Teddi Mellencamp's soon-to-be ex-husband is responding to her recent divorce petition ... and, he's specifically saying they've got a prenup he wants the court to enforce.

Edwin Arroyave filed a response to Teddi's divorce petition in Los Angeles Friday ... listing the date of separation as November 1 despite Teddi's claim they split on October 20.

Arroyave is also claiming there’s a premarital agreement in place ... which he wants to be enforced when it comes time to divvy up the assets.

Here's the deal ... the former lawyer and alleged fixer to President-elect Donald Trump said back in September he'd leave the country if DJT won relection -- joking he was "already working on a foreign passport with a completely different name."

Cohen also says he'd have to leave his wife and kids behind because he doesn't want them moving to the country he plans to flee to. Clearly, he was joking ... but, a few internet trolls didn't forget.

Liam Payne did not commit suicide, according to the prosecutor in charge of the case in Argentina ... a law enforcement source in Buenos Aires tells TMZ.

We're told the prosecutor in the case has officially ruled Liam did not die by suicide, stating the effects of the drugs the One Direction alum took caused him to fall to his death from the balcony of his suite at the CasaSur Palermo Hotel back on October 16.

As we told you Thursday, 3 people have been arrested in the case -- a housekeeper at the hotel, a friend of Liam's, and an alleged drug dealer ... this after multiple raids conducted by local police.
