Ben Stein thinks it's total BS Brett Kavanaugh has to go through a Senate hearing over something that allegedly happened when he was in high school -- even if it's true ... and he passionately believes it's not.

We got the 'Ferris Bueller' actor at LAX Tuesday, and our cameraman went head-to-head with him over the allegations made against the Supreme Court Justice nominee by Christine Blasey Ford ... that he sexually assaulted her at a party 36 years ago.

Stein calls it a "f***ing disgrace" and says he's not buying Ford's story ... and questions her motives. When our photog Charlie pushes back, saying it's important to hear them both out to get to the bottom of things ... Stein begs to differ.

It's interesting -- Stein clearly supports Kavanaugh and thinks the claims against him are lies, but when Charlie asks what if it can be proven they're factual ... Stein seems to say it still shouldn't matter.

As for whether or not Kavanaugh will be confirmed for SCOTUS -- Ben's got a prediction ... and another about Roe v. Wade.

McDonald's Employees Stage Massive Walkout ... Over Sexual Harassment

Scores of female McDonald's employees are staging a #MeToo walkout across 10 major cities ... protesting the company's alleged mishandling of sexual harassment complaints.

The strike is slated to begin during the lunch rush in major cities, including L.A., Miami, New Orleans, San Francisco and Chicago. The walkout won't go down at all McDees, only some. It's the first-ever nationwide walkout in protest of sexual harassment.

McDonald's employees are protesting what they say is widespread sexual harassment by coworkers or superiors ... alleging they groped or propositioned them for sex. The employees -- in conjunction with an advocacy group fighting for a minimum wage of $15 per hour -- say they were either retaliated against or fired after reporting the alleged incidents to supervisors.

The employees are demanding, among other things, mandatory sexual harassment training for managers and a better enforcement of its "zero-tolerance" sexual harassment policy.

Another advocacy group also plans to fly a plane over McDonald's corporate headquarters in Chicago with a banner that'll read, "McDonald's: Stop Sexual Harassment."

We reached out to McDonald's and a rep tells TMZ ... "We have strong policies, procedures and training in place specifically designed to prevent sexual harassment. To ensure we are doing all that can be done, we have engaged experts in the areas of prevention and response including, RAINN, to evolve our policies so everyone who works at McDonald’s does so in a secure environment every day."

Colton Underwood would be wise to keep it in his pants until he's down to 3 women on his season of "The Bachelor" ... so says one of the most promiscuous bachelors ever.

We talked to Season 4's 'Bachelor' Bob Guiney -- who slept with "five and a half women," according to an EP on the show -- and he says Colton should probably stay the virgin course until the fantasy suites, unless he's ready to have 'Bachelor' nation turn on him quick.

Bob's got a point -- it probably wouldn't play well with audiences if Colton started hooking up with ladies left and right after touting his virginity in such a public manner. If he stays true until the penultimate episode, Bob's sure ratings will skyrocket.

As for who should get cast to contend for Colton's heart, Bob thinks it wouldn't be a bad idea to have some late bloomers on there -- even though those folks won't have an automatic advantage.

He also suggests the pendulum could swing the other way with people like ... well, you gotta hear who his surprise guest of the year would be for yourself.

Asia Argento Back in Public for the First Time Since Sexual Assault Claim

Asia Argento isn't hiding anymore ... she's showing her face in public for the first time since Jimmy Bennett's claim she sexually assaulted him when he was 17.

The Italian actress resurfaced on the streets of Rome, going out for a ride with her director pal, Giovanni Veronesi, last weekend. The agency that shot the photos says they went to a house party overnight ... and Veronesi dropped her off at home the next day.

Asia made little attempt to go undercover -- no hat pulled down over her face, just a pair of shades -- despite the allegations Bennett is now making about their sexual encounter.

TMZ broke the story ... sources told us Bennett would be sitting down with the L.A. County Sheriff's Dept. to tell his story after Argento's lawyer, Mark Heller, issued a statement questioning Bennett's character and motives.

Argento initially denied ever having a sexual relationship with Bennett, but text messages and a photo obtained by TMZ debunked her claim. Her lawyer says she wasn't lying though, insisting that a one-time encounter doesn't amount to a relationship.

Asia's already been dropped from one show due to the Bennett controversy. Her episodes on Anthony Bourdain's 'Parts Unknown' were also scrubbed.

