Pepsi Yanks Commercial ... Apologizes to Kendall
Pepsi has officially folded and pulled its Kendall Jenner ad after an online revolt ... and issued a special apology to the "Keeping Up with the Kardashians" star.
The company was ducking for cover all morning, as people railed on the ad which made it look like Kendall Jenner could bring unity between cops and protests like the Black Lives Matter movement with a can of soda.
Pepsi released the following statement -- "Pepsi was trying to project a global message of unity, peace and understanding. Clearly, we missed the mark, and we apologize. We did not intend to make light of any serious issue."
The company goes on to say, "We are removing the content and halting any further rollout. We also apologize for putting Kendall Jenner in this position."
DeRay Mckesson, the face of the Black Lives Matter movement, said what's on the minds of many ... how could the brain trust at Pepsi have thought this was cool?
As for Kendall ... she's removed all references to the commercial on social media.

Kendall Jenner Rosario Dawson Goes After Pepsi Ad She Once Mocked
Kendall Jenner's Pepsi ad is about 15 years too late and it totally misses the point, according to Rosario Dawson, who once used cola to mock soda companies that exploited social injustice.
Rosario starred in the Chemical Brothers' video for their 1999 song, "Out of Control" ... in which she plays a revolutionary heroine who makes peace with rioting police by sharing a soda.
The video was intended to be a satire on the U.S. advertising culture, which tries to get its hands into everything and anything where it can make money.
Rosario has seen Kendall's version, and responded this way ... "Eerily reminiscent of Chemical Brothers "Out of Control" vid we shot in Mexico City ~ 15 yrs ago sadly minus the point."

DeRay McKesson Pepsi, Kendall Chose Profit Over Social Justice
DeRay Mckesson, the face of the Black Lives Matter movement, thinks the Kendall Jenner/Pepsi ad is a shocking example of exploitation for profit.
Mckesson, who has been arrested and tear gassed during various protests, is appalled the brain trust at Pepsi didn't have a clue the ad -- which conveys the message a can of Pepsi can resolve the conflict -- was so tone-deaf.
He clearly thinks this is capitalism at its worst.

"The Breakfast Club" host echoed a chorus of outrage over the ad, which suggests a can of soda can solve the problems between African-Americans and cops.
Charlamagne doesn't expect more from the Kardashian family, and also thinks now's the perfect time for Coca-Cola to seize the moment.
Waffle House Dine and Dash Man Falsely Accused Sues I Didn't Steal, I Left in Disgust!!
Waffle House sent the cops after a man for not paying for his meal, but video evidence cleared him and now HE wants payback ... according to a new suit.
William Edmonson Jr. claims he and his son went to a Pensacola Waffle House for some grub in October 2015, but when his burger order got messed up ... he saw one of the workers grab the patty with his bare hands, peel the cheese off and throw it back on the grill. He says he was so repulsed, he and his boy left before they got their meals.
Here's where it gets interesting. According to the docs ... Waffle House falsely reported to cops that the Edmonsons ate their food and left without paying, and William got arrested and charged with theft MONTHS later.
However, Edmonson says Waffle House later turned over surveillance footage of the incident that showed he and his son left without ever receiving their food ... so the DA immediately dropped the charges.
Edmonson's still PISSED, though, and wants a whole lot of cash from the restaurant to make it right.
We reached out to Waffle House ... so far, no word back.

Wonderful Pistachios Sued There's Nothing Wonderful About Diarrhea!!
Wonderful Pistachios allegedly put a man on a prolonged toilet visit ... a man who just filed a class action lawsuit claiming the nuts gave him Salmonella.
A Chicago area man is leading the charge against the The Wonderful Company, claiming he bought a bag of its pistachios in December 2015, and got abdominal pain and diarrhea shortly after eating them.
What's worse ... the man says after he recovered, he ate more Wonderful Pistachios and got sick again, because he had no clue the nuts were the culprit.
According to the docs ... the FDA determined in early 2016 the Wonderful Pistachios were indeed to blame for a Salmonella outbreak. The Chicago man believes the company failed to properly warn consumers of this risk and put people in danger.
He's suing on behalf of all folks who got sick from eating the pistachios. Sam's Club is also named in the suit, because he says that's where he bought his bag of nuts.
We reached out to Wonderful ... no comment.

