Dwight Yoakam thinks Marilyn Manson aiming a fake gun at concertgoers was "an inappropriate moment" -- but adds that kinda stunt is fair game in a nation as free as ours.

We got the country star Monday at LAX and he stopped short of ripping into Manson for his assault rifle prop at his show in San Bernardino ... scene of a 2015 mass shooting.

Manson chalked it up to his artistic expression ... and Dwight seemed to accept that, but made it clear he'd never pull that kinda thing.

He also talked about terrorism and the ongoing wave of gun violence in America -- and Dwight seems to think there's no way to put an end to it.

7:04 PM PT -- According to reports, Devin Patrick Kelley is described as an Air Force vet who was discharged for bad conduct ... and who was once court-martialed for alleged assault of his wife and kid.

Texas officials just held a press conference about the deadliest mass shooting in the state, and revealed that a local resident fired back at the shooter who killed 26 people at a small town church ... and then gave chase before the gunman was found dead.

A rep for the Texas Department of Public Safety gave a blow-by-blow account of what went down Sunday morning in Sutherland Springs, TX where a gunman opened fire at the First Baptist Church.

He says the gunman, ID'd as Devin Kelley, was dressed in all black tactical gear when he opened fire on the church -- using an AR assault-style rifle -- from the outside and then continued inside. When he walked out again, a local resident engaged him with his own rifle, causing the gunman to flee.

The resident followed the gunman in a separate vehicle, and the gunman was later found shot dead around a nearby county line ... where cops say they found more firearms in his car. It's unclear if the gunman suffered a self-inflicted gunshot wound, or if the resident shot and killed him.

As we reported ... the gunman left at least 26 dead, not including himself, as well as at least 20 others injured. The victims' ages range from 5 years old to 72.

Apparently, the resident who fired back at Kelley flagged down a passerby in a truck and instructed him to follow Kelley. The driver of that truck, Johnnie Langendorff, explained to local media he made a snap decision to follow the shooter.

Kevin Spacey Netflix Cuts Him Loose

Netflix is out of the Kevin Spacey business -- completely -- severing all ties with the actor and leaving the future of "House of Cards" uncertain.

The streaming service announced, "Netflix will not be involved with any further production of 'House of Cards' that includes Kevin Spacey." Translation, producers have to cut him from Season 6 or else.

Netflix went on, "We will continue to work with MRC [the Producers] during this hiatus time to evaluate our path forward as it relates to the show."

There's talk that Spacey's character, Frank Underwood, will be killed off and Robin Wright's character will carry the show in the final season, but no decision has been made.

And Netflix went even further, "We have also decided we will not be moving forward with the release of the film 'Gore,' which was in post-production, starring and produced by Kevin Spacey."

The decision was triggered by Anthony Rapp's claim that Spacey sexually assaulted him when he was 14. Numerous claims were subsequently made by cast and crew of "House of Cards," saying Spacey created a toxic working environment by sexually harassing men on set.

NYC Terrorist Wanted to Fly ISIS Flag in Hospital Room

The terrorist who mowed down a group of people in New York City Tuesday was so strident about what he had done, he told law enforcement he wanted to fly the ISIS flag in his hospital room.

According to the criminal complaint, obtained by TMZ, Sayfullo Habibullaevic Saipov told FBI agents he "felt good about what he had done."

His cellphone was an electronic ISIS training manual which included, among other things, a video of ISIS fighters shooting prisoners in the face and a video of a beheading. The complaint says the videos, 90 in all, inspired Saipov to carry out the attack.

Saipov was shot by a cop after the attack and was taken to Bellevue Hospital.

Eight people died as a result of the attack.

NYC Terrorism Accused Terrorist Mows Down Pedestrians ... NYPD Takes Him Down

One driver, who police are calling a terrorist, rammed pedestrians and cyclists in lower Manhattan Tuesday, killing 8 people and injuring about a dozen more.

