Although the two arrived to the Indiana court separately -- the on-again off-again parents quickly joined forces after the judge modified the existing order ... finally allowing the couple to hang out as they please.

But as we first reported, there's a slight catch -- Amber and Gary still can't be in the same room with their daughter Leah ... unless they're trading custody.

But there's still one major catch -- TMZ has learned the judge is refusing to allow Gary and Amber to be around their daughter Leah at the same time.

We're told the three of them are only allowed to be in the same room while trading custody of Leah.

Amber still faces two felony counts of domestic battery, one felony count of neglect of a dependent, and one misdemeanor count of domestic battery for allegedly beating the crap out of Gary in front of Leah ... and MTV cameras.

According to a police report filed in Anderson, Indiana last week -- Amber called cops after receiving 24 calls from a blocked number between 11:56 PM on February 3 and 5:21 AM on February 4.

Amber claims she could recognize the voices as Gary and his friend Ashley Williamson.

Amber told police she could hear Ashley threatening to kick her ass during the calls -- and she also says Gary was repeatedly saying "sexually vulgar" things to her. Amber claims the comments were SO vulgar, she refused to be more specific when speaking to police.

Law enforcement sources tell us, Amber filed a police report around 5PM -- saying someone claiming to be Gary had been harassing her over the phone ... and wouldn't leave her alone.

But Gary insists it wasn't him -- in fact, when the alleged phone calls took place, he tells us, "My ass was sleeping."

Maci was out with her best friend in NY last night -- and explained, "I was on vacation and Bentley wasn't with me and I was having a beer."

She adds, "It's obviously something I don't do anymore because I've grown up since then."

No word on when exactly the alcohol-infused party pics were taken -- but thankfully, Maci doesn't look pregnant at the time.

We're told Gary recorded his take on Lonestar's "Amazed" last week -- the pseudo-couple's "song" -- less than a month after a judge ordered Amber to stay the hell away from him and their child ... for beating the crap out of Gary on TV.

Here's the thing -- HE'S NOT THAT BAD, right? Anyone ..? Amber ...?

We spoke to Gary -- who explained his bad mouthing of Amber like this ... "I've said a lot of s**t because I am mad but if anyone wants to come up and talk s**t about Amber I won't let it happen because she is a good girl, and she's my baby mama."

Gary sounded like a textbook spousal abuse victim when he continued, "I am fine with the fact that Amber hit me because she has gotten all the help that she needs. Ever since that she hasn't put her hands on me."

As for a reunion with Amber ...Gary's optimistic. Kinda, sorta. "When the no contact order is lifted ... if she's single and I'm single then I'm sure we would try our relationship."

In an audio recording from December obtained TMZ, Gary is heard on the phone with Krystal, Amber Portwood's cousin. Gary explains to Krystal he kind of has a crush on her ... pointing out, "You've got things that Amber don't ... like a job."

Then Gary drops a real gem and tells Krystal, "Amber is sluttish. You've been with six dudes, Amber's been with f**king a million."

The topper ... dude actually tries to convince Krystal to come to his place by saying, "If you ever want to piss off Amber, let me know."

Gary and his friends were on their way to spend NYE in NYC. We hit up Gary with all sorts of questions about baby mama Amber Portwood and his daughter Leah -- but Gary repeatedly, though quite respectively, declined to comment.

The one time Gary did get fired up was when he yelled at one of his friends for making an attempted joke about Leah.
