will be completed.

Usher's 11-year-old stepson has passed away this morning from injuries suffered in a tragic jetski accident in Georgia earlier this month ... TMZ has learned.
According to our sources, Tameka is understandably devastated.
Glover was injured on July 8 ... as he was riding in an inner tube that was connected to a pontoon in Lake Lanier. According to authorities, a family friend who was riding a jetski behind the pontoon lost control and collided with Glover's tube.
The accident is currently under investigation.

Sources close to the family tell TMZ ... Tameka has not lost hope that her son, Kyle Glover, can make a drastic recovery ... despite doctors declaring him brain dead last week following a jet ski accident. We're told she is telling friends ... she still believes in miracles.
According to our sources, Tameka can only keep Kyle on life-support as long as her insurance company agrees to pay ... otherwise she doesn't have the funds to cover the enormous hospital bills.
We're told the insurance company hasn't set a specific deadline, but they've made it clear ... they're only willing to shell out coverage for a couple months ... tops.
Our sources say that Usher -- who helped raise Kyle for several years -- has been incredibly supportive in this difficult time... but has NOT offered to pay for any medical bills. We're told Tameka does not see him as a viable financial option.

Usher Wants to SETTLE With Ex In Wake of Jet Ski Tragedy
Usher has changed his tune and now wants to up his ante to settle his epic child support/custody war with Tameka Raymond after the jet ski accident that left his stepson Kyle brain dead ... TMZ has learned.
Sources connected with the couple tell TMZ ... Usher spoke with Tameka over the weekend and suggested that they settle up, but he did not significantly change his offer -- 50/50 custody with a very slight increase in child support. Tameka said no way.
But apparently Usher softened after the conversation, because our sources say he met with his lawyers earlier this week and instructed them to craft a new proposal that would give Tameka "a majority" of custody, though the sources did not specify the exact breakdown. We're told Usher is also raising his child support offer "significantly."
As for Usher's motivation ... we're told he's very conscious that Tameka is suffering and it's not a good move to continue the fight under the circumstances.
We're told the offer has not been presented to Tameka yet, but our sources say she's open to a "reasonable settlement."
Calls to lawyers on both sides have not been returned.

Usher's Stepson Investigation Into Accident Underway
The Department of Natural Resource in Atlanta is investigating the accident that left Kyle Glover, stepson of R&B star Usher in critical condition ... an investigation which could take months to complete.
As TMZ first reported, the 11-year-old was struck in the head by a jet ski while riding in an inner tube on Lake Lanier. He was rushed to a nearby hospital and remains there in critical condition.
Robin Hill, a rep for the Department of Natural Resources (Wildlife Resources Division), tells TMZ the department's Critical Incident Response Team will recreate the accident on the lake to help determine what happened. Using special computer programs, they will attempt to figure out how fast the boats were going at the time of the accident.
Hill says that rangers have been in touch with the driver of the jet ski and remain in contact with him. Once the department completes their investigation, they will turn their recommendation over to the district attorney who would then decide whether or not to file charges.

Usher's Ex-Wife Plans to Use Stalker Against Him In Custody Battle
Usher's alleged stalker is still causing him problems even after she's been hospitalized ... because his ex-wife plans on bringing her up in court to prove his kids are not safe with him ... TMZ has learned.
Usher and Tameka Raymond have engaged in a lengthy custody battle in court that is set to resume next month. Tameka has previously cited everything from Usher’s tour schedule to alleged drug use as to why she believes her ex should not have custody of their kids.
Now, we're told Tameka will use this latest incident with Usher's alleged stalker, Darshelle Jones-Rakestraw, to fuel her case. Our sources say the kids were with Usher during one of the alleged incidents when Jones-Rakestraw showed up at his home.
According to our sources, Tameka is scared for her kids' safety since Jones-Rakestraw was able to get all the way to Usher's home ... even though he lives in a gated community and has a security team.
When the trial resumes in August, we're told Tameka hopes this latest incident sways the court her way.

Usher broke down in tears today in an Atlanta court -- after his ex-wife's attorney insinuated he cares more about partying than he does about his children.
Usher was on the stand for hours today in his ongoing custody trial with his ex Tameka Foster -- and during questioning, Tameka's lawyer whipped out photos of the singer partying in Europe in February.
Usher's fighting for more custody with his kids -- but Tameka's lawyer was trying to prove he'd rather go wild at a nightclub than be a good dad.
