Halle Berry and Gabriel Aubry Counseling for Everyone

Halle Berry and Gabriel Aubry have been urged to get some serious counseling for the benefit of Nahla, but their marathon court hearing today was contentious and largely unproductive ... law enforcement sources connected with the case tell TMZ.

We've learned the L.A. County Department of Children and Family Services submitted more than a dozen recommendations to the judge, including mediation ... in which a 3rd party would sit with Halle and Gabriel and try to figure out how they can peacefully raise their child. We're told Halle was receptive but Gabriel wasn't.

And our sources say ... Halle agreed to continue her individual counseling, which will help her deal with what has become an impossible situation.

As for Gabriel, he's agreed to counseling for his anger issues.

And, as we first reported, both parties agreed today to send 3-year-old Nahla to counseling.

We're told the judge did not make any decision on the fate of the nanny, whom Gabriel wants fired.

And the judge hasn't ruled on Halle's request to keep Gabriel from Nahla until the child endangerment investigation runs its course.

Sources say Gabriel has objected to most of the recommendations and the judge is on the verge of holding a full hearing -- similar to a trial -- so he can firmly call the shots.

Halle Berry Locked and Loaded for Court

Halle Berry just arrived at the L.A. County Courthouse ... ready to do battle with baby daddy Gabriel Aubry.

Halle is trying to get a restraining order ... prohibiting Gabriel from having any contact with Nahla until the child endangerment investigation targeting him is resolved.

Sources tell us ... it's possible Halle will be required to testify today. Gabriel is trying to get an order firing the nanny ... something Halle doesn't want.

Halle Berry and Gabriel Aubry Counseling Recommended for Nahla

Gabriel Aubry's custody battle royale with Halle Berry has taken its toll … the L.A. County Department of Children and Family Services is recommending their 3-year-old daughter Nahla go into counseling … TMZ has learned.

There have been no allegations of Halle mistreating Nahla, but the nanny claims Gabriel screams at the child and has even violently yanked Nahla out of her arms.

Both Halle and Gabriel are scheduled to be in court today. Sources tell us Halle wants the judge to prohibit Gabriel from having any contact with Nahla until a criminal child endangerment investigation targeting him is resolved. The nanny accused Gabriel of pushing her while she was holding Nahla ... which is what triggered the investigation.

And speaking of the nanny … we've learned Gabriel is also asking for a restraining order ... asking the judge in effect to fire the nanny because Gabriel believes she is making up stories to curry favor with Halle.

TMZ also previously reported that Gabriel has agreed to enroll in anger management classes to control his temper.

Gabriel Aubry Agrees to Anger Management

Halle Berry and Gabriel Aubry met for hours Friday with representatives from the Los Angeles County Department of Children and Family Services ... and social workers concluded Gabriel needed to work on his anger issues ... law enforcement sources tell TMZ.

We're told DCFS recommended that Gabriel take anger management classes and our sources say he agreed to enroll.

As one law enforcement source told us who is connected to the case, "Gabriel has a little bit of a temper, but the good news is that he realizes it."

The recommendation stems from an incident earlier this month in which Gabriel allegedly pushed the nanny while she was holding Nahla. Our sources say Gabriel told social workers he never touched the nanny and she was making the story up to curry favor with Halle.

Our sources say DCFS is not making any recommendations on changing the custody arrangement. That will be left to the judge on Monday morning ... when Halle and Gabriel square off
again in court.

As we first reported ... there's also a criminal investigation focusing on child endangerment and battery. Our law enforcement sources tell us they are confident Gabriel will NOT be prosecuted because it's a "he said she said" case. We're told the matter will be referred to the L.A. City Attorney next week but it's expected the Office will decline to prosecute.

Gabriel Aubry Keeps Nahla Close

Gabriel Aubry kept a tight grip on his daughter Nahla this AM, in the midst of his battle royale with baby mama Halle Berry.

We're told Gabriel left his house to take Nahla to her pre-school.

TMZ broke the story ... Halle is trying to temporarily strip Gabriel of all contact with Nahla while police investigate a criminal child endangerment complaint against him ... for allegedly pushing the nanny while she was holding the child. Gabriel is also being investigated for battery.

Halle Berry Child Services Pays Visit Over Aubry Abuse Allegations

The L.A. County Department of Children and Family Services is at Halle Berry's home right now ... interviewing her over claims that baby daddy Gabriel Aubry had put 3-year-old Nahla in harm's way.

Law enforcement sources tell TMZ ... the visit to Halle is routine -- whenever there's a claim of abuse or neglect, DCFS will interview both parents. It underscores that DCFS is not blowing off the nanny's claim -- that Gabriel allegedly pushed her against a door with the kid in her arms.

