Brian Laundrie Federal Arrest Warrant Issued In Gabby Petito Case

3:58 PM PT -- The feds are tipping their hand ... the warrant for Laundrie's arrest is about way more than illegal credit card use. TMZ obtained a motion filed by prosecutors requesting Brian be held without bail before his trial, because he's a danger to the community.
Allegedly swiping someone's credit card hardly seems like a public safety issue, so the motion strongly suggests the feds suspect he's involved in something way more nefarious. The docs also state what's obvious at this point -- that Laundrie is a serious flight risk.
Brian Laundrie is now a wanted man by the feds ... an arrest warrant has been issued -- but NOT for Gabby Petito's death.
A Federal Grand Jury indicted Laundrie for the crime of Use of Unauthorized Access Devices. Specifically, prosecutors claim Laundrie used a Capital One Bank debit card. The document does not say it's Gabby's card, but that doesn't seem like much of a leap.
The indictment gives a timeline for the alleged unauthorized use of the card ... it was used from August 30 to Sept. 1 to purchase items totaling at least $1,000.
What's significant ... he returned to his parents' Florida home Sept. 1. And, the FBI first asked the public for assistance with Gabby's case around Aug. 28. She would later be reported missing on Sept. 11.
It's interesting ... the feds aren't linking the homicide to Laundrie, at least not yet. That's probably because there are still loose ends ... namely, there has to be probable cause to get a warrant for her death, and it's unclear if there's physical or other evidence at the crime scene linking Laundrie to the homicide. But, the indictment allows the feds to take Laundrie into custody ... that is, if they can find him.
The preliminary autopsy report has not been released, but it's expected any day. The manner of death will be critical in the investigation.

Closing arguments are going down Thursday in the federal court in Brooklyn, NY -- and defense attorney Deveraux Cannick drew the comparison by telling the jury Kelly is demanding prosecutors prove he's guilty beyond a reasonable doubt ... the same way Dr. King fought for Constitutional rights.
He went on to quote a part of MLK's "I've Been to the Mountaintop" speech, declaring ... "Somewhere I read of the freedom of speech. Somewhere I read of the freedom of assembly. Somewhere I read of the freedom of the press."
His point seemed to be that Dr. King wanted the government to uphold the Constitution, and Kelly's doing the same ... in his sex crimes trial.
Mind you, Kelly's attorneys only called a handful of witnesses to the stand during the trial -- most of whom merely stated they hadn't seen Kelly doing anything illegal. The singer himself chose not to testify, although that's not uncommon.
Cannick also claimed prosecutors encouraged witnesses to lie on the stand.
The jury will soon begin deliberations. Kelly faces 10 years to life if he's convicted.

Brian Laundrie Parents Stay Silent ... As Search For Gabby's Fiance Continues
Brian Laundrie's been missing for nearly 6 days now, and his parents are still not talking as the search for him continues as a person of interest in Gabby Petito's death.
Laundrie's mother and father were leaving their home in North Port, FL Thursday morning when they were asked if they have any info on his whereabouts ... and they had nothing useful to say.
This has been par for the course ever since their son showed up at their doorstep September 1 without Gabby, his fiancee, even though they were on a long trip across the country.
Brian's family has not been forthcoming with many details, other than letting authorities know he went missing last Friday after he was named a "person of interest" in Gabby's case. They said he took his backpack and went for a hike, but never came back.
As we reported ... Gabby's body was found 2 days later at a state park in Wyoming, a spot she and Brian are believed to have visited in the days after they had a domestic dispute in Utah.
The coroner ruled Gabby's manner of death homicide, and while the obvious suspect is Brian ... he's not officially been named one by police, at least not until they find out where he's at.

Gabby Petito and Brian Laundrie had an aggressive and public dispute days before she allegedly disappeared -- and things got so bad, the couple was booted from a Wyoming restaurant ... according to a possible witness.
A woman named Nina Celie Angelo says she and her boyfriend were at The Merry Piglets, a restaurant in Jackson Hole, August 27 and spotted the couple in a "blowout of a situation." Angelo says Gabby and Brian were sitting at the table next to hers.
Angelo claims Gabby was hysterically crying, and at one point Brian and Gabby were even fighting with the restaurant hostess before Gabby went out and stood on the sidewalk.
Angelo says she doesn't know what started the fight, but thought it had to do with the bill.
Brian allegedly came back into the restaurant several times to argue with staff after Gabby left, and Angelo claims he had an "aggressive" demeanor.
We called Merry Piglets to ask about the incident, but they had no comment. They would not specify if they've spoken to authorities, but Nina said she's reported all this to law enforcement.
Brian allegedly returned to his parents' Florida home on September 1 ... without Gabby.
As we've reported, Gabby's body was discovered by investigators Sunday afternoon in Wyoming. After an autopsy, the coroner ruled her death a homicide, but has not released a cause of death yet.
Meanwhile, Laundrie's whereabouts are still a mystery as the massive manhunt continues.