The FBI says it's investigating the incident as an act of terrorism. Video from the scene shows multiple people injured on a bike path which runs adjacent to NYC's West Side Highway. Police have the suspect in custody after an officer opened fire, shooting him in the abdomen.

NYPD says the alleged terrorist drove down the bike path for about 20 blocks before running into a school bus. That's when the NYPD officer engaged and shot the suspect.

The attack is the deadliest act of terror in NYC since 9/11.

Singer Josh Groban was in a nearby park with his dog, and says he heard 8-10 shots ring out as he fled the area.

Yasiel Puig Autographs Ball to Honor Vegas Shooting Victim

Yasiel Puig didn't let the intensity of the World Series -- and Tuesday's Game 6 -- stop him from doing something awesome to honor a victim of the Las Vegas shooting who was a Dodgers super fan.

Laura Shipp was one of the nearly 60 people killed in the massacre, and was described by her family and friends as a lifelong fan of Big Blue.

We're told Puig heard about Laura's story and last night decided to do something for her son Corey -- a Marine reservist. He autographed a baseball with a message for Laura.

He wrote, "To Laura, RIP" and added his signature. We're told the ball will be delivered to Corey today before Game 6 begins.

Eric Chase Bolling Jr. Death Ruled Accidental Overdose ... Father Says

5:25 PM PT -- We've obtained Bolling Jr.'s autopsy report -- it confirms Sr.'s tweets -- saying Jr. died of an accidental overdose. The report states Jr.'s blood had cocaine, fentanyl and a medication for anxiety.

The death of Eric Chase Bolling Jr. has been ruled an accidental overdose ... this according to his father.

The ex-Fox News Channel anchor, Eric Bolling, said he received tragic news Thursday from the coroner in Colorado informing him his 19-year-old son accidentally overdosed on drugs that included opioids. Eric went on to say, "Adrienne and I thank you for your continued prayers and support. We must fight against this national epidemic, too many innocent victims."

The news comes on the same day President Trump declared the opioid epidemic a national public health emergency.

We broke the story ... Eric died after suffering "emotional torture" over the humiliation his dad was suffering following his firing from the network over sexual harassment allegations.

Donald Trump I'm Releasing Secret JFK Documents Hey CIA, Nervous Much?

Next week could prove to be a seismic event in our nation's history, because Donald Trump just announced he will release documents our intelligence agencies have fought fiercely to keep secret relating to the assassination of President John F. Kennedy.

The documents have been kept under wraps since JFK's assassination November 22, 1963. JFK's successor, Lyndon Johnson, created the Warren Commission to determine if Lee Harvey Oswald acted alone. The Commission turned a blind eye to witnesses, documents and film suggesting a conspiracy.

The Warren Commission issued a 26 volume report, with thousands of documents, but the CIA and other agencies fought to keep thousands of documents secret, citing national security. The law says the remaining documents must be released by October 26 unless there are security reasons to keep them secret. Our intelligence agencies are still lobbying for secrecy.

There's a theory as to why these documents have been secret. JFK was led astray by the CIA over the disastrous Bay of Pigs invasion in the first year of his presidency. Kennedy hated the CIA for the embarrassment and diminished its role in the world of intelligence. There are some who believe Oswald had ties to the CIA and the agency might have been happy to get a new, less hostile president.

Mandalay Bay Vegas Shooter's Room Off Limits ... So is Entire 32nd Floor

The Las Vegas shooter's 32nd-floor suite at Mandalay Bay is still completely shut off to the public, and in fact ... the whole floor's on lockdown.

One of our guys hit up the hotel Friday to check out the situation with Stephen Paddock's room after reports the hotel planned to never rent it out again. This video shows you can't even get close to the suite.

Elevators won't allow guests to get off on the 32nd floor, and security guards are stationed in stairwells to block access.

Law enforcement sources tell us Vegas PD completed the investigation of the suite, and they've turned it back over to the resort -- but it's clear Mandalay Bay's not ready to let morbid sightseers gawk at it.

