Diddy is getting creative behind bars to sway a potential jury in his favor -- and he's even used his recent birthday celebration to obstruct justice in his federal criminal case, prosecutors say.

According to new legal docs, obtained by TMZ ... federal prosecutors say Diddy -- who is currently behind bars -- recruited family members to plot and execute a media campaign around his 55th birthday earlier this month for the purpose of influencing a jury at trial.

--You may recall ... Diddy's 7 kids posted a gushing Instagram video tribute to the music mogul and they let baby Love take center stage in the singing of "Happy Birthday." The children also wrote in the caption, "Happy Birthday Pops, we love you! 🎂❤️."

Kate Upton is out to her millions of Instagram followers about a very troubling scenario ... and it's safe to say she has people worried.

The supermodel recently posted on her Instagram stories a cryptic and disturbing question ... addressing her query to "lawyers/judges/advocates/law enforcement/parents" before going into detail.

Her message continued ... "A Dad, recently out of rehab, is traveling alone with his 10-year-old daughter. He gets drunk and high on pills, says he has a gun on him and threatens to SHOOT the taxi driver if he does NOT drop them of on the highway at midnight to walk home."

She added that the taxi driver in the scenario refused ... and "would rather be shot than drop the little girl off on the highway" ... with the conclusion, "Is this an emergency? A Crime? Would you be scared for your child?"

Fans were baffled by the question ... and had no idea how to take what appeared to be a serious ask from "Sweet Dreams" star.

Three of Malcolm X's daughters filed the suit Friday on their own behalf and on behalf of his estate, claiming the CIA, FBI, DOJ and NYPD all participated in a wide-ranging conspiracy behind their father's shooting death.

In the docs, obtained by TMZ, the family claims these agencies also engaged in a decades-long coverup after Malcolm was gunned down on February 21, 1965 at the Audubon Ballroom in Manhattan.

Rita's husband posted the update on Facebook Friday morning, where he shared the radio personality passed away "peacefully and quietly" on Thursday.

TMZ has learned Jayden has seen Britney a couple of times recently since moving back to California from Hawaii, but as for a full-on reconciliation between them ... Kevin’s been left in the dark.

Kevin’s lawyer, Mark Vincent Kaplan, tells TMZ ... "If there has been a reconciliation it’s news to Kevin." Mark adds that Kevin speaks to Jayden frequently and hasn’t been told about any kind of reconciliation between the 18-year-old and his mom.
