And sources connected with Tony tell TMZ ... Tony and Eva were well aware that the divorce would be filed. We're told Tony was planning on filing for divorce in San Antonio, Texas because it was more convenient, but, "Eva talked him out of it because she wanted to file in Los Angeles."

Sources also tell us -- contrary to the statement Eva's rep made to TMZ -- Eva not only knew she was filing for divorce, but it was timed to coincide with the Us Weekly interview.

The 60-year-old former teen idol was spotted weaving on and off the road a number of times on Florida's Turnpike around 8:00 PM ... and was eventually pulled over by a member of the Florida Highway Patrol.

According to cops, Cassidy told the trooper that he'd had a glass of wine around lunch time and popped a hydrocodone painkiller a few hours before the arrest.

In his report, The trooper claims he instructed Cassidy to get out of the car -- and dude was "swaying while standing." Cassidy took a breath test and blew a 0.139 and 0.141 -- way over the .08 legal limit.

The trooper then searched the car and turned up a half empty bottle of Labrot Graham Woodford Reserve Kentucky Bourbon in the back seat.

We're told Cassidy was taken to a nearby jail and booked for DUI. He was released this morning at 3:22 AM on a $350 bond.

David Cassidy is adamant that he was NOT hammered on booze when he got behind the wheel in Florida last night ... and says he plans to fight the DUI charges tooth and nail.

David's rep, Jo-Ann Geffen, tells TMZ ... the former teen idol admits he did take a pain pill for his back earlier in the day -- and may have been tired from an early morning funeral he had to attend -- but he definitely wasn't drunk.

Cassidy is also disputing the results of the two breathalyzer tests he took at the time of arrest -- insisting his true blood alcohol content was not properly measured.

Cassidy's rep tells us the actor is already on the hunt for a lawyer and plans to fight the charges adding, "He would never jeopardize anyone on the road and he would not have been driving had he not had to go to a funeral ... he's never been arrested in his life before for anything."

Sources close to Anderson tell us the 22-year-old was "extremely afraid" of Sheen during the hotel incident. Anderson is telling friends she decided to call hotel security because she felt "threatened" by the sitcom star.

And there's more... We've also learned Capri has lawyered up and plans to ask the D.A. in Aspen to violate Charlie's probation in his domestic violence case, on grounds he allegedly threatened her in the hotel room. BTW, we're told Capri never told NYC cops she was threatened.

As for what set Charlie off in the hotel room, sources tell us the actor noticed that a $100,000 watch had gone missing and he believed Capri took it. We're told the watch has not been found.

New York City police were called by security at The Plaza Hotel, who reported a disturbance in Charlie's suite. When cops entered just after 2 AM, they found Charlie drunk and naked. Chairs had been thrown around the room and a chandelier was damaged.

We're told an unidentified woman in the room told cops Charlie flew into such a rage that she locked herself in the bathroom and called security. There's also a report out that Charlie accused the woman of stealing his wallet.

Police sources say Charlie went voluntarily and that Charlie was "intoxicated, irrational" and "emotionally disturbed." Law enforcement sources tell TMZ Charlie was "emotionally disturbed" and they gave him a choice -- go to the hospital or jail. Charlie chose option 1.

Sources who have spent time with Charlie recently say he's been "a tortured soul for months" and his friends openly talked about how they feared for his life. Another source very close to Charlie echoed the fear that Charlie's most recent downturn could end tragically.

Charlie's rep just put out a statement that the actor was hospitalized after suffering an allergic reaction to medication ... though the information conflicts with what TMZ has confirmed ... that drinking was a factor.

"Two and a Half Men" is on hiatus this week and Charlie isn't due back on the set until next Tuesday. We're told producers have a jet ready in NYC to fly Charlie home today.

Sources connected with the actor tell us he'll fly into L.A. this evening and he'll go right home. Sheen won't be staying at Promises in Malibu -- where he's stayed on and off since earlier this year.

People connected with the show tell us ... Charlie doesn't think he needs to go back to rehab, even though some of his friends and associates tell us the situation is pretty desperate.

Cops did not find any evidence of drug use in Charlie Sheen's NY hotel room early this morning ... this according to law enforcement sources.

Junior Seau drove his SUV off a cliff in Carlsbad, CA this morning -- and survived -- this according to law enforcement.

We're told the retired NFL superstar sustained injuries in the wreck -- cops are on scene. TMZ obtained these photos of Seau's Cadillac Escalade which landed at the bottom of a cliff several feet from the beach.

Seau has been transported to a local hospital. The accident happened just south of Oceanside, CA ... where the former San Diego Charger had just been released from jail hours earlier.

As TMZ first reported, Junior Seau was arrested early this morning for domestic violence.

Aguilera cited "irreconcilable differences" in her divorce petition, which was filed today. It's an interesting twist, since sources tell us Christina is the one who cheated.

According to the divorce docs, there is a prenup. The divorce petition asks that "Earnings and accumulations of [Aguilera] before marriage, during marriage and from and after the date of separation" be considered separate property.

Aguilera, who is represented by disso-queen Laura Wasser, lists the date of separation as September 11, 2010.

The petition also seeks to terminate Bratman's ability to get spousal support.

Aguilera is seeking joint physical and legal custody of their child, Max, who is 2.

Sources connected with the couple tell TMZ the marriage fell apart after Aguilera allegedly cheated on Bratman. Aguilera's side refused comment.

A close relative of Toni Braxton tells TMZ ... the singer's financial undoing can be traced back to her show in Las Vegas.

The relative tells us Toni took out "show insurance" through Lloyds of London for her act at the Flamingo Las Vegas Hotel and Casino back in 2007.

When Toni was diagnosed with a heart condition -- in the middle of the show's run -- she had to pull the plug, but she was still on the hook to the Hotel for big bucks. Toni expected Lloyds to cover the loss but Lloyds didn't, arguing Toni had a undisclosed, preexisting medical condition, rendering the policy void.

In the end, Toni had to absorb a huge loss, which the relative claims sent her on a downward financial spiral.