Evander Kane Denies Sexually & Physically Abusing Estranged Wife ... 'False Allegations'

Evander Kane says his estranged wife, Anna Kane, is straight-up lying ... saying in a statement Wednesday he NEVER sexually or physically abused her during their relationship.
Anna, though, says he did in fact do those things ... spelling out the allegations in new court docs, according to the San Jose Mercury News, that were filed in Santa Clara County earlier this week as part of her divorce case against Evander.
In the docs, Anna claims Evander forced her to have oral sex with him in March 2019 -- just after a funeral for their baby daughter.
Anna alleges the San Jose Sharks player then forced her to have intercourse again days later ... writing in the docs that Evander told her when she denied his advances, "you can’t rape your wife.”
"Evander again forced me, against my will," she said in the documents, "to have sexual intercourse with him even though I had not healed."
Anna claims Evander also roughed her up after one of his playoff games against the Las Vegas Golden Knights.
In the docs, Anna says after Evander had found out she had been drinking before the game with some of the other players' wives -- he snapped.
She says after the game, which the Sharks had lost, the 30-year-old winger, "began screaming at me and punching me on the upper side of my head above the hairline."
She added, "Evander grabbed my blouse forcefully and pushed me into the wall of the room, slapping me across my face. Evander was screaming at me and threatened to hurt me even worse if I 'disobeyed' him and had any drinks without him."
Evander, though, says it's all B.S. ... denying the claims in a lengthy statement issued by his attorneys.
"To be clear," Evander's attorneys said, "Evander denies ever abusing Ms. Kane or their daughter Kensington, whom he cherishes."
"He recognizes that they have many years ahead of them as co-parents, during which they will have to work together, which makes it that much more frustrating that she has chosen this path."
The attorneys added they're confident Anna's "lack of credibility" will be exposed at future court hearings.
Of course, this isn't the first time Anna has hurled accusations at Evander ... earlier this summer, she claimed the hockey player would bet on his own NHL games from to time.
Evander has vehemently denied those allegations, saying, "I love the game of Hockey and would never do any of what was alleged."
The NHL has launched an investigation into the claims.
Meanwhile, Evander, in his own court filings, has accused Anna of getting violent with him on several occasions in the past, including an incident where he claims she punched him in the face multiple times.
The next hearing in the couple's divorce case is slated for next week.

Gabby Petito Family To Laundrie's Lawyer ... Don't You Dare Use Her Photos!!!

Gabby Petito's family's going after the lawyer for Brian Laundrie's family for using one of her photos on Yelp ... and they're warning him he better not do it again.
The Petitos' attorney, Richard Benson Stafford, sent a cease-and-desist letter to attorney Steven P. Bertolino demanding that he remove the photo of Gabby from his Yelp business page ... and gave him a deadline of 2 PM Wednesday.
It seems Bertolino complied, because Gabby's pic no longer appears there, but Yelp has added a notice to his page saying his business is being monitored.
In addition, Gabby's family's warning Laundrie's family lawyer to not use any of her photos on any of his other accounts -- social media or otherwise -- to promote his business ... or they'll take legal action.
As of now, it doesn't look like Bertolino has any other accounts featuring photos of her.
Obviously, the situation between the 2 families is very tense ... as the coroner has ruled Gabby's death a homicide and her fiance, Brian -- a person of interest believed to be the last person who saw her alive -- is also missing.
With all that happening, legal issues are inevitable ... and this seems to be just the start.

Gabby Petito's death has put her fiance, Brian Laundrie, in the crosshairs of law enforcement, but TMZ has learned prosecutors are not making a move until 2 primary loose ends are tied up.
Law enforcement sources with direct knowledge tell TMZ ... Laundrie is their suspect, despite the fact he's being officially called a person of interest. That said, we're told federal prosecutors are now in a waiting game, in large part because they don't know if Laundrie is still alive.
What's more ... our law enforcement sources tell TMZ, even if Gabby was murdered -- which seems to be the case since the Coroner has already ruled her death a homicide -- they would need to prove who did it. Our sources point out, it's possible Laundrie left Gabby out in the wilderness and someone else killed her ... whether it's probable or not, it's still possible.
As for why federal prosecutors will handle the case, it's because Gabby was apparently killed in the Grand Teton National Park, which is federal land.
We're told law enforcement is viewing Laundrie as their prime suspect, but there's a leap between that and actually charging someone with murder.
As we reported, a witness called 911 and told the dispatcher Laundrie had slapped and hit Gabby shortly before she went missing.
The Coroner is expected to reveal the cause of death shortly.

