'RHOA' Star Eva Marcille Don't Give Custody to My Baby Daddy ... He's a Violent, 'Ticking Time Bomb'

11:00 AM PT -- Kevin McCall Jr. just fired back at his ex, with his attorney, Adamma McKinnon, telling TMZ that his past shouldn't hinder his ability to be there for his daughter right now. She says, "Fatherhood or the right to be a Father is a highly esteemed privilege. Each and every human being has a shortcoming and has made a mistake a time or two; yet mistakes or shortcomings should never prohibit a father from serving as a father to his son or daughter."
McKinnon adds, "Such denial becomes a disservice to the innocent child as it serves a child's best interests to foster a bond with both parents. I look forward to working with counsel for Mrs. Sterling to ensure that Mr. McCall will be able to enjoy his privilege of fatherhood with their lovely daughter going forward and under the direction of the presiding Court."
She finishes by saying, "Mr. McCall's primary focus has always been and will continue to be the best interests of his daughter."
Eva Marcille is pleading with a judge to keep her baby daddy away from their daughter, because she fears he's capable of going on a killing spree like Chris Dorner.
The 'RHOA' star filed legal docs, obtained by TMZ, responding to Kevin McCall Jr.'s request to have the judge reevaluate their custody arrangement for 5-year-old Marley Rae -- but Eva says there's no need to because her ex is dangerous.
In the docs, Eva claims Kevin is unstable and has admitted to her he could do worse damage than Dorner -- the ex-cop who went on a killing rampage in 2013 that ended with a manhunt and fatal shootout in Southern California.
Eva also claims Kevin praised a man that killed her good friend and himself in a murder-suicide. She alleges he referred to the guy as his "hero." Eva even included a screenshot from one of Kevin's IG posts where he seemed to make ominous threats against her ... and called himself a "ticking time bomb."
Adding insult to injury, Eva says Kevin's been wrapped up in more legal woes -- including a recent domestic violence charge -- which she believes should disqualify him from spending time with their daughter.
According to the docs, Eva claims Kevin's not only been an absentee father for most of Marley's life, but he also hasn't paid a dime of child support.
She says nothing needs to change in terms of custody, and she wants a judge to toss Kevin's request entirely.
We reached out to Kevin ... so far, no word back.

R. Kelly's been ordered to use the money from his extensive music catalog to pay his ex-wife child support.
According to legal docs, obtained by TMZ, a judge just ordered the R&B singer to use his royalties from entities such as BMI and Sony to pay Drea Kelly the $20,833 he owes her each month.
You'll recall ... Drea's been coming after Kelly for back child support, and at one point he was so far behind on payments he ended up in jail. He eventually squared things up for that tab, but he's gotta keep up with the monthly payments.
According to the docs, Kelly's asking the court to cut him a little slack, but for now the judge says the dough must be drawn from those hefty royalties.
As we've reported, Kelly's had plenty of financial issues ... scrambling to come up with cash for bail, child support and even a retainer for famed defense lawyer Tom Mesereau ... which never happened.
Kelly is currently in jail awaiting trial on numerous federal and state charges.

Kevin Hart appears to be sparing the driver of a nasty car wreck that nearly killed him -- because we've learned he isn't planning to take the guy to court.
Sources close to the comedian tell TMZ ... Kevin does not intend to sue driver Jared Black, whom the CHP determined caused the crash by driving recklessly. In fact, we're told Kevin's not even going to file a claim with Jared's insurance company to cover his medical bills and the cost of the 1970 Plymouth Baraccuda, which was totaled in the single-car crash.
Our sources say Kevin likes Jared and Jared's fiancee is close to Kevin's wife, Eniko. The fiancee, Rebecca, is Eniko's personal trainer.
We're told Kevin will use his personal health insurance to cover medical costs. It's not like he needs the money. It's unclear whether he's just going to write off the value of the car.
The medical bills are going to be huge. Kevin had surgery for 3 fractures on his back and is undergoing intensive therapy. All of that put the medical bills in the stratosphere.
Here's the kicker... we're told that Jared himself has lawyered up, and could file suit against Kevin for not having the proper safety harnesses in the car. If he does sue, there's a problem, because no one in the car was even wearing their safety belt. So, even if there were harnesses, it wouldn't have done anyone any good if no one strapped in.
The wild card ... there's a long way to go before the statute of limitations runs, so Kevin has plenty of time to change his mind ... if he's so inclined.