The nanny also claims Gabriel has violently yanked Nahla out of her arms.

There is also a criminal investigation to determine if Gabriel committed the crimes of child endangerment or battery.

Halle Berry, Gabriel Aubry Judge Puts Off Decision

Halle Berry will have to wait until Monday to get a decision from a judge ... on whether her baby daddy, Gabriel Aubry, should be prohibited from having any contact with Nahla until the child endangerment investigation runs its course.

Sources tell TMZ ... Judge Scott Gordon heard the matter this AM because the judge who was handling the case is on vacation. After hearing the lawyers arguments, Judge Gordon decided he would not decide, but rather put the matter off until next Monday, when Judge Mark Juhas returns from vacation.

Judge Gordon did not grant an immediate emergency order for either side because he believed there are enough protections in place to keep Nahla safe until Monday's hearing.

We're told Halle and Gabriel did not address the judge.

Halle Berry's Nanny Loses Restraining Order Bid Against Gabriel Aubry

Halle Berry's nanny -- who Gabriel Aubry allegedly pushed into a door while she was holding his daughter Nahla -- just got shut down in court -- the judge rejected her request for a restraining order.

Alliance Kamdem claimed she feared retaliation by Aubry, but the judge called her petition "insufficient and speculative."

In her declaration, Kamdem raised more issues than the alleged incident last week, in which she claimed Aubry pushed her out the door while she was holding Nahla. Kamdem cites another alleged incident in June in which she claims Gabriel violently pushed her out a door.

Kamdem claims during a recent trip to Spain where Halle was shooting a movie, Gabriel "would walk over and violently grab/take Nahla away from me."

She also said Gabriel didn't like her from the moment she began her duties as a nanny last June. She claims Gabriel said, "You are a spy," and "Nahla doesn't like you, she doesn't want you here."

The judge said Kamdem's issues should be resolved in family court.

TMZ broke the story ... Gabriel is currently being investigated for child endangerment and battery -- after allegedly pushing Kamdem into a door while she held Nahla in her arms.

Kamdem filed a police report after the incident, claiming Gabriel had injured her. She has since quit the nanny position.

Halle Berry to Gabriel Aubry Stay Away From Nahla!!!

Halle Berry has just arrived at court, where she'll ask a judge for an order prohibiting her baby daddy, Gabriel Aubry, from having ANY contact with 3-year-old Nahla until the child endangerment investigation against him is resolved.

As TMZ first reported, the LAPD is conducting a criminal battery and child endangerment investigation after Gabriel allegedly pushed the nanny with Nahla in her arms. And before the alleged pushing, the nanny says Gabriel screamed at her and hurled a racial epithet. In addition, we've learned the L.A. County Dept. of Children and Family Services is also conducting a child endangerment investigation.

TMZ has learned more about what nanny Alliance Kamdem has told the cops. Law enforcement sources tell us ... Kamdem claims Gabriel repeatedly yelled and cursed at her, often while Nahla was present. Kamdem also says it got so bad ... Gabriel would make her sit in a corner in his condo until he called for her.

Kamdem also claims Gabriel often yelled at Nahla, causing the child to cower and cry. And she told police ... when Nahla had a rash he refused to treat it.

Kamdem quit last week after Gabriel allegedly shoved her.

Gabriel's rep tells TMZ, "Anyone can file a police report at any time, regardless of it being accurate."

As for Halle's court appearance later this AM ... we'll be there.

Halle Berry's Baby Daddy Investigated for CHILD ENDANGERMENT

Halle Berry's baby daddy Gabriel Aubry is being investigated for criminal child endangerment and battery -- over an incident involving his and Halle's child ... TMZ has learned.

According to the police report, obtained by TMZ, Gabriel allegedly pushed his nanny into a door while she held his daughter Nahla in her arms.

Law enforcement sources tell TMZ ... Gabriel was supposed to take 3-year-old Nahla to school Wednesday but decided to keep her home instead. The nanny -- who worked for both Gabriel and Halle -- went to the school to pick Nahla up and was told the child was a no-show.

According to the report, the nanny then went to Gabriel's home, where she found Nahla. The nanny picked Nahla up and began to question Gabriel as to why he didn't take the child to school.

According to the report, that's when Gabriel allegedly flew into a rage -- claiming, "You're the f**king nanny. Who do you think you are? You are a nobody. You don't need to f**king know anything." The 6-foot-4 Gabriel then allegedly pushed the 5-foot-2 nanny out the door, Nahla in her arms.