Gabby Petito's body has, indeed, been recovered in Wyoming -- and the Coroner says this was a homicide.
As we reported, the Teton County Coroner was conducting the autopsy Tuesday on the remains cops found over the weekend in Grand Teton National Park. The Coroner's Office is now confirming the body is Gabby's. Attorney Richard Stafford said the same.
Before today, the feds simply said they believed it was Gabby. You'll recall the corpse was found near an area where the white van she and fiance, Brian Laundrie, were traveling in was spotted.
While Laundrie has not yet been named a suspect, the FBI is conducting a manhunt for him. As you know, Laundrie had returned to his parent's home in Florida ... without Gabby.
Plus, the guy has mysteriously disappeared without a trace ... although, there was a potential sighting this week. A man in Baker, FL reported that he believed he saw a man matching Brian's description pop up on his deer cam ... some 500 miles away from North Port, FL, where Brian lives.
Gabby and Brian had been on a cross-country road trip together for months now -- documenting their stops in a white van they'd taken out. Another thing that was also caught on camera was an alleged domestic disturbance ... the aftermath of which a police officer filmed on his body camera upon pulling them over.
While Gabby was distraught, Brian denied he'd hit her ... despite a 911 caller claiming he did exactly that. In any case, the cop cut both of them loose after they both refused to press charges.
Gabby has been unaccounted for since late August. Her family first reported her missing on Sept. 11 -- and believe Brian has something to do with her fate.

Gabby Petito's Fiance Brian Laundrie Possibly Spotted ... FL Cops Investigating Cam Footage
1:20 PM PT -- The Oskaloosa Co. Sheriff just released a statement saying they searched the area where the image was taken extensively and didn't find anything, or anyone, of interest. Cops searched using a drone, and checked nearby farmlands.
In a statement, cops said, "There are no known possible past or current connections between Laundrie and anyone in this area at this time to follow up on."
The hunt for Gabby Petito's fiance, Brian Laundrie -- who's believed to be the last person to see her alive -- may have broken wide open ... because someone thinks they spotted him about 500 miles from his Florida home.
Sam Bass says a man fitting Brian's description was seen on his trail camera set up in the wilderness in Baker, FL early Monday morning ... and he's alerted the authorities.
Bass' deer camera footage shows a man with a backpack trekking through the woods, and he certainly resembles Laundrie ... who was reported missing by his family after being named a person of interest in the disappearance of Gabby.
Folks were quick to point out Baker is about 450-500 miles away from Laundrie's home in North Port -- which would be quite a journey on foot over 4 days -- but the Okaloosa County Sheriff’s Office has confirmed it's actively looking into the footage ... but there's no confirmation it's Brian yet.
People have also pointed out that the man's backpack is similar to Laundrie's, and his parents told authorities he left with it on a hike Friday and never came back.
As we've reported ... the story of Gabby and Brian -- who were on a cross-country trip this summer and documenting it on social media -- garnered national attention when he returned to his Florida home without her on Sept. 1.
Gabby was reported missing 10 days later by her family, who claim Brian was not cooperative at all in trying to locate her, and the feds believe they found her body at a national park Sunday in Wyoming ... a place she was believed to have visited with her fiance.
There was also a domestic dispute between the couple in mid-August in Utah, but the authorities released them with no charges or arrests. A 911 caller from that incident said they had observed Brian physically attacking Gabby ... she went missing sometime after that.
On Monday, FBI agents tore up Brian's parent's home in Florida, searching for evidence and leaving with several boxes.
A makeshift memorial has already been set up at the site where the remains believed to be hers were found, though the autopsy confirming it's her has not been disclosed yet.