Harvey Weinstein Prosecutors in Rape Case Say ... Alleged Victim's Love Letters are Irrelevant

Prosecutors in the Harvey Weinstein rape case say they told the grand jury that Weinstein had a relationship with the woman who is accusing him of raping her, but they say there was no need to present emails the woman sent Weinstein professing her love after the alleged rape, because she never suggested in the emails she was lying about the alleged sexual assault.

Weinstein went public with emails -- first obtained by TMZ -- written between April 2013 and February 2017 by the woman who claims she was raped by Weinstein on March 18, 2013 in NYC.

Weinstein's lawyer, Ben Brafman, says his client and the woman had a 10-year relationship ... something they say prosecutors never told the grand jury. As a result, Weinstein has asked the judge in the case to dismiss all charges against him. In the new docs, prosecutors say they did tell the grand jury about the relationship, but acknowledge they never showed grand jurors the emails.

One email written by the woman on April 11, 2013 says, "I was able to talk to [redacted] today and will be connected with [redacted]. :) Thanks, and I hope to see you sooner thank (sic) later ..."

There's another email on April 17, again written by the woman, reads, "It would be great to see you again, and catch up!" Another email on September 11, 2013 says ... "Miss you big guy." There's a slew of emails that go on and on.

They go back and forth over the years talking about meeting up. At one point, the woman asks for a Soho House membership referral.

Prosecutors say in new legal docs, obtained by TMZ, the emails may be "inconsistent" with what Weinstein thinks is the correct state of mind for a rape victim, but she never says the rape didn't occur.

As we reported ... Weinstein surrendered to NYPD in May for the charges. His bail had been set at $10 million and he was released after posting $1 million cash.

Harvey Weinstein is seen getting handsy and flirting with a woman in a new video ... the same woman accusing him of rape.

In footage released Wednesday, Weinstein is seen hugging, touching and making suggestive comments during a business meeting in New York with Melissa Thompson. Thompson is a major player in the class action lawsuit against the fallen producer.

The clip starts with Weinstein entering the room and telling someone off camera not to interrupt ... he then closes and locks the door behind him.

Thompson is clearly uncomfortable throughout the video, at one point telling Weinstein his hands were moving too far up her leg.

In a lawsuit filed in June, Thompson alleged Weinstein raped her in a hotel the same day the video was shot.

Weinstein's attorney, Benjamin Brafman, tells us others have seen the full video ... and it tells a different story. Brafman says, "... the video, when viewed in its entirety, in context and not in select excerpts, demonstrates that there is nothing forceful, but casual – if not awkward – flirting from both parties."

He continues, "It (the video) was produced by Ms. Thompson to bolster her position in a civil lawsuit seeking money. Any suggestion of sexual misconduct is false. This is a further attempt to publicly disgrace Mr. Weinstein for financial gain, and we will not stand for it. Facts do matter.“

One of the most famous "Big Brother" contestants says the show is rock solid ... despite rumors longtime host, Julie Chen, might be leaving Big Brother with Les Moonves now gone.

Dan Gheesling -- who won season 10 and was the runner-up on season 14 of "Big Brother" -- says if Julie steps away from her hosting role on CBS' hit reality series, whoever replaces her will have some massive shoes to fill. Her 18-year run has been that iconic.

So far, Julie has not given even a hint that she'll leave the show. In fact, she made it clear ... she'll be hosting Thursday night's episode.

The real question ... will "Big Brother" go on the chopping block now that Moonves is gone? Sharon Osbourne said this week on "The Talk" nobody's job is safe now ... nor are any of the CBS shows in the wake of Moonves' departure.

Backstreet Boys' Nick Carter No Charges for Alleged Rape

12:33 PM PT -- Schuman just released a statement on the decision, saying, "My family and I were well aware of the likelihood that my case was not prosecutable due to the statute of limitations in California regarding rape which was modified in 2016. It is unfortunate that the law isn’t fully retroactive to accommodate assaults that have happened in the past, regardless of how far back."

She continues, "It gives me great solace to know that my testimony is fully documented, investigated and sealed for the future if needed by law enforcement. I gave my statement, as did the other witnesses. Speaking out was the best thing I could have ever done for myself and I hope it inspires others to do the same if it feels right for them."

Backstreet Boys singer Nick Carter will not be charged for allegations of rape made by Dream singer Melissa Schuman.

Law enforcement sources tell TMZ the statute of limitations for the alleged 2003 incident expired in 2013 ... so the L.A. County District Attorney's Office will not press charges.