AMC's "The Walking Dead" is waging legal war with the creators of a comic book series ... and just like the zombies at the heart of both stories, the dispute refuses to die.
According to legal docs obtained by TMZ ... "The Toking Dead" filed a trademark application back in August 2017, but AMC fired back with a cease and desist, claiming copyright infringement ... and the legal standoff is still going down.
For those unfamiliar ... 'Toking Dead' is a comic strip about 2 friends who open a marijuana dispensary, and when disaster strikes and people mutate into zombies, the guys discover their weed holds the key to saving humanity.
It's kinda easy to see why the honchos at AMC don't want their super-popular show mixed up with potheads. Yeah, some people still don't like Mary Jane.
Anyways, 'Toking Dead' responded to the 'Walking Dead' legal threat by pushing forward with its trademark application and eventually publishing the comic in June 2018 in the NY Gazette.
AMC got pissed and quickly filed an opposition to the 'Talking Dead' trademark ... and now the whole thing is once again in legal limbo.
Sure, reputations, brands and money are on the line ... but maybe everyone needs to just chill out and smoke some herb.

Jeremy Renner's ex-wife seems to be trying to show why she should get sole custody of their daughter as the court battle wages on ... opting for a day in the hay as exhibit A.
Sonni Pacheco was seen Saturday with her and Jeremy's 6-year-old daughter, Ava, at a pumpkin patch in L.A., where it was just mom and the kid enjoying themselves. In photos and video we got of their outing, you can see Ava having a great time.
She goes up and down an inflatable slide a few times while Sonni looks on, and certainly seemed down with the festive scenery all around her as she held hands with her ma.
It even looks like there might've been some other parents there with their own kids tagging along, as Sonni was seen mingling with a woman and a guy in a black shirt. Safe to say, it was a cozy looking scene -- the opposite of what's been going on behind closed doors.
As we've reported ... Jeremy and Sonni are locked in a bitter custody battle right now, with allegations being hurled against each other left and right. Sonni has said that Jeremy is a substance-abusing loose canon who threatened to kill her as well as himself.
He denied that, and claimed she was the one with substance abuse issues ... not to mention being sex obsessed and introducing that type of content to their kid. He's also called her mentally unstable and a liar, who's only attempting to smear him for revenge.
Both parents are out for sole custody, and with this ... it looks like Sonni's the first to strike with a good photo-op. Time will tell if it helps her cause.

Safaree Robber Who Stole Cash and Jewelry Pleads Guilty

One of the guys who allegedly robbed Safaree at gunpoint last year won't roll the dice on a trial -- he's pled guilty to a felony and is cutting a pretty good deal ... considering he was staring down a potential 20 years behind bars.
Carl Harry is the only one of the 3 alleged robbers to cop a deal. He's pled guilty to 1 count of conspiracy to commit theft, and prosecutors have agreed to recommend a sentence of 364 days in the Bergen County Jail, with 5 years probation after that.
Harry's other 6 charges will be dismissed. So, pretty good tradeoff.
The other 2 men charged, Shawn Harewood -- who Safaree knew fairly well -- and Tacuma Ashman, are slated for trial in December. Their 7-count indictments still stand.
As we reported, Safaree was held at gunpoint and robbed of more than $180k in cash and jewelry. Authorities say the men had been tracking Safaree for a while and cornered him in a parking garage where it all went down ... to their dismay, right in front of security cameras.
Harry will be sentenced in January.

Jeremy Renner's ex has filed more documents in their bitter custody battle ... this time claiming some upcoming depositions should go down under extremely secure conditions, because she feels threatened by the actor.
Sonni Pacheco claims in the legal docs, obtained by TMZ, Jeremy put a gun in his mouth, threatened to kill himself and fired the gun into the ceiling while their 6-year-old daughter, Ava, was asleep in a nearby bedroom. Pacheco also claims he wanted to kill her and himself because Ava would be better off with no mother than having to deal with Sonni.
Renner has denied Pacheco's allegations and says he made no such comments. But, she's now asking the judge in the custody war to set aside a room at the courthouse where her depo and the depo of their nanny can be taken in order to feel safe there. She notes you can't bring a gun into a courthouse.
The nanny filed a declaration in Sonni's petition, saying Jeremy told her he fired a gun into the ceiling of their house "because of you [the nanny]. You're the reason I pulled the trigger. Do you think if my blood and brains are all over my bedroom floor, do you think you would be living this lifestyle in this mansion." It's weird because there's no mention as to why Renner has beef with the nanny.

