Ben Affleck, Jennifer Garner Divorce Settlement Complete ... Divorce Final after Ben's Rehab

Ben Affleck and Jennifer Garner have settled their divorce case and the final settlement will be filed with the court after Ben gets out of rehab ... TMZ has learned.

Sources connected with the couple tell TMZ, Ben and Jen have reached a property settlement, which was complicated and time-consuming because of the fortune that needed to be divided. We've learned the couple did NOT have a prenup, so all of their earnings during their 12-year marriage went into one pot.

As for custody ... we've learned they agreed to joint custody of their 3 children. What's a little unusual ... the settlement does not say how much custodial time Ben and Jen each get. We're told they have gotten along great co-parenting the kids, and feel it's better to shift custody back and forth depending on work schedules rather than abide by a rigid formula.

The wild card in all of this ... Ben's drinking. Our sources say Ben has fallen off the wagon for the last 18 months ... sometimes regaining sobriety only to slip again. It's obviously an issue because when Ben isn't sober it could put the children at risk when he's with them. It's something Ben and Jen have been dealing with for months.

The settlement is complete, but it hasn't been signed because of sobriety issues. However, we're told when Ben is out of rehab and back on his feet it will be signed, sealed and delivered to the judge, and then the divorce will become final.

As for reconciliation ... we're told absolutely not, and it's been that way for a long, long time.

Ex-NFL QB Erik Kramer I Want My Marriage Annulled ... My Brain's Messed Up

Former NFL QB Erik Kramer wants to erase his marriage from the books ... claiming his 2015 failed suicide attempt left him with a lack of mental capacity to legally consent to marriage.

According to new legal docs ... Kramer says his wife, Courtney Baird, stole $50k of his money before they wed, and she's now filed for divorce.

He says before they got married, Baird "exerted undue influence upon me to convince me, given my weakened mental state, that her actions were not wrongful."

Now, Kramer claims his 2017 marriage -- which lasted less than a year and a half -- never should have happened in the first place ... because he suffered a traumatic brain injury when he shot himself in 2015.

Kramer was reportedly suffering from depression, which some believed was triggered by head injuries during his playing days, when he attempted to kill himself.

Kramer maintained he was not diagnosed with any concussions during his NFL career, and did not link his suicide attempt to CTE. Nevertheless, he says he has still not recovered from the brain injury from the suicide attempt so when he said "I do," it was without the necessary mental capacity to seal the deal.

Baird want the divorce judge to divvy up their earnings and also wants him to pay spousal support. She'd get neither if the marriage is annulled.

We broke the story ... Kramer's wife filed for divorce in June on the heels of his arrest for domestic assault. She also got a domestic violence restraining order.

Kramer started 46 games for the Bears from 1994-1998, and also played for the Falcons, Lions and Chargers during his 10-year NFL career.

Nicollette Sheridan Divorce Final ... Denise Richards, He's All Yours!!!

Nicollette Sheridan's officially done being a housewife ... her divorce is now final, so it clears the way for her ex's relationship with Denise Richards.

According to new legal docs obtained by TMZ ... the 'Desperate Housewife' and actor Aaron Phypers are going on their merry ways after a judge signed off on their divorce settlement. It wasn't a messy divorce ... she gets to keep the Hidden Hills crib and a horse named Leo.

Nicollette also won't have to pay any spousal support, and same goes for Aaron. He gets to keep his personal belongings and any bank accounts and cars under his name. While the divorce just became final, Aaron moved on from his 6-month marriage a long time ago.

Aaron and Denise Richards started dating back in September 2017. No word if he'll make an appearance on 'Real Housewives of Beverly Hills' but chances seem pretty good. As for Denise's ex, Charlie Sheen, Kyle Richards hints it could happen.

TMZ broke the story ... Nicollette filed for divorce in July 2016, much to our surprise.

A former 'Steve Harvey Show' actress abandoned her estranged husband after he suffered a stroke, and left him completely broke and on his ass ... according to the gent himself.

Wendy Raquel Robinson's estranged hubby, Marco Perkins, claims in divorce docs -- obtained by TMZ -- he needs Wendy to pay him significant spousal support when their divorce is all said and done 'cause she allegedly left him destitute after he had a stroke back in 2015.

Marco says he enjoyed a lavish lifestyle while married to Wendy, and is asking a judge to make her cough up at least $10,000 a month so he can maintain that life -- adding that she can afford it, since he believes her monthly income is in the ballpark of $200k/month.

We broke the story ... Marco filed for divorce last week after 15 years together with Wendy. They have no minor children.

Billy Bush I'll Pay Spousal Support ... But, I Want Joint Custody!!

Billy Bush is willing to fork over spousal support, but he wants his estranged wife to budge when it comes to custody of their 2 minor kids.

In new legal docs obtained by TMZ ... Billy says he wants joint physical and legal custody of their 13 and 17-year-old daughters. Billy's estranged wife, Sydney Davis, had wanted joint legal and primary physical custody, so it seems a battle may be brewing on that front.