As we reported ... Schuman claimed Nick raped her several years ago and filed a report with the LAPD for the incident in February. In a blog post, the singer said Nick forced her into a bathroom and forced oral sex on her ... then made her reciprocate. She says Carter then took her to a bedroom and forced intercourse.

Carter maintained the sex was consensual, saying, "I am shocked and saddened by Ms. Schuman’s accusations. Melissa never expressed to me while we were together or at any time since that anything we did was not consensual."

Carter continued, "We went on to record a song and perform together, and I was always respectful and supportive of Melissa both personally and professionally.”

After the decision, Carter's attorney, Michael Holtz, tells us, "Nick Carter was vindicated today when the L.A. County District Attorney’s Office rejected the charges against him. Nick has denied these allegations ever since he first learned of them last year, and was confident the District Attorney would conclude that there was no basis to pursue charges against him."

Holtz finishes, "He is happy to put this matter behind him.”

Larry Nassar Drugged, Raped & Impregnated 17-Year-Old ... Lawsuit Claims

A former Michigan State field hockey player claims Larry Nassar raped her back in 1992 -- and got her pregnant -- but when she tried to go to cops, a high-ranking MSU official shut her down.

The woman behind the suit is Erika Davis -- who was 17 years old when she suffered a knee injury during an MSU team practice and her coach referred her to Nassar.

During an exam, Davis claims Nassar crushed up a pill and made her drink it -- and a short time later she got "very woozy" and could not move her limbs.

Davis claims she passed out -- and woke up to Nassar raping her vaginally and ejaculating into her.

Later in the summer, Davis says a pregnancy test came back positive "and the only person who could have caused her to be pregnant was [Nassar]."

She miscarried a few weeks later, according to the suit.

Davis claims she told friends who recommended she go to the police -- but when she did, a detective told her he was "powerless to investigate ... and to go to the athletic department."

Davis says the athletic department had already dismissed her complaint and the Sergeant told her that MSU athletic director George Perles was a "powerful man" and that "she should just drop it."

Davis says she eventually moved on with her life and repressed the memories -- until 2018 after other victims began speaking out. That's when she decided to resurrect her legal action.

In her suit Davis says, had MSU taken her seriously back then, the school "could have prevented hundreds of young girls and women from being sexually assaulted by Defendant Nassar."

Les Moonves Out as CBS' CEO ... Vows to Donate $20M to #MeToo

7:25 PM PT -- Les Moonves has issued a statement in the wake of his ouster from CBS, saying in part ... "Untrue allegations from decades ago are now being made against me that are not consistent with who I am. Effective immediately I will no longer be Chairman and Chief Executive Officer of CBS. I am deeply saddened to be leaving the company. I wish nothing but the best for the organization, the newly comprised board of directors and all of its employees."

4:30 PM PT -- It's just been announced Moonves is out at CBS, and the network is implementing a big shakeup on its board of directors through a company-wide settlement. Interestingly, CBS says $20 million will be donated on Moonves' and the network's behalf to an org that supports #MeToo, which is set to be made immediately. The cash will come out of any severance benefits owed to Moonves following a pending investigation into his alleged misconduct. The company also notes that Moonves will not be getting any type of severance package at this point, but may receive further payment once its investigation is wrapped and after a final evaluation from the Board.

CBS's longtime CEO, Les Moonves, is reportedly resigning from his position as head of the network after multiple allegations of sexual misconduct.

Citing sources familiar with the matter, CNN's Brian Stelter reported Sunday that Moonves would be stepping down and that the official announcement would be made either Sunday night or early Monday morning. This comes on the heels of a second New Yorker article by Ronan Farrow where six additional women accused Moonves of sexual misconduct.

The allegations range from Moonves allegedly forcing oral sex on certain women, exposing himself without permission to others ... and allegedly using physical violence or intimidation against them.

He'd already been accused of sexual misconduct from 6 separate women earlier this summer -- including allegations of sexual assault from the 1980s ... for which he will not face criminal charges. Ronan wrote that earlier piece as well.

Moonves has worked at CBS since 1995, where he first served as president of CBS Entertainment. He served as CEO of CBS Television from '98 to 2003, and was eventually bumped up to chairman and CEO of the entire company in 2003. He's responsible for greenlighting series like 'CSI,' 'Without a Trace,' 'NCIS,' 'Survivor,' 'Cold Case' and many, many other hit shows.

Reports have recently said that Moonves and the CBS board were negotiating an exit package for him somewhere in the ball park of $100 million. Stelter says exit talks have been finalized, but did not report on any specific figure.
