Asia Argento Accuser Jimmy Bennett Goes MIA ... Investigation Stalls

Jimmy Bennett has yet to file a police report against Asia Argento for allegedly sexually assaulting him when he was 17 and cops haven't been able to reach him ... so the case is on ice.

Law enforcement sources tell TMZ ... officers have tried contacting Bennett several times, but he's gone radio silent. Jimmy was last heard from in September when he sat down for an interview on Italian television, and got skewered by the host over his claims ... especially when he admitted to ejaculating.

We broke the story ... Bennett, who's now 22, vowed to go to the L.A. County Sheriff's Dept. weeks before his TV appearance to file a sexual assault report against Argento.

We're told he never did, though ... nor has he indicated he still wants to.

As you'll recall ... Argento and Bennett had a sexual encounter in a Marina Del Rey hotel room back in 2013. Bennett snapped a photo of the then 37-year-old in bed with him, shirtless, after they allegedly had intercourse.

Argento, however, claims it wasn't consensual because Bennett jumped on her and she was "frozen."

Bennett later threatened legal action over the incident and, in April, Argento settled with him for $380,000 ... which her late boyfriend, Anthony Bourdain, paid.

It's a crime in California for an adult to have sex with a person under 18, and the maximum penalty for statutory rape in a case like this is 3 years in prison. It's a moot point, though ... unless Bennett contacts police.

Steven Seagal No Charges In 2002 Sexual Assault Case

Steven Seagal won't be charged for allegedly sexually assaulting a woman in 2002.

According to legal docs -- obtained by TMZ -- the actor was accused of sexually assaulting the woman at some point between May 1, 2002 and August 31, 2002. Full details of the allegation were not included in the filing.

As for why Seagal won't be charged ... the Los Angeles County District Attorney's Office says the statute of limitations has expired.

You'll remember, Steven walked out of an interview with BBC Newsnight in October after a reporter brought up the allegations.

Seagal was also accused of raping a woman back in the '90s -- a case that was also well beyond the statute of limitations -- and Portia de Rossi claimed Seagal sat her down on a couch during a casting for one of his films and unzipped his pants, so she fled the room.

Seagal has adamantly denied all claims.

Harvey Weinstein Judge Rejects His Motion to Dismiss ... Pretrial Date Set

Harvey Weinstein's got a date ... for his sexual assault pretrial in NYC, after the judge rejected his motion to dismiss the case.

Weinstein arrived at the courthouse Thursday morning, and got the bad news shortly thereafter. Once in court, the judge called prosecutors and Weinstein's attorney to the bench ... and said he was not dismissing the indictment.

The attorneys argued at the bench for about 10 minutes -- the media wasn't privy to their discussion -- but at the end the judge stated pretrial will begin on March 7.

The judge issued a written ruling addressing the defense's motion to dismiss -- saying the prosecution is not required to give the Grand Jury evidence that is favorable to the defense.

Translation: There's nothing shady about the Grand Jury not hearing evidence about relationships Weinstein might have had with his accusers. The judge also said the defense's argument the D.A. filed the charges due to "political pressure" was speculative.

Weinstein's legal team had fired off a letter earlier this month informing the judge ... they've found an email claiming to show one of the women alleging he raped her sure didn't act like it, because she went to HIS movie screening only hours after the alleged rape.

The movie mogul's defense has also pointed to a new female witness -- a close friend of one of Weinstein's accusers -- using her to paint a picture of a consensual relationship between Weinstein and his accuser.

Weinstein was greeted in court by several actresses, including Marisa Tomei, Jennifer Esposito, Nia Vardalos and Amber Tamblyn -- who were wearing Time's Up tees.

As we've reported, Weinstein's lawyers filed the motions to dismiss last month. His team also believed the whole case had been tainted ... because prosecutors admitted the lead detective, Nicholas DiGaudio, allegedly hid information about the witness in dealing with prosecutors and allegedly coaxed the witness into not disclosing what she knew.

Weinstein's attorney, Ben Brafman, tells TMZ ... "We are obviously disappointed, by the Court's decision to deny our motion to dismiss the Indictment. Judge Burke has however, ruled and we must accept his ruling. Nothing in the Court's ruling however, removes the flawed theory of this case that we intend to vigorously defend at trial, where we are confident that Mr Weinstein will be completely exonerated."

A few days later, Weinstein was indicted by a grand jury on multiple rape charges.

As we reported ... Weinstein was slapped with 3 new sexual assault charges in July for an alleged sexual assault of a woman in 2006. A grand jury charged Weinstein with a first-degree criminal sexual act and 2 counts of predatory sexual assault, which are felonies carrying a maximum sentence of life in prison.

Weinstein previously scored a huge victory when a judge dismissed one sexual assault count from the case involving actress Lucia Evans.

CBS Employees Quizzed ... How Bad is Sexual Harassment at Network?