The nanny filed a police report, claiming she was injured. Law enforcement sources tell us ... police are investigating Gabriel for both misdemeanor child endangerment and misdemeanor battery.

The report lists the investigation as a battery, but law enforcement sources tell us they are "definitely investigating child endangerment."

In addition, we're told child protective services has launched a parallel child endangerment investigation.

Halle's going to court tomorrow, we believe, to secure legal protection for Nahla.

Halle's reps have no comment. So far, no word back from Gabriel's people.

Halle Berry's Ex Loses Big in Court

Another win for Halle Berry in her bitter custody battle against her ex -- a judge just shot down Gabriel Aubry's request to ditch his nanny-supervisor while he's with their daughter.

TMZ broke the story ... Gabriel was trying to amend his visitation rights -- which require a nanny to be present while he's with Nahla -- claiming he wanted more alone time with his daughter. Halle opposed the change.

We've learned the judge issued an order yesterday, siding with Halle, upholding the original agreement requiring supervised visitation on Gabriel's part.

Sources tell TMZ, Gabriel is pissed -- and he feels the nanny is ruining his relationship with his daughter.

Halle Berry's Ex Wants to 86 the Nanny When He has Nahla

Gabriel Aubry's lawyer went to court this morning, asking the custody judge to change the agreement Gabriel made with Halle Berry ... requiring a nanny to be present whenever he has custody of Nahla while the two are in Europe ... sources tell TMZ.

Here's what we know. Before Halle went to Europe to shoot her latest movie, she and Gabriel struck a deal on who gets Nahla and when, and under what circumstances. Sources tell us one of the conditions ... when Gabriel had the child, a nanny had to be present.

We're told Gabriel is now unhappy with the deal he struck, and wants the judge to remove the nanny clause.

Gabriel's lawyer, Gary Fishbein, argued his case this AM, while Halle's lawyer, Neal Hersh, countered.

We're told the judge took the matter under consideration. A decision is expected shortly.

Halle Berry Fighting Legal Battle ... In a BIKINI

At the same time Halle Berry was frolicking around Spain in a teeny, tiny AWESOME bikini ... she was sending her lawyers into battle back in L.A. today ... to once again fight her baby daddy Gabriel Aubry.

Sources connected to Halle tell TMZ ... Aubry, who is also in Europe, has been throwing a fit over custody issues involving their daughter Nahla while Halle shoots "Cloud Atlas" in Europe -- and we've learned, Halle's lawyers were in court today to put out the flames.

Halle's lawyers Neal Hersh and Judy Bogen were in court today to address Gabriel's bellyaching -- and while it's unclear exactly what happened during the proceedings, the two walked out with huge smiles on their faces.

Halle Berry Victorious in Custody Fight

Score one for Halle Berry in the latest custody battle with baby daddy Gabriel Aubry.

TMZ has learned Halle and her lawyers, Neal Hersh and Judy Bogen, prevailed in court today -- as both she and Gabriel stood by while their lawyers argued before the family law judge.

We're told the issue had to do with the custody agreement the couple signed. There's a provision in the agreement dealing with how much time each of them gets to spend with Nahla when Halle shoots a movie.

Halle is going to Europe soon to shoot a flick, and Gabriel and Halle were arguing over the "movie clause" -- specifically, how they're supposed to divide their time with Nahla.

We're told the judge bought Halle's interpretation of the "movie clause," meaning Gabriel won't get as much time with Nahla as he wanted.

Halle Berry, Gabriel Aubry Epic Custody War Continues

Halle Berry is squaring off right now with her baby daddy, Gabriel Aubry, as yet another battle has erupted over custody of 3-year-old Nahla.

We've learned Halle's lawyer, Neal Hersh, has filed legal papers asking the judge to hold Gabriel in contempt for allegedly violating the custody deal.

It has been all-out war between Halle and Gabriel for months, with no signs of a truce.

Halle Berry Claims Gabriel Violated Custody Agreement

Halle Berry went to family court this morning, complaining her baby daddy, Gabriel Aubry, violated the custody agreement they struck over Nahla, and to reinforce her point, her lawyer submitted a lengthy court document claiming Gabriel has put Nahla at risk.

Sources tell TMZ ... Halle is concerned for 3-year-old Nahla when she's in the care of Gabriel. Our sources would not be specific about the violations, but we're told it has to do with requirements Gabriel was supposed to follow when he had custody of Nahla.

The lengthy documents go into great detail about Gabriel's parenting skills, claiming there was once an incident overseas when Gabriel allegedly neglected Nahla, imperiling her safety.

Halle wanted the judge to find Gabriel in violation of the custody order. Gabriel was not in court today, and the judge set a hearing on the matter for later.