Nancy Grace says determining Gabby Petito's cause of death could be hampered by the wildlife of Wyoming -- but, adds, the fact her tattoos were ID'd offers a glimmer of hope.
The author and Fox Nation host joined "TMZ Live" Tuesday and said she's not sure Tuesday's autopsy will ultimately determine how Petito died ... or if her fiance, Brian Laundrie, was involved.
Her theory? The site where authorities found remains matching Gabby's description experiences such intense weather elements, it could have caused decay or damage to the body that might conceal markers the coroner would use to determine cause of death.
Nancy -- who's special, "A Gabby Petito Investigation" is streaming now on Fox Nation -- points out there's also a lot of wild animal activity in that area, and it's possible the creatures could have damaged the corpse.
That being said, Nancy says there's hope Gabby's body was found somewhat, if not fully, intact. Remember, the FBI said the body they found was "consistent with the description" of Petito.
Nancy says, that if authorities were able to immediately identify Gabby's tattoos -- on her left arm and right forearm -- it's possible her skin was still intact ... meaning the body could offer clues about what led to her death.
With all we know at this point, she sees 3 possible explanations for Gabby's disappearance and possible death. She also tells us why she thinks cops never named Laundrie a suspect.
As for Laundrie ... he's been missing for days now but a trail cam set up in the wilderness in Baker, FL may have spotted him. The FBI is investigating the possible sighting.
In the meantime, a memorial has been set up at the site where authorities believe they found her body.

Gabby Petito 911 Call from Utah Stop ... Alleges BF Brian Slapped Her

Gabby Petito's boyfriend, Brian Laundrie, allegedly slapped and hit her in the run-up to them being pulled over and questioned by a cop in Utah, shortly before she vanished ... this according to a 911 caller, who claimed to have witnessed violence.
FOX obtained the 911 call in question, which was placed on August 12 near Moab, Utah -- not too far from where Gabby and Brian were eventually pulled over later that day by a city cop, whose body camera captured a distraught Gabby ... and Brian unseemly denying anything had happened between them.
Check out the audio ... you hear a man tell the operator he's calling to report a domestic dispute he says he saw in town, going on to paint a picture of the white van Gabby and Brian had been traveling in, while also providing a license plate number ... and descriptions of both of them.
When the operator asks point blank what he saw them doing ... the guy doesn't hesitate -- he says he saw the man slapping and hitting the female, then both of them running up and down the sidewalk ... and finally jumping into the van and driving off.
Not long after this, Gabby and Brian were, in fact, stopped by a Moab officer and questioned. While neither Gabby nor Brian admitted to any physical confrontation -- it was clear the former was having a hard time and going through some sort of a breakdown, as she started to cry in front of the cop. Brian, for his part, said they'd just been arguing ... nothing more.
Interestingly enough, FOX reports that an official police account of this entire incident claimed "no one reported that the male struck the female" -- which appears to be contradicted here.

As we reported ... the feds announced Sunday that they believe they found the remains of Gabby's body in a national park in Wyoming, one of the last places she's said to have been with Brian -- who came back to Florida solo, and who has since gone missing himself.
Police have called him a person of interest, but have stopped short of saying he's a suspect -- however, they are searching his parents' home, where he lived, which is being deemed a crime scene.

The body believed to be that of Gabby Petito -- a travel blogger who's been unaccounted for, for at least a few weeks now -- has been found.
Authorities announced Sunday they discovered what they believe to be the remains of Petito during a vast search across Grand Teton National Park in Wyoming -- among parts of the country -- which is one of the places she and her boyfriend, Brian Laundrie, had recently visited on a monthslong, cross-country road trip to the west coast ... which they were documenting online.
A rep for the FBI says while forensic tests have not yet been completed, the body they discovered is consistent with Gabby's. Petito's family has also been notified ... but there is not yet a cause of death.

Gabby's family first reported her missing on Sept. 11 -- this after not hearing from her since late August ... and following Brian's return to North Port, FL, sans Gabby. Up until this past Friday, Laundrie and his family had reportedly refused to speak with investigators ... but then his own loved ones reported him missing, saying they'd last seen/heard from him on Tuesday.
The Petito's have claimed that Brian went radio silent on them when they tried to get answers -- namely, why he'd returned by himself in their shared van, where he last saw her, and why he would leave her alone?

It goes without saying ... her fam suspects Brian is mixed up in her disappearance, claiming he isn't missing ... but simply hiding. Police have said he isn't a suspect quite yet, but certainly a person of interest. Now, a search is underway to find Brian as well.

Adding to the speculation is bodycam video from a Utah officer who had a run-in with Gabby and Brian near Arches National Park prior to her vanishing -- and it sounds like there was a squabble between the couple.
You can see Gabby breaking down in tears when the officer asks what was going on after pulling them over on the side of a road, as she explains she has OCD. Brian, for his part, told the cop they were just arguing and that there wasn't anything to be alarmed about.
The case, of course, has become the biggest talked about story for a while ... and has captured national headlines.
For now, it appears only Gabby has been located -- and, sadly, she isn't alive. She was only 22.