CBS execs are reaching out to employees at the network to make sure what Les Moonves got away with for so many years ... never happens again.

CBS sources tell us, employees recently received a survey to help the network determine the "cultures and values" in the company. We're told there were around 100 questions in the survey, some of which invited long-form responses.

Our sources say employees were asked if they'd ever been sexually harassed or assaulted by someone at CBS, if they ever reported it, and if they ever felt threatened by management.

We're told the questions dug deep ... asking employees who had reported an incident if they felt their complaint was properly handled and if the behavior reoccured. Employees were not forced to participate in the survey, but they were strongly encouraged to do so.

One employee told us the survey felt like "an attempt to repair what has become such a broken network."

CBS announced Monday Moonves will not see a penny of his $120 Million severance package.

A statement from the CBS Board of Directors tasked with investigating Moonves read, "We have determined that there are grounds to terminate for cause, including his willful and material misfeasance, violation of Company policies and breach of his employment contract, as well as his willful failure to cooperate fully with the Company's investigation."

In all, twelve women accused Moonves of various forms of sexual misconduct, including engaging in forced oral sex in 1995. He claimed every sexual encounter was consensual.

Moonves' wife, Julie Chen, remains at the network as the host of "Big Brother" ... but left her job on "The Talk" shortly after her husband resigned in September.

Moonves' attorney, Andrew Levander, released a statement Monday saying, "The conclusions of the CBS board were foreordained and are without merit,”

Les Moonves Will NOT Get $120 Million Severance Package ... After Sexual Misconduct Claims

Harvey Weinstein Lawsuit Claims He Bragged About Sleeping with J. Law ... Both Deny Sexual Relationship

8:07 PM PT -- A spokesperson for Weinstein tells us, "This lawsuit was filed and updated strategically with no notice given or any attempt to reach out to Mr. Weinstein's attorneys for one reason; It was meant to embarrass Mr. Weinstein and garner unchecked media attention. There is absolutely no truth to the malicious claims made in this lawsuit, and we are reviewing our options with an eye on filing for an immediate dismissal."

The statement continues, "Mr. Weinstein is embarrased for Ms. Lawrence with whom he has only had a professional and respectful relationship, who has sadly been dragged into this ugly attempt at defamation. This filing further proves that anyone can say whatever they want in a lawsuit for maximum shock value, to defame and debase, without having to offer any facts or reality."

4:45 PM PT -- Jennifer Lawrence tells us ... “My heart breaks for all the women who were victimized by Harvey Weinstein. I have never had anything but a professional relationship with him. This is yet another example of the predatory tactics and lies that he engaged in to lure countless women.”

Harvey Weinstein shocked a woman at the Sundance Film Festival by walking in on her in a bathroom and masturbating ... according to a new lawsuit ... and she claims that was just the start of years of sexual abuse.

The woman filed suit in L.A. County as a Jane Doe ... and says she first met Weinstein at the famed festival in 2013. She says they had a business meeting at the Waldorf Astoria in Park City, and she got up to go to the restroom. In docs, obtained by TMZ, she says Weinstein walked in while she was sitting on the toilet with her tights around her ankles.

She initially thought it was an accident, but in the suit she says she was terrified when she saw him drop his pants. According to the suit, Weinstein exposed his penis and said "My d**k is nice and hard for you" -- and then asked, "Do you like my d**k?"

Doe says she rejected his advance, but Weinstein still moved closer while masturbating. She claims he continued until ejaculating on her skirt. At the end, Weinstein promised her everything would be okay, as long as they remained friends ... according to the suit.

Doe, an aspiring actress, says Weinstein offered a few scripts to look at, and promised follow-up meetings and possible roles.

She says they met again during the festival, and claims he forced her hand onto his erect penis after a screening.

Later that year, she claims they met in NYC to discuss a film called, "Vampire Academy." They had a dinner meeting and afterward they went to his office, and Doe claims he kneeled in front of her and forcibly performed oral sex on her. In the suit, she says she was sobbing ... and Weinstein responded by saying, "I slept with Jennifer Lawrence and look where she is; she has just won an Oscar."

She goes on to allege there were similar incidents of sexual battery in March 2013, January 2014 and February 2015 ... all in NYC.

She also alleges there was a December 2015 incident at a Beverly Hills hotel -- where Weinstein touched himself sexually while saying he just wanted to look at her. When she tried to leave, he allegedly shoved her into the bathroom and said "Shut the f**k up and be quiet. You don't want to f**k this up."

Jane Doe - who is being repped by Genie Harrison - is suing Weinstein and The Weinstein Company. We've reached out to Weinstein's legal team ... no word back yet.

Rachael Denhollander 1st Nassar Accuser 'Last 2 Years Have Been Very Painful'

This is Rachael Denhollander -- the very first woman to come forward with sexual abuse allegations against Larry Nassar.

She's a hero. A survivor. And, she was brutally honest when we asked her how she was holding up in the wake of all that's transpired since she went public with her story.

