California Cop Video Shows Kick to Suspect's Head ... Deputy Under Investigation

A Sheriff's deputy in Southern California is under investigation due to a video of him winding up and kicking a suspect in the head AFTER the guy appeared to surrender.
Surveillance footage from a Toyota dealership in Victorville, CA captured Wednesday's violent interaction on camera ... you see the suspect roll out from under a parked car before he's confronted by a deputy with a flashlight, who appears to order the suspect on the ground.
The man complies, but then the cop takes a big step and unloads a couple kicks to the suspect's face.
Video shows the cop stand over the man for a few seconds before beginning to slap some handcuffs on him as another deputy arrives to assist.
The San Bernardino County Sheriffs Department tells TMZ the incident started with an attempted traffic stop of a motorcycle. Police say the driver led cops on a high-speed chase, and ditched his bike near the dealership before fleeing on foot. Cops say they found the suspect hiding in the dealership lot, and admit there was a "use of force" during the arrest.
The Sheriff says a review of the footage raised immediate concerns about the deputy's actions and he's on leave while under investigation.

The Shake Shack manager will get his day in court, and now one of the NYPD cops wants hers too -- because she's suing the burger joint, and she's sticking to the bleach story!
NYPD officer Genesis Novadiaz just filed a lawsuit against SS, claiming she was one of the 3 officers who thought they were "poisoned" ... and she's pointing the finger at Shake Shack and its employees, including the manager who just filed a lawsuit of his own over the incident.
In the docs, obtained by TMZ, Novadiaz claims Shake Shack workers at the Manhattan location -- including manager Marcus Gilliam -- were negligent in their duty to maintain equipment in a safe manner for customers ... and, as a result, she alleges she was subjected to harmful cleaning chemicals in her shake, including bleach.
So, she's sticking to her guns, claiming there must've been bleach in those damn shakes. While the theory of intentional poisoning was debunked by an NYPD investigation, Novadiaz is still calling out the restaurant for careless or reckless upkeep on their shake machines.

In the suit, she claims Shake Shack violated a number of New York City and State health code violations -- and oughta be forced to pay for it, because she says she became ill.
Remember, Gilliam himself just sued New York and the officers over the same incident -- claiming they defamed and falsely arrested him by lying about being intentionally poisoned.
Seems Novadiaz wanted to get her own version of the story in a courtroom, as well.

Jimmy Graham I Was Going 90 MPH Before I Flipped My Car ... In Wild March Crash
Jimmy Graham is VERY fortunate to be alive today ... the NFL star told reporters he was going NINETY MPH before flipping his car in that terrifying rollover March accident.
Graham walked away from the wreck in the Miami area unscathed ... but when he broke it all down for media members at his press conference Tuesday, it's truly hard to fathom how he wasn't seriously injured in the crash.
The 34-year-old says it all initially happened because he saw a cop car going down an off-ramp with its reverse lights on.
"He was reversing," the Chicago Bears tight end said. "So I got over two lanes and, you know, the sun is kind of coming up, and as I go up over that hill, I'm looking at the cop and when I look up, there's a disabled vehicle on the center lane."
"And I'm going about 90. So, probably about 15 yards away, so I swerved to the left and barely missed him, but I was headed for a bridge so I had to make kind of a last-minute decision and decided to turn right and flip it to avoid jumping that thing."
Graham says cops told him he rolled his vehicle over FOUR times and skidded on his roof for about 100 yards.
Somehow, though, Jimmy says he and his dog were able to simply get out of the ride after it came to a stop and walk away.
"Sparks and glass is going everywhere and I'm just sitting there in the seat belt," Jimmy said. "I get out the seat belt and I'm on the roof kind of hollering for my dog. I don't hear her so I get out and she's in the back and we just walked way."
"Couple hours later, ended up flying [out for a charity event]. So, it was a wild one."
Graham added that he's super thankful for the Miami area authorities who responded to the crash ... saying he felt "obviously extremely lucky" to have avoided tragedy.

Shake Shack Manager You Hauled Me Downtown But I Didn't Spike Cops' Drinks!!!
The Shake Shack manager accused of poisoning police officers' drinks last summer claims he was treated like a first-rate criminal ... and now he wants someone to pay.
Marcus Gilliam -- the man who was running the Manhattan restaurant when this went down about a year ago -- just sued a number of NYPD cops, a few police unions and the City of New York for what he says was a rush to judgment and a gross overreaction, all based on nothing.
In his suit, obtained by TMZ, Gilliam alleges he was arrested and taken in for questioning that night, and was kept in custody until the wee hours of the morning ... supposedly getting grilled and accused of spiking 3 cops' shakes with bleach, even though he says he actually hadn't.
ICYMI -- 3 NYPD cops rolled up to Shake Shack, said their milkshakes tasted funny ... and before you knew it, had a whole bunch of unions tweeting out accusations that their officers had been intentionally poisoned.
Gilliam points out what we had reported ... that a "thorough investigation" proved that was a bogus allegation. In the interim, Gilliam says he was getting treated like crap by cops, being falsely held against his will for something he clearly hadn't done.