The Weinstein Co. In Financial Freefall Buyer Getting Cold Feet

The Weinstein Co. is broke as a joke and a review of its books is scaring the one potential buyer who could save it.

Sources familiar with the situation tell TMZ, TWC has been out of money for 15 months. The 42% equity interest owned by Harvey and Bob Weinstein, we're told, is worthless.

What's especially daunting ... a top-to-bottom review of the company and its books has unearthed -- as one source put it -- "a horror story."

We're told the deals the company made -- especially movie deals -- are falling apart left and right. As one source connected to the company tells TMZ, "I haven't seen this much anger EVER in this business. Companies are taking this one personally."

We're told the finances and state of the company are so daunting, Colony Capital -- which has been in negotiations to buy TWC -- is no longer sure it makes sense. Colony fears that even by changing the name and doing a complete personnel change, there's a taint that just won't go away.

One TWC insider tells us, "One thing is certain. If there's any chance for survival, Bob has to go." As we reported, if Colony Capital goes forward, Bob Weinstein will be gently pushed aside to run Dimension -- the film division which is not really a player.

Museum of Ice Cream Upping Its Sprinkle Game For the Environment

The Museum of Ice Cream has been a huge hit for dessert lovers in L.A. and San Francisco this year ... but now some folks are screaming about the harm it's doing to the environment.

The museum's main attraction -- the Sprinkle Pool -- isn't all rainbows according to critics who've pointed out the tiny plastic sprinkles get carried out to the streets in people's clothes and become litter ... which could end up in the water and be a danger to marine life.

A rep for the museum tells TMZ ... it's aware of the environmental concerns and working on a fix, including creating a biodegradable sprinkle for the Sprinkle Pools. We're told California's top environmental specialists have been consulted on the issue as well.

In the meantime ... the museum claims it's ramping up its cleaning efforts to minimize the amount of plastic sprinkles that make their way outside its walls ... and encourages guests to do a "double shake" before leaving.

Fans of the ice cream attraction don't have to worry, though -- it's staying open until December ... so there's still plenty of time to get a Sprinkle Pool pic for the 'gram.

Jesus Campos, the Mandalay Bay security guard who alerted police to the Las Vegas shooter, is speaking out for the first time about the violent encounter that left him with gunshot wounds.

Jesus opened up to Ellen DeGeneres ... detailing the harrowing moments leading up to him discovering Stephen Paddock on the 32nd floor, just as he was starting to open fire on the crowd of concertgoers below.

He thinks a loud slamming door during his routine check of the floor is what tipped off his location to Paddock, who then started shooting into the hallway -- and hit Campos in the leg.

Miraculously, Campos says he was still able to somehow get on his radio and tell his team shots had been fired. You can hear his full story on Wednesday's episode of 'Ellen.'

United Airlines 2 Officers Fired In Violent Passenger Removal

The officers who violently dragged a passenger off a United Airlines flight have been canned and a third has resigned ... 6 months after the violent incident was caught on video.

The Chicago Dept. of Aviation on Tuesday released a report outlining why it fired an officer, sergeant and suspended 2 others for their role in savagely dragging Dr. David Dao off Flight 3411 at Chicago's O'Hare International Airport back in April.

The incident threw United into a massive PR crisis that was compounded after CEO Oscar Munoz said he fully stood behind the crew's actions. Munoz subsequently apologized.

In the Inspector General's report, the IG said one officer was fired for improperly escalating the incident while a sergeant was 86'd after removing facts from an employee report.

Dao -- who later settled with United for an undisclosed amount -- suffered a concussion, broken nose and lost 2 teeth. Following the news, Dao's attorney, Thomas Demetrio, said "This is not a day of celebration for Dr. Dao, who is neither vindictive nor happy about Mr. Ferguson's findings. There is a lesson to be learned here for police officers at all levels."

A rep for the Anne Frank Center for Mutual Respect -- a nonprofit supporting her legacy -- tells TMZ ... HalloweenCostumes.com's gimmick is offensive and trivializes Anne's suffering and the suffering of millions during the Holocaust.