"It's been really hard. The last two years have been very painful," Denhollander told us.

"My husband has been an incredible support system, my family has been an incredible support system and I'm grateful for that. Not everyone can say that."

We asked Rachael if she thinks she'll ever really completely recover from the abuse -- and again, she didn't mince words.

"I think that something we really need to understand is that the scars still remain. Sexual assault changes the course of a person's life. While there is a great deal of hope after abuse, it's absolutely devastating."

Of course, Simone Biles also is speaking publicly about how she's still dealing with the trauma -- telling 'GMA' this week, "I still go to therapy and I'm on anxiety medication now."

The bottom line -- Denhollander, Biles and other survivors want officials in gymnastics and other sports to be proactive in protecting young athletes from predators like Nassar.

"The real test is what happens when the allegation is in your own community. When it happens against your favorite sports player, your favorite sports team, your favorite coach."

"Are you willing to listen and to look for the truth then?"

Simone Biles Takes Anxiety Meds, Therapy ... Over Larry Nassar Sexual Abuse

U.S. Olympic superstar Simone Biles says she's still traumatized from the sexual abuse she suffered at the hands of Larry Nassar ... and has sought professional help for treatment.

Biles appeared on "Good Morning America" on Tuesday where Robin Roberts asked her how she's been able to handle the emotional rollercoaster connected to the Nassar scandal.

"It's definitely not easy," Biles said ... "I have my ups and downs. I still go to therapy and I'm on anxiety medication now."

"I had a lot of ups and downs throughout the year and trying to figure out what was wrong, and so I go to therapy pretty regularly and it’s not easy but the people surrounding me are some of the best so it makes it a little easier."

Roberts thanked Biles for being so open about her treatment and said, "Bless you for taking care of you like you're doing."

Back in January, Biles revealed she -- like scores of gymnasts -- was abused by the former Team USA gymnastics doctor.

"I've felt a bit broken and the more I try to shut off the voice in my head the louder it screams," Biles posted on social media back in January along with the hashtag #MeToo.

"I am not afraid to tell my story anymore."

Nassar is currently serving a 60-year sentence in federal prison for child porn -- and has been sentenced to up to 175 more years for sexually abusing more than 140 athletes.

'Surviving R. Kelly' Cops Track Down Shooting Threat ... It's a Chicago Number

The investigation into who threatened to shoot up an NYC screening of "Surviving R. Kelly" -- the documentary about his alleged sexual abuse of women -- has led cops to someone in R. Kelly's hometown.

Law enforcement sources tell TMZ ... NYPD's person of interest is a man with Chicago's 773 area code. We're told cops aren't ready to release the man's name yet, and it's unclear if he has any direct connection to Kelly.

'Surviving' was screened Tuesday night at NeueHouse in NYC, but 20 minutes into it someone made a phone threat. The male caller said someone was in the audience with a gun and would open fire if the screening continued. The venue was immediately evacuated.

R. Kelly's ex-wife, Andrea Kelly, told Variety she thought the singer was connected to the threats. Andrea was at NeueHouse and she and several other accusers were scheduled to hold a Q&A session immediately following the screening.

The docuseries premieres in January on Lifetime.

We reached out R. Kelly and NYPD for comment ... both declined.

Harvey Weinstein Alleged Victim Went to My Screening ... Here's the Email Chain!!!

1:23 PM PT -- The Assistant District Attorney just submitted a letter to the judge in response to Weinstein's new docs, saying, "The defendant filed an addendum to this argument ... describing a communication involving this same witness ... when read in conjunction with the grand jury minutes, this is not exculpatory information."

The letter continues ... "The defendant has a misguided and antiquated view of how a rape victim should react after having been assaulted does not change this reality."

Harvey Weinstein says the woman alleging he raped her sure didn't act like it, because she showed up at HIS movie screening just hours after the alleged rape.

Weinstein's legal team fired off a letter informing the judge in his rape case ... they've found an email between Weinstein's assistant and a friend of the alleged victim, and the timing is key ... they say.

The email is an invitation to attend a screening for one of Weinstein's projects. It was sent to an unidentified woman -- her name's been redacted -- and said she could bring 3 guests with her.

The invitee responded to Weinstein's assistant, "I'm going just with (name redacted)." According to Weinstein's attorney, Ben Brafman, the guest she was bringing is one of the alleged victims.

The alleged rape happened the morning of March 18, 2013 -- and the email exchange happened later that afternoon. Brafman says the friend confirms she and the alleged victim not only attended, but met up with Weinstein at the screening.

Brafman insists this is "strong evidence that she was not raped" -- why would an alleged rape victim "go out of her way to spend time with her 'rapist' merely hours" after the alleged attack?

TMZ broke the story ... the friend is a new witness who claims the alleged victim was "hooking up" with Weinstein for "a very long time" and she never heard the alleged victim say anything bad about Weinstein.