As it turned out ... the "funny taste" in the shakes might've been the machine not being cleaned properly. In any case, Gilliam claims his detainment was BS, because there was a mountain of evidence -- like surveillance video -- that the NYPD should have checked to clear his name before they hauled him into custody.
He alleges he was not only falsely arrested, but defamed as well when the suspicion turned into "fact" and spread like wildfire ... and he's asking for damages.
One last thing ... Gilliam apparently doesn't know the names of many of the cops he says were involved in the ordeal, including the 3 who kicked it off. So he identifies them by the types of shakes they ordered — Strawberry, Vanilla and Cherry Shakes. 😅

Famous Dex Drama at Court Hearing ... Back in Custody Over Protective Order
New trouble keeps finding Famous Dex ... even when he's in court dealing with previous legal issues.
Law enforcement sources tell TMZ ... the rapper was at a hearing Thursday related to the 19 charges he was hit with in March -- including domestic violence and gun possession, to name just a couple -- and he pled not guilty to those charges.
However, we're told during the hearing it was revealed that Dex had allegedly violated a protective order put in place after one of the alleged domestic violence incidents from last October.
Our sources say the rapper was immediately taken into custody, and is currently being held on $200k bond.
As we've told you ... Dex's string of big-time legal problems began in November when a SWAT team showed up at his home, and he was named a suspect in a domestic violence case.
A few months later, he was arrested for gun possession during a traffic stop, and just days after that ... he was hit with the 19 charges.

Swae Lee believes the cleaning staff at a Miami hotel cleaned him out of some very pricy ice ... and now police are looking into it.
Law enforcement sources tell TMZ ... the rapper had a room at the Mondrian Hotel in South Beach, and he told cops when he checked out Thursday he realized some of his jewelry was missing -- $300,000 worth!!!
Sources close to Swae say a bracelet and chains got jacked, and he explained to cops why he thinks hotel workers could be the culprits. That's because we're told after he reported the theft to the hotel, the bracelet was turned in -- allegedly by an employee -- but not the chains.
Our law enforcement sources say Miami Beach PD detectives have spoken to Swae and are investigating the incident, but so far cops say there's no evidence hotel staff was involved in the alleged theft.

Darnella Frazier -- the teenager who recorded George Floyd's death under Derek Chauvin's knee -- has just earned a special citation in this year's Pulitzer Prize.
Pulitzer Prize co-chair Mindy Marqués said during Friday's announcement that the Floyd story, in particular, highlighted not only the essential role of journalists, but the increasing importance of ordinary citizens.

She added, "We want to note that the board has awarded a special citation to Darnella Frazier, the teenage witness who filmed and posted the transformative video that jolted viewers and spurred protests against police brutality around the world."
The honor was presented after the board awarded the Minneapolis Star-Tribune with the Pulitzer -- arguably journalism's most prestigious award -- for its reporting of Floyd's death and the aftermath.
Darnella was 17 when she whipped out her phone to record the fatal arrest. After posting the video on social media, it spread like wildfire across the globe, sparking a worldwide movement against police brutality.
But, after the video went viral, Darnella said she had to move away from her home for safety. She also suffered anxiety attacks and couldn't sleep ... often times waking up shaking until her mom rocked her back to sleep.
On the 1-year anniversary of Floyd's death ... Darnella said even though it was a traumatic life-changing experience, she was still proud of herself. She added, “If it weren’t for my video, the world wouldn’t have known the truth.”
The video, of course, played a massive role in the prosecution and conviction of Chauvin.

Someone has beef with Jennifer Lopez and way too much time on their hands, and it's pissing off cops, who continue to get flooded with 911 calls to go to her L.A. home ... nearly 6 months after this annoyance started.
Law enforcement sources tell TMZ ... LAPD units are still responding to the singer's house because someone keeps calling 911, but we're told this isn't your typical swatting where people report a fatal shooting or mass carnage.
We're told the 911 caller reports other complaints ... like loud music or other disturbing noise coming from the house. Our sources say each time officers get to the pad, there's no such disturbance and J Lo's security tells them everything's fine.
In one instance, we're told cops found a gardener at Jennifer's pad -- but security quickly assured them the gardener wasn't blaring music.
Our sources say cops are struggling to track down the 911 callers because the calls aren't coming from a landline -- and the bogus calls have become a huge waste of time and manpower.
TMZ broke the story ... the calls started almost immediately after J Lo performed at President Biden's inauguration, and the operating theory was the calls were politically motivated.
We're told J Lo's security is working with LAPD in an effort to solve the mystery -- but it's already such a headache, cops desperately want the offender busted, convicted and locked up to the max.