Lori Loughlin's Husband Allegedly Emailed ... 'I Had to Work the System'
Lori Loughlin's husband practically admitted to paying big bucks to get their daughter into USC ... according to prosecutors.
In the indictment that brought a new charge upon Lori and Mossimo Giannulli, he's accused of emailing their accountant admitting to working the system to get their daughter admitted.
According to the docs ... Mossimo forwarded a $200,000 invoice he got from Rick Singer to his accountant for payment in April 2017 and wrote, "Good news my daughter...is in [U]SC... bad is I had to work the system."
Prosecutors claim on or about the same day, the daughter received a formal acceptance letter from USC and Mossimo wired the money.
As we reported ... the U.S. Attorney out of Boston filed a new charge of Federal Program Bribery against the couple Tuesday. The 2 allegedly paid $500,000 to the mastermind, Singer, to get their daughters into USC ... and this $200k is allegedly part of that total.
The new charge carries a maximum 5-year prison sentence. They've already charged Lori and Mossimo with various other crimes that could land them in prison for 40 years.
Of course ... they could also possibly cop a plea deal.

Hooters needs to spread its wings and take care of visually impaired folks looking to purchase gift cards ... so says a legally blind man suing the popular restaurant chain.
Marcos Calcano is suing Hooters on behalf of himself and others with vision disabilities because its gift cards do not contain Braille, and he says he's clamoring to buy one ... according to a new suit.
Calcano says adding Braille to the cards is an easy fix that would make it much simpler for people like him to access the $400 billion gift card market ... and it "would restore the dignity to blind persons."
According to the legal docs ... Hooters informed him it does not sell gift cards containing Braille, and he believes the chain has no intention of doing so.
Hooters isn't alone, either -- Calcano claims to his knowledge, the only store that sells Braille gift cards is Starbucks ... even major retail chains like Walgreens, CVS and Target don't offer them.
At the same time he sued Hooters, he also filed against Domino's pizza.
He says he "intends to immediately purchase at least one store gift card" from Hooters as soon as the Braille is added.
Sounds like the guy's got a hankering for a 10-piece pronto ... or he's Christmas shopping early.
Calcano filed the class action suit seeking unspecified damages and wants the court to order Hooters to Braille up.

Antonio Brown is making his return!!!
... to another courthouse -- 'cause the NFL star has just agreed to retake his deposition in his condo-trashing lawsuit on Dec. 12, after the first one ended in complete disaster.
Remember, AB -- who's been teamless since his release from the Patriots last month -- is being sued for allegedly trashing his fancy Miami-area condo last year.
But, during his first deposition in the case last month ... the attorneys for the place -- The Mansions at Acqualina -- say he was a complete monster during the proceedings.
In court docs, they allege Brown showed up late ... "chanted over and over" during questioning -- and was overall "defiant" and "profane."
They also allege AB inexplicably left the depo early ... saying out of nowhere he gave them a 5-minute countdown and walked out of the office building long before the meeting was scheduled to end.
Opposing counsel demanded the judge order AB to sit for a second depo -- but before the matter went before the court, Brown's team agreed to the request.
They even set a date and location ... Dec. 12 (during the NFL's Week 12) at the Dade County Courthouse.
In fact, Brown's hearing is slated for just hours before the Jets kick off against the Ravens on "Thursday Night Football."
As for if Brown will be on a team by then, don't bet on it. The NFL is still investigating rape allegations against the receiver -- and Brown even seemed to say himself on Twitter on Thursday it's looking more like a 2020 return for him.