As far as spousal support, Sydney requested it and Billy didn't fight it.

TMZ broke the story ... Sydney filed legal docs to end the marriage last month, citing irreconcilable differences.

They separated last September ... about a year after the infamous "Access Hollywood" bus audio was released. You know by now he was fired from his job at "Today" shortly after the audio became public. He scored millions in a settlement.

Lisa Marie Presley Scores Huge Win vs. Estranged Hubby ... No Spousal Support for You!!!

Lisa Marie Presley won't have to pay her estranged hubby spousal support ... 'cause the postnuptial agreement they signed in 2007 says she doesn't have to pony up a penny and it's ironclad.

According to new legal docs obtained by TMZ ... the judge said the agreement Michael Lockwood signed in 2007 -- after they married in 2006 -- is legit. Michael gave up his right to spousal support, something they've been at war over for the last week.

Even though Michael testified he had NOT read the postnup when he signed it, the court ruled signing it on the advice of his attorney holds up because it means he understood what he was signing based on what his lawyer was telling him.

This is just the latest in Lisa and Michael's divorce war. She was ordered back in February to pay him $100k in legal fees.

Tyrese's Ex His Money Probs are His Fault, Not Mine ... Don't Mess with The Rock

Tyrese has nobody to blame but himself for his struggles in the movie biz, because he picked a fight with The Rock and lost ... according to his ex-wife.

'Steve Harvey Show' Star Wendy Raquel Robinson Heading for Divorce

Wendy Raquel Robinson -- best known for playing Regina "Piggy" Grier on "The Steve Harvey Show" -- is getting divorced after 15 years ... TMZ has learned.

Her husband, Marco Perkins, filed paperwork in L.A. Friday for dissolution of marriage. The couple wed in 2003 and has no minor children together.

Wendy gushed about her hubby in a 2012 article in Essence, saying marriage is wonderful ... and, "I can honestly say he’s my best friend.”

Other than her role as the school principal on Harvey's sitcom, Wendy's also well known for her role as Tasha Mack on the show "The Game."

Jack and Lisa Osbourne Settle Divorce

Jack and Lisa Osbourne made quick work of their divorce because TMZ has learned the case has already settled.

Sources with direct knowledge tell us ... under the terms of the settlement, Jack has given Lisa a "sizable cash payout." He's also paying "significant child support" and is covering private schools, medical costs and pretty much every other expense.

The couple will also share joint custody of their 3 children.

As we reported, Lisa filed for divorce back in May and Jack just filed legal docs responding to her divorce petition. In his docs, Jack asked the judge to deny Lisa spousal support, but turns out that was just a formality because the settlement gives Lisa cash upfront in lieu of spousal support.

The divorce will be official 6 months after the May divorce petition was filed, but since Jack and Lisa have settled ... it's now just a matter of time.

Jay Mohr, Nikki Cox Divorce Finally Final ... After 2 Tries and 2 Years

After multiple divorce filings, a failed reconciliation and claims of drug abuse ... Jay Mohr and Nikki Cox are officially done being husband and wife.

According to new legal docs ... their divorce became final Tuesday, but the terms of their settlement will remain under wraps. This means we don't know the custody situation of their 7-year-old son ... same for child or spousal support.

We broke the story ... Jay filed for divorce from Nikki in July 2016, claiming she had a serious drug problem and seeking full custody of their kid. However, he told us the 2 were "Very in love. Very happy and that's really all there is" ... and called it off 6 days later.

It didn't last, though -- Mohr filed for divorce from Cox for the second time in December 2016, and once again claimed Nikki had a drug problem that made her an unfit mother ... so he wanted sole physical custody of their son.

But, like we said ... it's unclear if he got his wish.

Angelina and Brad Sources: She's Making it Difficult For Him to Have Relationship with Kids

Angelina Jolie is not blocking Brad Pitt from seeing their kids, but sources involved in the case say she continues to drive a wedge between them and Brad.

Sources with knowledge of the case claim Angelina continues to exert influence over the former couple's 6 kids ... and it's been effective. We're told Brad is having trouble connecting with his children ... some of whom don't even want to see him.

We're told the 3 boys are the ones who have been influenced the most. The girls are more open toward Brad.

The divorce judge issued a report criticizing Angelina for not allowing the children to properly interact with their dad. The judge laid down a cell phone policy in which Brad can call and text the kids at will, and Angelina can't monitor the conversations.

As we reported, the kids are now all in L.A., per the judge's order, where Brad has significant custodial time with them. Our sources say Angelina has not blocked Brad's ability to see the kids, but they say Angelina continues to drive a wedge between Brad and the kids and it's had a significant impact on his ability to restore his relationship with them.

We reached out to Angelina's rep ... so far, no word back.