Jeff Lowe's legal troubles are piling up, and in more than one state ... TMZ has learned.
On the heels of the 'Tiger King' star getting busted for DUI in Oklahoma, Jeff's now a wanted man in Las Vegas ... this according to the clerk at the Las Vegas Municipal Court, who tells us there are 4 bench warrants out for his arrest.
The warrants stem from a 2017 case in which he was charged with 3 counts of not having a proper license or permit for wild animals, and one count of doing business without a license. He was convicted in 2018 of illegally using animals to make money in the Las Vegas valley, but agreed to stay out of trouble to avoid jail time.
According to the clerk ... the bench warrants were issued because Lowe was due in court Wednesday for a hearing, but he no-showed.
We're told Lowe has to post $20,500 to deal with the warrants and get a new court date.
We broke the story ... Jeff and his wife, Lauren, were arrested this weekend for DUI, as cops say they were both intoxicated and driving at different times before they got busted.
In the weeks prior to that ... Lowe had dozens of his big cats confiscated from his Oklahoma zoo. The feds said the seizure was part of an ongoing probe for alleged violations of the Endangered Species Act.
We've reached out to Lowe ... no word back, so far.

As you know ... the 2 have been crisscrossing the country since hooking up months ago and igniting Bennifer 2.0. He traveled to Miami to be with her, and then last week she was in L.A. to be with him and checked out a fancy private school -- presumably for her kids, Max and Emme, to attend.
We'd say take a good look before she's gone, Miami ... but we know you already did.

A Philly cop inadvertently busted himself pulling an illegal move ... at least that's the claim of a man who recorded his own arrest, only to see that video deleted -- allegedly by the arresting officer -- and now a lawsuit's coming.
According to the police report ... a Philly cop identified as Officer Burnett says he noticed a pickup truck idling for 10-15 minutes at a gas station back in March, so police ran the plates and it came back to Jacob Giddings.
Cops say Giddings had an active warrant for assault, so Officer Burnett asked him to step out of the vehicle, and when he "started to resist" ... Burnett used force to pull him out.
However, Burnett's body cam was activated, and as you can see ... it captured Giddings apparently recording the incident on his phone from inside his truck. That fact is not mentioned in the police report.
Based on Burnett's body cam, it looks like Giddings lost his phone in the struggle. Later, after Giddings was in custody, the officer picked up the phone and appeared to gain access to the footage. He hits a few commands, but it's not clear from the footage what he did.
Giddings, from the police car's backseat, is heard asking Burnett if the video is still on his phone, and the cop says he doesn't know -- but Giddings believes Burnett deleted the vid.
According to the police report, cops also found marijuana on Giddings and he was arrested and charged with one count of resisting arrest and one count of drug possession. During the bust he suffered minor cuts to his wrist from the handcuffs, and was taken to a hospital for treatment.
Giddings has lawyered up, and his attorney, Donte Mills of Mills &. Edwards LLP, tells TMZ ... they'll be suing Philadelphia PD for excessive force and assault, tampering with evidence, false arrest and malicious prosecution.
Mills says they later recovered Giddings' arrest video from his iCloud account. We're told Giddings is still being prosecuted, and he doesn’t believe Burnett has been disciplined.
According to Philadelphia Police, "This incident is currently under investigation with our Internal Affairs Bureau. The officer involved has been placed on administrative duty status pending the outcome of the internal investigation."

UPS Driver Attacked on San Fran Street ... Attacker Gets Instant Karma!!!
Cops are searching for 2 brash, and slightly bruised, jerks who robbed a UPS driver in broad daylight -- and another driver's dash cam captured the whole incident, including the suspects' comical getaway.
The attack went down last week in San Francisco's busy downtown area, where one suspect -- wearing a face-covering -- hopped out of a car and started throwing a flurry of punches at a UPS driver named Minh.
Minh told KPIX-TV the attacker first swiped a package from his cart, and when he tried to retrieve it things turned violent. Although he tried his best to fend off the punches, he says he got hit in the face and lost 2 teeth ... in addition to suffering a black eye.
The guy who was punching Minh ended up dropping the package, and attempting to jump into his buddy's car -- but as they tried to speed away, the puncher fell HARD out of the moving vehicle!!!
That's the only awesome part of this video. Well, that and the fact the suspects' license plate is clearly visible.
No arrests made yet, but armed with this video, you'd think it's just a matter of time before cops track down these tools.
As for Minh -- his foot was injured under the getaway car, and he's now on crutches. There's a GoFundMe account set up to help him recover and provide for his family of 5.