Lizzo's going to war -- a legal war -- with three songwriters who've been making a lot of noise, claiming they wrote parts of her #1 hit ... but Lizzo says that's BS.
Lizzo filed legal docs Wednesday in federal court asking a judge to declare the 3 men have no copyright on "Truth Hurts," and no right to share in the song's immense profits.
You've probably seen this bubbling up on social media. One of the songwriters -- Justin Raisen -- has claimed he cowrote a song called "Healthy" with Lizzo last year. He claims Lizzo lifted the signature lyric, "I just took a DNA test turns out I'm 100% that bitch" from "Healthy."
According to the docs, obtained by TMZ, Lizzo says that line is actually from a 2017 tweet that became a popular meme -- and that's why she decided to sing it on the 'Truth' demo. On social media, Lizzo said producer Ricky Reed was the only other person in the room when she wrote 'Truth.'
She says Justin and his brother, Jeremiah, and their reps have on at least 2 occasions acknowledged in writing they have no claim to 'Truth.'
Lizzo suspects they are trying to set up an "opportunistic" lawsuit to cash in on her hit ... which has been #1 for 7 weeks.
To be clear, she's not suing anyone ... Lizzo just wants the judge to declare all 3 songwriters -- Justin, Jeremiah and Yves Rothman -- have no right to her "Truth Hurts" profits.

Rose McGowan Sues Harvey Weinstein ... You Tried Smearing Me!!!

12:09 PM PT -- Harvey's lawyer, Phyllis Kupferstein, got back to us ... "Once and for all, Rose McGowan will be shown to be what she is; a publicity seeker looking for money. From the moment she sought a multi-million dollar payout in return for not making these baseless allegations, which we rejected, we knew that she was waiting for an opportune time to begin this." She continued on ... "We will demonstrate that this case has no legal merit."
Rose McGowan is going after Harvey Weinstein and his former attornies ... claiming they conspired to smear her and discredit her rape allegations against the disgraced studio mogul.
According to legal docs obtained by TMZ ... McGowan claims "this case is about a diabolical and illegal effort by one of America's most powerful men and his representatives to silence sexual-assault victims."
McGowan -- who is also suing Weinstein's ex-lawyers, Lisa Bloom and David Boies -- claims back in 2016 she was going to write a memoir and motivational book called "Brave" that would include details about Weinstein allegedly raping her in 1997 at the Sundance Film Festival.
She then claims that when Weinstein learned about these plans, "he tapped into his team of fixers" with the goal of ensuring McGowan's story never saw the light of day ... "and -- if it did -- that no one would believe her."
McGowan then alleges Weinstein's lawyers -- in conjunction with the international spy agency, Black Cube -- worked together and "tried to steal McGowan's unpublished book" and attempted to buy her silence. She claims that Weinstein's plans were that if they couldn't stop her, they'd do everything in their power to ruin her reputation.
What's more ... she brought up what we had previously reported -- McGowan insisted Weinstein may have had a hand in having coke planted in her wallet back in 2017.
She claims, in docs, her lawyer, Jose Baez, advised her to drop that defense and instead plead no contest, which she did. McGowan says it's odd that 9 days after she pled no contest, Baez then signed up as Weinstein's criminal defense attorneys.
The actress, of course, is one of the first women to accuse Weinstein of sexually assaulting her. She helped spearhead the #MeToo Movement, which prompted scores of women to come forward.
McGown is suing for damages. A rep for Lisa Bloom tells us, "It is inexcusable that Ms. McGowan chose to include my client in her lawsuit. Facts matter. There is simply no credible factual or legal basis for her claims against my client. We look forward to our day in court to set the record straight."
We've reached out to Boies, so far, no word back.

Nelly UK Sexual Assault Case Settled

Nelly is putting a sexual assault case behind him by reaching an agreement with his accuser to settle the matter out of court.
A woman in England had filed a lawsuit, about a year ago, against Nelly for allegedly sexually assaulting her after a 2017 concert in Essex. The accuser, who filed as Jane Doe, had claimed the rapper forced her to perform oral sex during a meet-and-greet.
According to docs filed Tuesday in federal court, and obtained by TMZ, the accuser has informed the judge that she and Nelly recently settled their dispute.
Neither side is saying whether money changed hands ... terms of the agreement are confidential.
Nelly's girlfriend, Shantel Jackson, is also in the clear now. The accuser had included her in the lawsuit, claiming Shantel lied when she dismissed the accuser as a liar.
As TMZ first reported, Nelly had similarly reached a settlement last year with another woman who claimed he sexually assaulted her on his tour bus.