Jack Osbourne I'm Not Paying My Wife Alimony

8/16 -- TMZ has learned the divorce has already settled, and the reason Jack's lawyer checked the box denying Lisa spousal support is that they agreed she'd get an upfront cash payout in lieu of spousal support.

Jack Osbourne has filed his response to his wife's divorce petition, and it seems there's a conflict ... at the very least, over spousal support.

Jack is asking the judge to deny Lisa any such support. He's down with her request to give them joint custody of the 3 kids.

He wants Lisa to foot the bill for her lawyers, but she's asking that Jack pay.

As we reported ... Lisa filed for divorce back in May after 5 and a half years of marriage.

Jack and Lisa got married in October 2012 with a small ceremony of less than 50 guests in Hawaii. They tied the knot after just 4 months of dating.

We broke the story ... Jack showed up to Lisa's house late last month and allegedly punched her boyfriend in the head. No one wanted to press charges.

Angelina Jolie I'm in the Market for Kids

Angelina Jolie has returned to the U.S. with her kids, and the reason is simple ... she was ordered to do so by the judge in her divorce case.

Angelina was shopping Sunday in WeHo with 3 of her kids at Whole Foods.

According to court docs, obtained by TMZ, Angelina was ordered to return with the kids Saturday. According to the judge's order, Brad Pitt has a right to custody of the kids for no less than 4 hours every other day on school days and 12 hours every other day on non-school days.

Brad and Angelina are due back in an L.A. court this week to hammer out more custody issues. The judge is waiting for a custody evaluation by at least one psychiatrist. In the meantime, the judge indicated he will deal with temporary custody issues while he waits for the report.

Angelina Jolie Money Suddenly Tight ... In Brad Pitt Divorce

Angelina Jolie is sounding the alarm ... all is not well in the money department.

TMZ broke the story, Brad Pitt loaned his estranged wife $8 million to buy a house ... a little weird for an actress who has raked in millions for years.

Sources familiar with the situation tell us, Brad's income and net worth far, far exceed Angelina's ... it's not even close.

Fact is ... Angelina has not made money an issue in her divorce until several weeks ago, when she asked a judge for a formal child support agreement. As we reported, Brad has paid Angelina $1.3 million in support over the last 2 years and she didn't complain until late last month.

Our sources say Brad and Angelina don't have a prenup, which means anything they earned while they were married is a 50/50 split. That benefits Angelina, but the problem is ... they married in 2014.

Brad made more than her throughout their relationship, which began in 2004. The only way Angelina could get a cut of Brad's income from 2004 - 2014 is if she could prove they had an agreement that he would support her.

We're told she's talking about filing such a claim. But sources connected to Brad say that's laughable, because they were both extremely rich and such a promise wasn't necessary and never made.

What's super interesting ... Angelina and Brad delayed tying the knot until gay marriage became legal in California. Brad made that statement in 2006, and it took 8 more years for them to finally walk down the aisle. Had they married in 2006 she'd be entitled to millions more in community property.

Brad Pitt Struggles to Maintain Relationship with Kids

Brad Pitt and Angelina Jolie are at war in their divorce case, but the more immediate struggle is the co-parenting situation that even has a judge issuing a warning to cool it ... or else.

We're told Brad has been spending the bulk of his Summer in England -- where Angelina and the kids live -- so he can see his 6 children. The judge in the divorce case set out a schedule for Brad to visit with his children in London beginning in mid-June for 10 hours a day. The visitation increased last month to 4 consecutive days at a time.

Our sources say Brad and Angelina never interact with each other, and the handoffs are always through nannies and assistants.

It's clear there have been issues over Brad interacting with the kids. The judge in the divorce case already issued an order saying Angelina tried to restrict Brad's access that the judge believed was "harmful" to the children. The judge even said Brad had a right to call and text the kids whenever he wanted, and Angelina could not monitor the contacts.

TMZ broke the stories about Angelina claiming Brad has only provided minimal child support, and Brad fired back in legal docs that he's paid her $1.3 mil in child support since they split nearly 2 years ago ... and he loaned her $8 million to buy a house.

From what we're told, things are getting worse, not better, between the two.

Ex-NFL QB Erik Kramer Charged With Battery In Domestic Violence Case

Ex-Chicago Bears quarterback Erik Kramer has been charged with misdemeanor battery stemming from his alleged domestic violence incident back in June ... TMZ Sports has learned.

As we previously reported ... the former NFL player was arrested after he admitted to police he got physical with his wife, Cortney Baird, during a fight at their Agoura Hills home.

Baird claims Kramer flipped out after she confronted him about an argument the two previously had ... saying the ex-QB got violent and threw various household items at her.

Kramer was booked on suspicion of felony corporal injury to a spouse and released on $50k bond.

Now ... we're told cops are hitting Kramer with one count of misdemeanor battery for the incident -- and the ex-QB is facing up to six months in jail if convicted.

Erik -- whose wife filed for divorce shortly after the incident -- is due in court later this month to face the charge.