Sources familiar with the situation tell TMZ ... the Nelk Boys recently donated over $100,000 to boost the reward for info on what police are calling a road rage killing -- one that left a young boy dead.
6-year-old Aiden Leos was shot and killed May 21 on the 55 Freeway in Orange, CA while on his way to kindergarten with his mother ... and we're told the Nelk Boys felt heartbroken for the single mom and wanted to help find her son's killer.
Our sources say the Nelk Boys, who live in Orange County, hit up the District Attorney expressing a desire to raise the reward for information on the case ... donating $100,000 along with their partner John Shahidi on May 30 as the reward swelled last week to at least $500k.

By Sunday, the California Highway Patrol said they had arrested 2 suspects, 24-year-old Marcus Anthony Eriz and 23-year-old Wynne Lee, near where the shooting happened. The CHP says the pair are expected to be charged with murder.
Law enforcement sources tell TMZ ... the reward is for the arrest and conviction of the young boy's killer, so it will be a while before any reward or part of the reward is paid out.
We're told law enforcement is still investigating.

The Miami shooting allegedly involving DaBaby's entourage left a grisly scene ... and one of the victims says he still has a bullet lodged in his leg.
Check out these photos of the injuries Emerson Delgado says he suffered when shots rang out late Monday night in Miami Beach.
As you can see, Delgado's right leg is a bloody mess, and the guy's missing a huge chunk of flesh now. He's been treated and released from a hospital, but he says he'll be wearing a walking boot-styled cast for some time.
According to the police report, cops say Delgado was shot once in his right calf ... but his lawyer, Josiah Graham, tells us there was a second bullet that grazed Delgado’s right hamstring.
Graham, who's with Kelley Uustal law firm, claims the melee began when a member of DaBaby's entourage punched Delgado, knocking him to the ground. He says Delgado started to run away, when someone behind him opened fire and struck him in the leg.
As we reported ... a rapper named Wisdom, who police say is a part of DaBaby's entourage, was arrested for attempted murder and aggravated assault with a firearm. Cops say Wisdom fired at least one shot that hit someone in the leg.
Graham says doctors decided to leave the bullet inside Delgado's leg to avoid any potential future damage. While he's out of the hospital, he remains on bed rest. It's easy to see why.

The "RuPaul's Drag Race" star arrested for allegedly pummeling a romantic partner is claiming self-defense, and she let cops know it as she was arrested -- while also blasting white "privilege," and taking a vape.
TMZ obtained this must-see video of Widow Von'Du in handcuffs, shouting that she's getting busted for defending herself in her own Kansas City, MO apartment -- and she clearly thinks it's because the alleged victim is a white man.
According to Von'Du ... she had asked him 5 times to leave her pad. As she put it, "someone else would not understand his privilege does not extend to my apartment." She quickly added, "And, just because his ass got beat up because he would not leave ... I'm being arrested."
You can also see a friend of Von'Du's holding a mic, and she made it clear she wanted all her fans to know about what she sees as a gross injustice. That being said, when someone offered her a vape ... Widow took a break from raging out to inhale deeply.
Things got deadly serious, though as police were loading Widow into their van. She demanded cops strap her down because she didn't want there to be any doubts about her possibly resisting police. She declared for the camera, "I'm not about to be the next one that we march for" ... alluding to Black people who've died in police custody.
As we first reported, Von'Du allegedly punched and KO'd her partner, leaving him with injuries so severe ... he needed 14 stitches in his face and head. Von'Du was booked for 1st and 2nd-degree domestic assault.

JoJo Siwa's extravagantly fun Pride Party took a dark turn when cops were called for a possible overdose.
Law enforcement sources tell TMZ ... cops and paramedics responded to the call to JoJo's home in the San Fernando Valley a little after 8 PM Wednesday. We're told someone reported a male around 30 years old might have OD'd on LSD.
Sources connected to the party claim the guy showed up to the party high, and in pretty rough shape. We're told the person was transported to the hospital, and police determined there was no crime committed.
That person's health status is unclear at this time. We've reached out to Siwa's rep for more ... no word back so far.
As we reported ... JoJo threw a huge rainbow-themed bash at her house attended by her GF and a bunch of fellow influencers, including Tana Mongeau. The party featured a bounce house, a decked-out pool and kitchen, a bedazzled piano and a whole lot more.
Unfortunately, it seems one person took the fun way too far.
