Scary moment at home for Brooks Nader ... the Sports Illustrated cover model claims someone tried to gain entry into her home ... and now police are involved.

Law enforcement sources tell TMZ ... Brooks called police to her Bel Air rental home last week after she claims she experienced a possible trespassing attempt.

Our sources tell us Brooks told police two men and a woman showed up at the gate to her property and were denied entry, but one of them made it past the gate and onto her property.

Artem Chigvintsev says he's more than just a 'DWTS' alum, he's also a DIY guy at heart ... pushing back on some nasty things his estranged wife says about him.

Here's the deal ... in a restraining order Nikki Garcia (Bella) filed against Artem last month, she claimed he got cut from the upcoming "Dancing with the Stars" season a week before his domestic violence arrest and started working a construction job she says he felt "was beneath him."

But Artem's firing back in new legal docs ... saying Nikki is lying about his opinion on construction work.

Artem Chigvintsev has walked away with his best-case scenario following a 2-hour hearing in his Nikki Garcia (AKA Bella) divorce case ... TMZ has learned.

According to docs obtained by TMZ ... the professional dancer and the retired WWE star had a hearing in the Napa County, California court Tuesday, where a judge ordered the exes to share custody of their son, 4-year-old Matteo.

This was certainly the outcome the "Dancing with the Stars" alum was hoping for ... as he previously requested joint custody when he filed his divorce response in September.

Brooks Nader and Gleb Savchenko are going to have a hard time denying they're dating after this ... 'cause they went to a tattoo parlor together, and couldn't stop making out while getting new ink.

The "Dancing with the Stars" partners hit up Nautilus Tattoo in Hollywood Monday night and packed on the PDA ... sucking face in front of their tattoo artists, a couple friends and photogs.

Nikki was spotted Friday in Napa, CA for the first time since a judge gave her court-ordered protection from "Dancing With the Stars" pro Artem Chigvintsev.

She was smiling as she carried their son, Matteo, in her arms ... and they had matching all-black outfits.

Artem Chigvintsev is firing back at Nikki Garcia (Bella) in their ugly divorce, claiming she completely made up domestic violence allegations that landed him behind bars -- allegations she detailed in a restraining order she obtained Monday.

In new legal documents, obtained by TMZ, Artem painted the retired WWE star as the aggressor with anger issues that led to his arrest in late August, ultimately destroying their 2-year marriage.

Artem also filed photos with the court, showing injuries to his hand, elbow and the back of his head ... claiming Nikki was responsible for it all.

Nikki Garcia (AKA Bella) filed a restraining order against estranged husband Artem Chigvintsev Monday, and a judge signed off, after Nikki submitted a sworn declaration to the court saying in detail how Artem allegedly brutalized her.

In her petition, Nikki says Artem "tackled me multiple times and pinned me to the ground while our child was present."

She says since Artem was cut from "Dancing with the Stars," he grew "increasingly angry, snapping at me, and yelling." She said they had discussions about his need to control his anger, adding on the morning of the incident, Artem went off on Nikki over how their 4-year-old son's English muffin should be toasted, screaming that she made their son a "picky eater."

Before this blue-eyed blondie sittin' on her mama's lap turned into a dancing queen, she was just growing up with her four siblings in Orem, Utah and started moving 'n grooving when she was just 9 years old.

Considering she comes from a long line of family dancers ... no shocker she's taken home the Mirror Ball trophy twice on "Dancing With The Stars" before sitting at the judges table next to Carrie Ann Inaba.

Anna Delvey's clarifying her parting comment on "Dancing with the Stars" ... saying she told the audience she didn't learn a dang thing from her experience 'cause the judges' advice didn't help her stay on the show.

The footage was clearly taken from Tuesday night's episode of the competition series ... Brooks and Gleb are wearing the same outfits they donned for their quickstep routine for Oscars Night.

Anna Delvey and Tori Spelling are the first 2 stars to fall out of the "Dancing with the Stars" sky ... heading home in a double elimination -- and, their reactions couldn't be more different.

The socialite and the actress were eliminated Tuesday night after landing in the bottom 3 with "Family Matters" star Reginald VelJohnson ... and, ultimately, hosts Alfonso Ribeiro and Julianne Hough didn't call their names.

Anna and Tori couldn't have had more different reactions to getting the hook BTW ... just watch the clip -- Tori talks about how grateful she is to have participated in the show and encourages her kids to keep following their dreams.

3:55 PM PT -- Artem's attorney Dmitry Gorin of Eisner Gorin LLP tells TMZ ... "Mr. Chigvintsev has maintained his innocence from the beginning. He is grateful that the district attorney accurately assessed what took place, and determined he should not be charged."

He continues, "He enjoys tremendous support from the community, and requests privacy for the pending divorce matter. He loves his son, wants the best possible for him, and looks forward to the next chapter in his life professionally and as a father."

Artem Chigvintsev will NOT be prosecuted after his arrest on suspicion of felony domestic violence.

Napa County District Attorney Allison Haley announced Tuesday her office declined to file criminal charges against the "Dancing With The Stars" pro in connection with last month's arrest.

Prosecutors say they decided not to pursue criminal charges after reviewing the investigation and evaluating all the evidence.