1:29 PM PT -- Murdaugh just appeared in a South Carolina court, going in front a judge and being read the charges against him.
10:38 AM PT -- Murdaugh has just turned himself in. He reportedly pulled up to the Hampton County Law Enforcement Center in a beige SUV. Murdaugh was booked at the Hampton County Detention Center and is expected in court later in the day.
The disgraced lawyer faces a slew of charges ... including insurance fraud, conspiracy to commit insurance fraud and filing a false police report.
"Dateline" correspondent Josh Mankiewicz knows the bizarre murder/assisted suicide case of South Carolina's Murdaugh family is right up his show's alley -- and he's totally into it -- but he says the location is a bit off.
Josh was leaving The Palm in L.A. Wednesday when we got his take on the endless twists surrounding prominent lawyer Alex Murdaugh, and the unsolved murders of his wife and son.
For starters, Josh, like everyone else, says the case is riveting and people are asking him about it nonstop. Comes with the territory when you're the go-to guy covering true crime cases.
For the uninitiated ... Murdaugh found his wife, Margaret, and 22-year-old son, Paul, shot dead outside their home in June -- and police have yet to make any arrests in that case.
Fast forward to September 4 ... when Murdaugh got shot in the head, but survived. He now admits he hired a hitman to kill him so his surviving son could collect a $10M life insurance policy. The shooter's already been arrested and charged with assisted suicide, and Murdaugh's expected to surrender to authorities Thursday.
Josh is blown away by all of this, and that's coming from a "Dateline" vet who's seen it all ... so, ya know we're in uncharted true crime waters. In fact, he says one of the strangest parts of the case is that it's NOT happening in Florida!
Apologies to the Sunshine State, but y'know ... some insane stuff does happen there. 'Memba this and this??? Anyway, Josh also has a tip for Alex Murdaugh, although we suspect it's too late to help him now.
BTW ... S.C. officials announced they're also opening a new investigation into the 2018 death of a housekeeper at Murdaugh's home. 😲

Soccer Star Reece James My Home Was Burglarized ... And I Caught The Cowards On Video!!!
Reece James -- a Chelsea soccer star and member of England's national team -- claims his home was burglarized Tuesday ... and he says it was all captured by security cameras.
James says the incident went down while he was away from his house playing in a game for Chelsea ... claiming the footage shows clear as day how thieves stole a giant safe from his home.
In the video, you can see what appears to be four men pushing their way through a gate on James' property to get access to his house.
The men then appear to look into James' windows ... before breaking in using a giant sledgehammer.
James says you can see in the video the guys stole a safe from his place ... and then hauled it all the way outside and into a getaway car.
"They managed to collectively lift a heavy safe containing some personal items of mine into their car," James said.
The 21-year-old footballer says some of his priceless soccer awards were in the safe ... adding that law enforcement has been notified and is investigating.
"I am appealing to all my Chelsea and England fans to help identify and turn in these low life individuals who will never be able to rest easy as the evidence is mounting against them," James said.
"The police, my advisers and Chelsea FC (and many others) are all behind me as we have firm leads on who the perpetrators are. We are closing in on them."
James said, thankfully, nobody was home or injured during the incident.
"I want to let all of you know I am safe and well," James said. "I really do appreciate having the platform to tell you all about my misfortune and I hope together we can catch these individuals and deliver justice where it is due."

Marilyn Manson's rape accuser just had her lawsuit against the shock rocker tossed out of court ... TMZ has learned.
According to new legal docs, obtained by TMZ, the judge dismissed the suit Tuesday, ruling the statute of limitations had passed on the woman's claims.
TMZ broke the story ... Manson was sued back in May by a Jane Doe who claims they started dating in 2011 before things took a turn for the worse and he raped her.
Manson's accuser claimed she repressed her memories of the alleged rape ... but the judge dismissed the suit because the woman couldn't specify how her memory was repressed, or why she didn't learn of it earlier.
While this lawsuit is dismissed, for now, we've told you Manson is also being sued for sexual assault by 3 other women ... including his former assistant and "Game of Thrones" star Esme Bianco.
It should also be noted the court has given the woman 20 days to refile the complaint and address the judge's concerns about her allegedly repressed memories and the statute of limitations.

Fayne had cut a plea deal with prosecutors ... who agreed to drop 14 other charges and recommend Fayne get a 151-month sentence. Instead ... the judge hit him with nearly 5 more years behind bars. The silver lining ... he was staring down a possible 30-year sentence if he didn't cut that deal, so take that for what it's worth.