Heart Attack Grill Cardiac Corner Is Our Turf! Beat It, Heart Attack Shack
The famed Heart Attack Grill in Vegas is blowing a valve over a Tennessee burger joint ... claiming it's blatantly ripping off its death-on-a-plate theme.
The Grill is suing the Heart Attack Shack in Chattanooga for copying its name, its "Flatliner Fries" and even its logo with EKG waves. In the docs, the Grill says the Shack is purposely confusing consumers to make them think the restaurants are related ... and they're not.
According to the suit, the Shack has refused to change a damn thing ... even after the Grill fired off a threatening letter in February.
Now the Heart Attack Grill wants a judge to step in, and give the Heart Attack Shack a cardiac arrest. It also wants a slice of its profits.

Event organizers later issued a statement saying they're disappointed -- but "we are equally grateful to the United Center Security team and the Chicago Police for restoring order."

Drake Nothing Personal, Amsterdam ... I Ate Bad Sushi!!
Drake had no choice but to cancel his Amsterdam concert because he had a prior engagement ... with a bathroom, due to extreme food poisoning.
Sources close to Drizzy tell us he ate some bad sushi on Monday, and it messed up his stomach. We're told it was so bad he had to get medical treatment immediately. It wasn't enough though ... he was still too sick to go onstage, which seriously pissed off the entire arena full of fans who'd already been waiting in their seats for 75 minutes when they got the bad news.
It was the third time in 3 months Drake had to postpone an Amsterdam gig ... which explains why fans threw crap onstage. He's promised to make up the show Wednesday.
We suggest a simple bowl of rice beforehand.

Harry Potter Yuengling Moves to Own Harry Potter's Butterbeer ...For Ice Cream!!!
Yuengling is using Harry Potter's famed butterbeer for its ice cream ... but it took a legal shortcut that could backfire in a huge way.
Yuengling's rolled out its new "butterbeer" flavor this week ... even though it never secured the legal right to market ice cream.
Yuengling's prez, David Yuengling, tells TMZ his company filed docs to trademark butterbeer ice cream 8 months ago, and he's hopeful he'll win approval.
Here's the problem ... J.K. Rowling created the fictional drink in her Harry Potter books, and Warner Bros. secured all the rights and produced the movies. So it's pretty clear ... Warner Bros. will be extremely territorial over one of it's most valuable franchises.
So far Yuengling's application for the right to use the name hasn't been decided ... but if it's rejected the company has a big problem on its hands, and Warner Bros. could go after it for all the loot its made selling the frozen delight.
We've reached out to Warner Bros. for comment ... so far, no word back.

Cat Deeley's Server Mistakes Were Made, But ... She Handled it Like Trump!!
The guy who waited on Cat Deeley at Tom George Restaurant on Sunday thinks she totally overreacted by publicly bashing the L.A. eatery ... and leaving him a $0 tip.
Joseph Vasko-Bezenek admits the restaurant flubbed the "So You Think You Can Dance" host's order, but claims he provided great service and the manager went above and beyond to comp her. He particularly takes issue with Cat angrily ranting on Twitter afterward to ruin the restaurant's reputation -- to him ... that's Trump-like.
What's worse -- as any server knows -- Joseph got a big fat zero for a tip ... so he didn't want to let Cat get off scot-free for that.
On the bright side ... he also told us he'd welcome the chance to serve her again. Olive branch?

It's pretty gnarly -- you can hear the guy screaming out "What did I do?!" before he's taken down. Even crazier ... he's got a dog right next to him that's in the mix of the scuffle.
Cops did not find a gun. The man was booked for resisting arrest.
